  • Prohibition of discrimination in social security law

    The article starts with non-discrimination rules in general, examining its strengths and weaknesses: on the one hand, non-discrimination law is rooted in one of the most common and widely ... acknowledged legal principles, the principle of equality. Furthermore, prohibition of discrimination is a basic individual right, and a human right at the same time; and it is not restricted to specific matters of substance, or to specific areas of regulation. On the other hand, there is a particular structure of the right to equality and the prohibition of discrimination which leads to a certain weakness. For their formal structure, non-discrimination rules cannot be qualified as social rights in a strict sense, nor do they have a specific content: With regard to social security, equality rules do not protect against cutbacks in social benefits and they do not yield any normative basis to answer the question as to how much social protection has to be guaranteed. In a second step, the article explores, primarily referring to EU law, the prohibited grounds of discrimination which have a specific influence on social security law, namely gender, nationality and age. It can be stated as a general principle that equality rules are regulated to a much lesser extent in social security than in employment relations.
