    The basic principle of the Law of Torts is, that everyone has the right to thecompensation for the injury if there is a wrongful conduct, a harm, and causation between the two and if the person ... commits the tort with an intent ornegligence. The conduct of the physician is wrongful if he makes an medical error with an omission of due care or if he treats a patient without his informed consent: There is an exception to the requirement of obtaining the patient's consent when an emergency need to treat a patient exists and the patient is unable to give an informed consent due to illness or injury. Even if the physician has breached his duty of proper disclosure to his patient, there is no liability if the patient suffers no harm. To find out if there is harm it is necessary to compare the health condition of a patient before and after undertaking treatment.
