Criminal law is omnipresent in every society and it dictates how its members ought to act. Due to its vital importance, criminal legislation needs to be written in a simple and understandable ...language. Yet this seems not to be the case, since legislative texts often prove to be demanding, confusing and too complex for people to understand. Translators who deal with this type of texts find themselves in a unique position of not only having to understand, but also to produce legal texts in another language. In order to achieve top quality translations, they need an in-depth linguistic knowledge of the source and target language as well as knowledge of both legal systems involved. This thesis consists of two parts. The first, theoretical, part introduces and describes concepts such as legal language, legal texts, legal norms, criminal code and translation of legal texts. The second, empirical, part deals with a portion of the Slovene criminal code and its equivalent passage in the Austrian criminal code in order to determine similarities and differences between the two codes in terms of content, sentence structure and language. Regarding the content, more differences were discovered than similarities. With respect to the structural analysis, the conclusion was drawn that, in most cases, the element of a crime is given first, followed by a legal consequence. The linguistic analysis, which was carried out on the basis of three categories (nominalization, passive voice and relative pronouns), showed that all these elements are used in order to achieve abstractness, anonymity, impersonality and succinctness of the language used. Contrary to popular belief that Slovene is a language prone to use verbal structures, more passive constructions were found in the Slovene criminal code. The Austrian criminal code, on the other hand, contains several active expressions with a passive meaning, a feature that was not found in the Slovene part.
