  • Slovene views on the succession of states

    Special feature of the dissolution of the former SFRY lies in the fact that the successor States have not reached an agreement on the fundamental state succession issues, contrary to the case of the ... former SU and the former Czech and Slovak Federation. Namely, one of the successor Statesto the former SFRY, i.e. the FRY (Serbia and Montenegro), claims for itself the position of the predecessor state. Therefore, at the negotiations among the successor States of the former SFRY, it has been impossible to come to an agreement on the succession of states issues, inter alia the definition of state property, the inventory of this property and the key of distribution of assets and liabilities of the former SFRY. Slovenia holds the position that these negotiations are based on international law on state succession, including the two Vienna Conventions on the Succession of States of 1978 and 1983. The aim of the Opinions of the Arbitration Commission of the Conference on Yugoslavia has been to give interpretation of individual succession of states matters. Due to inconsistency in respect of the implementation of the relevant resolutions of the Security Council and the General Assembly of the UN, which have confirmed the fact that former SFRY ceased to exist, the question of the membership and the seat of the former SFRY in the UN remains unsolved. This additionally burdens the succession of states of the former SFRY.
