Der Beitrag wendet sich gegen eine in zwei »Schulen« der politischen Staatsrechtswissenschaft vertretene Lesart der Weimarer Republik, die für deren Untergang legitimitätsschwache »dilatorische ...Formelkompromisse« der Entstehungszeit (C. Schmitt) bzw. mangelnde Fähigkeit der entstandenen Verfassungsordnung zur »Integration« (R. Smend) verantwortlich machen will. Statt dessen werden zunächst die Gründungsintentionen von 1919 rekonstruiert, unter wesentlichem Rückgriff auf die Konzeption des Verfassungsautors H. Preuß und der ihn tragenden demokratischen Parteien. Daraufhin läßt sich die Phase einer beginnenden Distanzierung der Verfassungspraxis von solchen Ursprüngen auf die Zeit vom Herbst 1922 bis Frühjahr 1924 verorten, als zunehmend unparlamentarisch regiert wurde, obgleich im Reichstag zuvor noch republikloyale (Zweidrittel)-Mehrheiten aufgeboten werden konnten. Die erst unter der Präsidentschaft Hindenburgs (seit 1925) auflebende Staatsrechtsdebatte ratifizierte insofern auch den eingetretenen schleichenden Verfassungswandel zu einer bereits »anderen Republik«.
Einer Betrachtung des organisatorischen Potentials mit Blick auf die Standesidentitaet und Interessenkohaerenz schliessen sich Fragen nach Struktur und Perzeption einer Mittelstandsposition an. Vor ...diesem Hintergrund koennen die politischen Orientierungen im Kontext ungleichzeitiger kommunaler Entwicklungsmuster in Berlin und Wien interpretiert werden. Nach Analysen der Mobilisierungs- und Radikalisierungsprozesse in der Nachkriegsdekade ist eine vorlaeufige Bilanz moeglich.
In seiner konzeptiven Bedeutung für die politische Theorie ist Hugo Preuß bislang gründlich verkannt worden. Der vielbeachteten publizistischen Anbahnung seiner politischen Rolle als Verfassungsautor ...des Jahres 1919 ging ein wissenschaftliches Gesamtwerk voraus, das in mehrfacher Hinsicht zukunftsweisend war: Innerhalb der preußisch-deutschen Staatsrechtslehrer blieb er über Jahrzehnte der profilierteste Demokrat, der zu einer „westlich“-pluralistischen Traditionslinie politischen Denkens einen maßgeblichen Beitrag leistete. Dabei löst sich seine Argumentation mit der politisch-philosophischen Kritik des einflußreichen Souveränitätsbegriffs zugleich vom monistisch-nationalen Staatsverständnis eines vielbeschworenen Herrschaftsmonopols. Auf diese Weise öffnet Preuß neue Horizonte für den Völkerrechtsuniversalismus ebenso wie ein kommunales „Selfgovernment“ und legt den Grundstein zu einer Konzeption des modernen Verfassungsstaates, die das Erbe einer Aufklärungstradition von „öffentlicher Meinung“ der „Bürgerassoziationen“ in den parlamentarisch-massendemokratischen Parteienpluralismus zu transponieren trachtet. Darin erweist sich Preuß - am ehesten mit dem freilich stärker rechtstheoretisch denn politiksystematisch orientierten Hans Kelsen inhaltlich übereinstimmend - als überzeugende zeitgenössische Alternative nicht nur zu Carl Schmitt, sondern auch gegenüber Max Weber oder Hermann Heller, deren Wortmeldungen im Umkreis des Diskurses über das Souveränitätsproblem im folgenden mit einigen Vergleichsaspekten ebenfalls thematisiert werden. Until recently, the conceptual importance of Hugo Preuß has been thoroughly undervalued in political theory. While his role as father of the Weimar constitution of 1919 is widely known, his preceding scientific publications, which in many respects indicated future trends of his thinking, have not been widely publicized. For decades, he was the best known democratic politician among German-Prussian constitutionalists and contributed decisively to a "Western" pluralistic tradition of political thought. It is noteworthy that his politico-philosophic criticism of the influential concept of the nation-state based on the legitimate use of power. In doing so, Preuß opens up new horizons for universalism in international law as well as for municipal "self-government". He also establishes the foundation of the concept of a modern constitutional state which seeks to transmit the heritage of the enlightenment, especially the elements of "civic association" and "public opinion" to parliamentary democracy and party pluralism in the mass democracy. In this respect, Preuß, following the more legal theoretical than systematic political approach of Hans Kelsen, represents a convincing contemporary alternative not only to Carl Schmitt but also to Max Weber and Hermann Heller. The contributions of the latter to the problem of sovereignty are discussed on a comparative basis with those of Preuß.
