The study aimed to determine the push and pull factors and the impact of the pandemic and the opening of the Austrian labour market for Croatian citizens in 2020 on the migration of Croatian citizens ...to Austria after Croatia entered the EU. The study was conducted using qualitative methodology, i.e., semi-structured interviews as the main research method. The results showed that, in addition to the influence of economic and personal factors on emigration from Croatia, social migrant networks stood out as a strong pull factor for respondents to migrate to Austria. Nevertheless, some respondents, regardless of family and friends in other countries, migrate to Austria for its better living and working conditions. The pandemic and the opening of the Austrian labour market in 2020 were at one time an obstacle to emigration for some respondents, and their experiences indicate that in the next few years the number of Croats who immigrate to Austria could increase, both due to delayed emigration from Croatia and the migration of Croats from Germany.
The monograph ('I live in Bukov Vrh ('village') below Bukov vrh ('hill')') contains eight different proposals for writing the initial in the non-first components of multi-word geographical proper ...names. The proposals were presented at the open conference ““Meeting of two commissions”“ in June 2019. The motives that triggered the discussion on spelling reform and the decision to consult with the general public before the final decision of the spelling commission are presented. A survey will be prepared, presenting the views of the debaters, presented in the present monograph. The views of the chapters in the central part of the monograph can be summarized in three groups: the first group advocates a more comprehensive reform, which is reflected in the technical solution of writing geographical names - ““all components of the name with a capital letter”“~the second group does not advocate technical reform at the outset, but focuses on clarifying the rules and abolishing the division into settlement and non-settlement names~the third group does not support any changes.
Das neue unionale Datenschutzrecht ist, entgegen mancher Befürchtung, kein law of everything. Vielmehr müssen unterschiedliche Rechtsmaterien ineinandergreifen, um eine sachgerechte Regelungsstruktur ...im Schnittbereich von Datenschutzrecht und Privatrecht aufzubauen. Philipp Hacker bestimmt das Verhältnis dieser Rechtsmaterien, insbesondere von DS-GVO und BGB. Denn die Verschränkung unterschiedlicher Technologieformen fordert mehr denn je ein rechtsbereichsübergreifendes Verständnis von juristischer Dogmatik und ein interdisziplinär fundiertes Konzept von Regulierung. Auf Basis des geltenden Rechts entwirft er ein integriertes Marktordnungsrecht für digitale Austauschverhältnisse. Die Untersuchung schließt mit Reformperspektiven, die aufzeigen, wie die informierte Einwilligung durch eine technologische ersetzt werden kann, um eine privatautonome Gestaltung von Rechtsverhältnissen unter den Bedingungen der digitalen Wirtschaft zu ermöglichen. Die Arbeit wurde mit dem Wissenschaftspreis der Deutschen Stiftung für Recht und Informatik 2020 ausgezeichnet.
V prispevku predstavljamo razvoj pogojev za dopustnost državne pomoči premogovni industriji, začenši s pravnimi predpisi Evropske skupnosti za premog in jeklo, potem predpisi Evropske skupnosti in ...danes Evropske unije. Oblikovali smo tezo, da se je v povezavi s potekom Regulative Sveta EU št. 1407/2002 dne 31. decembra 2010, na osnovi katere je Evropska komisija dovolila pomoč rudarski industriji v različnih državah članicah EU v obdobju pred začetkom finančne in ekonomske krize in ki je postala vzrok za uvedbo novega predpisa o državni pomoči rudarstvu v obliki Odločitve Sveta EU 2010/787/EU o olajševanju zaprtja nekonkurenčnih rudnikov premoga, intenzivnost pomoči rudarski industriji v zadnjih letih povečala.
This article presents the evolution of the conditions of state aid admissibility to the coal industry, starting with legal regulations within the European Coal and Steel Community, the European ...Community, and now the European Union. The thesis was formulated that, in connection with the expiry on 31 December 2010 of Council regulation No. 1407/2002, on the basis of which the European Commission allowed aid for the national mining industry in different member states in the period before the onset of the financial and economic crisis, the immediate cause of introduction of the next regulation for mining state aid in the form of Council Decision 2010/787/EU on state aid to facilitate the closure of uncompetitive coal mines was the increasing intensity of the aid for the mining industry in recent years.
V prispevku predstavljamo razvoj pogojev za dopustnost državne pomoči premogovni industriji, začenši s pravnimi predpisi Evropske skupnosti za premog in jeklo, potem predpisi Evropske skupnosti in danes Evropske unije. Oblikovali smo tezo, da se je v povezavi s potekom Regulative Sveta EU št. 1407/2002 dne 31. decembra 2010, na osnovi katere je Evropska komisija dovolila pomoč rudarski industriji v različnih državah članicah EU v obdobju pred začetkom finančne in ekonomske krize in ki je postala vzrok za uvedbo novega predpisa o državni pomoči rudarstvu v obliki Odločitve Sveta EU 2010/787/EU o olajševanju zaprtja nekonkurenčnih rudnikov premoga, intenzivnost pomoči rudarski industriji v zadnjih letih povečala.
The single market and trade policy are Europe's major economic achievements and its best assets in times of increasing globalisation. The single market and trade policy, by allowing people, goods, services and capital to move more freely through both Member States and the world, open up new opportunities for citizens, workers, businesses and consumers, creating the jobs and growth Europe so urgently needs. This collection of essays addresses the various facets of these two pillars of European integration. A more efficient single market creates the conditions for a more open trade policy, and vice-versa. Growth has been lacking in Europe in recent years, and enhancing these two assets is the most fruitful way to find it again.
Biotska raznovrstnost v kmetijstvu zajema, med drugim, prostoživeče živali, s katerimi upravlja človek. Posamezne osebke lahko redimo, gojimo ali vzrejamo za proizvodnjo hrane, volne, kož, krzna oz. ...druge gospodarske namene, ali pa za družbo, rekreacijo, varstvo ali pomoč človeku. Odvisno od tega jih različno obravnavamo. Za pravno ureditev področja rabimo jasno opredeljene in usklajene termine. V Sloveniji na področju gojenja oz. reje prostoživečih živali ni zakona, ki bi dejavnost celovito urejal, zato je bilo težišče raziskave na rabi terminov: živali (divjad) v ujetništvu, gojene živali (gojena) divjad, rejne živali oz. živali (divjad) v reji, znotraj predpisov, ki se vsebinsko prekrivajo. S pregledom dokumentov sem ugotovila, da raba omenjenih terminov v slovenski zakonodaji ni usklajena. Termine je potrebno uskladiti in doreči, pri čemer je bistveno upoštevati način rabe živali. Na podlagi sinteze ugotovitev sta oblikovana predloga za razdelitev in rabo proučevanih terminov ter osnovno spremembo predpisov. Oblikovan je tudi shematski prikaz vsebinskih razlik med predlaganimi termini.
Biotska raznovrstnost v kmetijstvu (BRK) vključuje dele biotske raznovrstnosti, povezane s kmetijstvom in pridobivanjem hrane, med katerimi imajo poseben pomen genski viri. Temeljna izhodišča pravne ...ureditve varstva okolja in ohranjanja naravne dediščine so zapisani v Ustavi Republike Slovenije. V Sloveniji imamo celosten pristop urejanja pravnega varstva okolja, pri katerem je na samem vrhu celostni Zakon o varstvu okolja. Pod njim so posamezni zakoni, ki razčlenjujejo njegove določbe ter jih prilagajajo posebnostim varstvenega področja. Na področju varstva biotske raznovrstnosti in naravnih vrednot imamo Zakon o ohranjanju narave (ZON). Analiza je pokazala, da Zakon ne obravnava kmetijske biotske raznovrstnosti ter da se je njeno varstvo oblikovalo znotraj kmetijske zakonodaje, neodvisno od okoljske. V predpisih obeh se uporabljata neodvisni vrednostni lestvici naravnih dobrin (naravne vrednote oz. avtohtone sorte in pasme), ki nista povezani v logično celoto. Vključevanje varstva biotske raznovrstnosti v kmetijstvu v sistem okoljske zakonodaje bi bilo mogoče s spremembo ZON, in sicer z določilom o prenosu pristojnosti za agrobiodiverziteto na kmetijsko zakonodajo. Ustrezna povezava med okoljsko in kmetijsko zakonodajo na področju varstva genskih virov v kmetijstvu bi bila smiselna uporaba statusa naravne vrednote za tiste dele BRK, ki imajo za Slovenijo določeno kulturno, zgodovinsko in/ali znanstveno vrednost.
