The volume brings together academics and practitioners from across the EU to address the question of 'facultative mixity' in the EU's external relations, i.e. the situation whereby both the EU and ...its Member States enter into an international agreement with a third country even if legally the EU could act on its own.
Porast fleksibilnih oblik zaposlitvenih razmerij je zaznati tudi v slovenskem novinarstvu. Te oblike so pogosto tudi prekarne, kar (lahko) ima negativne posledice za kakovost novinarskih vsebin in ...ogroža vlogo novičarskih medijev kot nadzornikov oblasti. Avtorji prispevka utemeljujemo tezo, da so za pravno neurejen prekarni položaj novinarjev, ki omogoča pritiske na novinarje in pomeni grožnjo svobodi izražanja, odgovorne državne oblasti. Analiza primerov iz sodne prakse Evrops-kega sodišča za človekove pravice in Ustavnega sodišča Republike Slovenije je potrdila, da morajo državne oblasti aktivno zagotavljati pogoje za delo svobodnih medijev. Če država v zakonodaji do-pusti prekarno delo novinarjev, krši svoje pozitivne obveznosti v zvezi z varstvom svobode izražanja, saj politiki in kapitalu omogoči, da novinarje postavlja v odvisen položaj. Analiza ključnih doku-mentov je pokazala, da so v Sloveniji po letu 2002 zlasti novinarske organizacije redno pozivale k ureditvi razmer. Državne oblasti so bile s problematiko prekarnega dela ter s predlogi sprememb in dopolnitev zakonodaje seznanjene oziroma pozvane k ukrepanju, vendar problema prekarnosti sistemsko še niso uredile.
Die Mitgliedstaaten der EU dürfen sich im Rahmen eines transparenten Vergabeverfahrens unter bestimmten Voraussetzungen sozialer Zuschlagskriterien bedienen. Zur Untermauerung dieser These schlägt ...die Arbeit einen Bogen zum Beihilfenrecht und zieht Lehren aus der Altmark-Rechtsprechung des EuGH zu Dienstleistungen von allgemeinem Interesse. Dazu stellt die Untersuchung Bezüge zu dem Querschnittsinstrument mainstreaming her und macht die EuGH-Rechtsprechung zu affirmative action-Maßnahmen fruchtbar. Sie widmet sich speziell dem Kriterium der Tariftreueverpflichtung und nimmt eine sorgfältige Verhältnismäßigkeitsprüfung sozialer Vergabekriterien als Instrument staatlicher Regulierung vor. Schließlich werden anhand der gefundenen Ergebnisse die neuen Vergaberichtlinien 2004/17/EG und 2004/18/EG untersucht.
In an International Community characterized by the weight of state sovereignty the interpretation of international norms (by states, International Organizations and judicial and arbitral bodies) is ...one of the key points of this legal order. State sovereignty conditions the creation and application of International Law as well as the settlement of disputes. Thats why the intervention of judicial and arbitral bodies acquire a great importance. This work contents a comprehensive and critic approach to international judicial and arbitral case law concerning interpretation of international norms and international institutions as well as to the way the International Court of Justice conceives access to its jurisdiction ant its exercise. So, conventional instruments and instruments of a statutory nature, customary norms, institutional norms of the United Nations, unilateral declarations, as well as procedural instruments, facts alleged and the exercise of the jurisdiction attributed to the International Court of Justice in the way they have been interpreted by the Court constitute the object of a work surely useful for persons involved in international practice, studies or teaching.
