Avtorja se uvodoma ukvarjata z vprašanjem »tujosti«, ki se pojavlja v več intenzitetah: državljanstvo posameznika je le eden od dejavnikov, ki vplivajo na njegovo družbeno sprejemanje ali zavračanje. ...Po pregledu stanja v evropskih zaporih avtorja v osrednjem delu analizirata položaj tujcev v slovenskem kazenskopravnem sistemu, kjer je mogoče zaznati zaostrovanje pri obravnavi tujcev – več obsodb in več tujcev v zaporih v zadnjih letih. Temu nasprotne rezultate pa pokaže podrobnejši pregled kaznivega dejanja umora (in uboja), v katerem avtorja ugotavljata, da je kaznovanje tujcev celo manj punitivno kot kaznovanje domačih državljanov in za to ponudita nekaj morebitnih razlag.

Ključne so: zmanjšanje stroškov za kar 80 %, poenostavitev postopkov in uvedba enotnega patentnega sodišča. Intelektualna lastnina bo z enotnim patentom pridobila pomen. Toda strokovnjaki opozarjajo, da lahko novi patent povzroči nove oblike neželenega vedenja, kot sta izbira najugodnejšega sodišča (ang. forum shopping) in pojav patentnih škratov. V raziskavi želim predstaviti predvsem obe plati, prednosti in slabosti, predvideti, kakšne učinke bodo imele na poslovanje podjetij, zajeti čim širši krog strokovnjakov ter prikazati njihove poglede na tematiko.
In February 2013, the European Union successfully completed more than 30 years of negotiations and formally signed an agreement establishing a single European patent. The agreement brought about a ...more competitive patent law compared with that in the United States and Japan. The agreement resulted in a number of advantages, especially for small and medium-sized enterprises, such as the reduction of costs by as much as 80%, simplification of procedures, and the adoption of the Unified Patent Court. With the new unitary patent, intellectual property will grow in importance. Yet experts warn that the new patent results in new forms of unwanted behavior, such as forum shopping and the emergence of patent trolls. This study presents both sides-the pros and cons-to predict the effects on business and cover the widest possible range of experts, providing their views on the topic.

State sovereignty conditions the creation and application of International Law as well as the settlement of disputes. Thats why the intervention of judicial and arbitral bodies acquire a great importance. This work contents a comprehensive and critic approach to international judicial and arbitral case law concerning interpretation of international norms and international institutions as well as to the way the International Court of Justice conceives access to its jurisdiction ant its exercise. So, conventional instruments and instruments of a statutory nature, customary norms, institutional norms of the United Nations, unilateral declarations, as well as procedural instruments, facts alleged and the exercise of the jurisdiction attributed to the International Court of Justice in the way they have been interpreted by the Court constitute the object of a work surely useful for persons involved in international practice, studies or teaching.
Die Mitgliedstaaten der EU dürfen sich im Rahmen eines transparenten Vergabeverfahrens unter bestimmten Voraussetzungen sozialer Zuschlagskriterien bedienen. Zur Untermauerung dieser These schlägt ...die Arbeit einen Bogen zum Beihilfenrecht und zieht Lehren aus der Altmark-Rechtsprechung des EuGH zu Dienstleistungen von allgemeinem Interesse. Dazu stellt die Untersuchung Bezüge zu dem Querschnittsinstrument mainstreaming her und macht die EuGH-Rechtsprechung zu affirmative action-Maßnahmen fruchtbar. Sie widmet sich speziell dem Kriterium der Tariftreueverpflichtung und nimmt eine sorgfältige Verhältnismäßigkeitsprüfung sozialer Vergabekriterien als Instrument staatlicher Regulierung vor. Schließlich werden anhand der gefundenen Ergebnisse die neuen Vergaberichtlinien 2004/17/EG und 2004/18/EG untersucht.

Im Mittelpunkt steht die Frage, welches Recht bei grenzüberschreitenden ...Sachverhalten, wie sie typischerweise im Internet entstehen, über die Haftung des Intermediärs, der eine Immaterialgüterrechtsverletzung durch Bereitstellen einer Plattform oder eines Zugangsdienstes ermöglicht, entscheidet. Ausgehend von den Vorgaben des immaterialgüterrechtlichen Territorialitätsprinzip und der darauf aufbauenden Schutzlandanknüpfung sowie deren Grenzen, den Vorgaben des Unionsrechts und der materiellrechtlichen Ausgestaltung verschiedener Formen der Haftung für die Ermöglichung von Immaterialgüterrechtsverletzungen im deutschen, französischen und US-amerikanischen Recht wird für die Haftung der Intermediäre eine eigenständige kollisionsrechtliche Anknüpfung befürwortet, die zur Anwendung eines vorhersehbaren Rechts führt.
