Third country nationals are in a "weak" position when it comes to issuing a uniform Schengen short-term visa. The EU acquis on visas, and most notably the Visa Code, is still a domain strongly marked ...by State sovereignty, wide margin of appreciation and scarce transparency in the decision-making process. The EU Court of Justice has tried to rebalance the situation of third country nationals who apply for a Schengen visa, by ensuring that essential guarantees are in place when such a visa is denied. Even if granting a visa entails a clear manifestation of sovereignty, the decision to refuse a visa application cannot evade basic principles of the Rule of law, such as the duty to state reasons and the right to an effective remedy. Following a contextualization of the EU visa policy, with an overview of the evolution and the main features of the visa regime, this Insight the case-law of the Court of Justice relating to the interpretation of the Visa Code, in light of the EU Charter of Fundamental Rights, and namely, its art. 47.
El artículo aborda la problemática de las soberanías locales, su emergencia como resultado de la eclosión juntera, y su relación con la otrora cabecera del poder virreinal: Santafé. El objetivo es ...identificar los puntos centrales de la confrontación entre las soberanías locales y los postulados unitarios surgidos de un sector de la élite santafereña. A partir de ello, se interpretan, principalmente, cartas y publicaciones periódicas que se refieren a nociones como soberanía, representación y provincia. Fueron relevantes las contribuciones de Thibaud y Calderón a la concepción de soberanía, y las de Palti en torno a la representación. Así, se concluye que la fragilidad de las soberanías locales obedece a problemas internos como la conformación de cuerpos representativos y la preponderancia de algunos centros poblados que se denominaron “cabeceras provinciales”. Finalmente, se señala que las soberanías locales son un tema poco estudiado, tratado en particular desde el papel de los cabildos y juntas, por lo cual se deja de lado numerosos conflictos, que hacen de las soberanías locales una alternativa política inviable frente al unitarismo promocionado desde el centro del virreinato. The article addresses the problem of local sovereignty, its emergence as a result of the hatching, and its relationship with the former head of the viceregal power: Santafé. The objective is to identify the central points of the confrontation between local sovereignty and unitary postulates arising from a sector of the elite of Santa Fe. From this, they are interpreted, mainly, letters and periodicals that refer to notions such as sovereignty, representation and province. The contributions of Thibaud and Calderón to the conception of sovereignty were relevant, and those of Palti regarding representation. Thus, it is concluded that the fragility of local sovereignty is due to internal problems such as the conformation of representative bodies and the preponderance of some populated centers that were called “provincial headers”. Finally, it is pointed out that local sovereignty is a little studied topic, dealt with in particular from the role of the councils and boards, so that numerous conflicts are left aside, which make local sovereignty an unfeasible political alternative against promoted unitarianism from the center of the viceroyalty. O artigo aborda a problemática das soberanias locais, sua emergência como resultado da eclosão de conselhos, e sua relação com a outrora cabeceira do vice-reinado: Santafé. O objetivo é identificar os pontos centrais da confrontação entre as soberanias locais e os postulados unitários surgidos de um setor da elite de Santafé. A partir disto, são interpretadas, principalmente, cartas e publicações periódicas que fazem referência a noções como soberania, representação e província. Foram relevantes as contribuições de Thibaud e Calderón à conceição de soberania, e as de Palti em torno à representação. Desta forma, concluiu-se que a fragilidade das soberanias locais obedece a problemas internos como a conformação de corpos representativos e a preponderância de alguns centros povoados que foram denominados “cabeceiras provinciais”. Finalmente, aponta-se que as soberanias locais são um tema pouco estudado, tratado em particular desde o papel dos cabildos e conselhos, pelo qual se deixa de lado numerosos conflitos, que fazem das soberanias locais uma alternativa política inviável perante o unitarismo promovido desde o centro do vice-reinado.

It is not a coincidence that perceptions of sovereignty were key reasons
why the United Kingdom referendum on European Union membership
ended in a victory for the Leave side. In this article, we will ...apply methods
of conceptual history to parliamentary debates in order to trace the development
of sovereignty as a political concept in Europe-related debates
through studies of four periods between 1945 and 2016. We will show that
both supporters and opponents of European unity deliberately used the
British position on sovereignty in political struggles throughout the analyzed
period. The concept was used above all to describe the traditional
view of the supremacy of British parliamentary sovereignty, but it was also
used for different purposes to create a perception of how sovereignty could
or could not be modified in dealing with an integrating Europe.

Given the context in which Romania finds itself - on the one hand, a national, sovereign and independent, unitary and indivisible state and, on the other hand, its membership to certain international ...structures - for example to the United Nations, to the Council of Europe, to the European Union etc. - or Romania 's quality as a party to the Convention for the Protection of Human Rights and other international treaties - the natural question arises, where lies the boundary between the national sovereignty, which presupposes the right of the state to decide freely in its internal and external affairs and which has two components, namely the independence and the supremacy, and the fulfilment of some obligations deriving from the membership to the above-mentioned structures, a membership having the significance of a restriction of the powers of the state authority, a relativization of national sovereignty.
Data have become the new global currency, and a powerful force in making decisions and wielding power. As the world engages with open data, big data reuse, and data linkage, what do data-driven ...futures look like for communities plagued by data inequities? Indigenous data stakeholders and non-Indigenous allies have explored this question over the last three years in a series of meetings through the Research Data Alliance (RDA). Drawing on RDA and other gatherings, and a systematic scan of literature and practice, we consider possible answers to this question in the context of Indigenous peoples vis-á-vis two emerging concepts: Indigenous data sovereignty and Indigenous data governance. Specifically, we focus on the data challenges facing Native nations and the intersection of data, tribal sovereignty, and power. Indigenous data sovereignty is the right of each Native nation to govern the collection, ownership, and application of the tribe’s data. Native nations exercise Indigenous data sovereignty through the interrelated processes of Indigenous data governance and decolonizing data. This paper explores the implications of
Indigenous data sovereignty and Indigenous data governance
for Native nations and others. We argue for the repositioning of authority over Indigenous data back to Indigenous peoples. At the same time, we recognize that there are significant obstacles to rebuilding effective Indigenous data systems and the process will require resources, time, and partnerships among Native nations, other governments, and data agents.
