  • Abuse of a dominant position

    This chapter deals with unilateral conduct of undertakings with substantial market power, i.e. undertakings with dominant position as regulated by Article 102 TFEU. At the beginning of this chapter ... some general issues, including objective justification, the question of formalistic or effects-based approach and relationship between Article 101 and 102 TFEU are explained. This is followed by the the main features of Article 102 TFEU, like notion of undertaking, dominant position, substantial part of internal market and different categories of abuses of dominant position: exclusionary, exploitative, discriminatory conduct and abuses hindering inter-Member State trade. The theoretical grounds are widely supported by economic principles and relevant decisions of the Court of Justice of the European Union and the European Commission are discussed in this regard.
