  • Distinctive long-term care schemes as a response to changed family structures and demographic situation

    It is argued that the need for long term care benefits is predominately related to the reduction of personal autonomy due to old-age, which might present problems for the aging European society. In ... addition, traditional family structure of two or even three generations living together is not common any more. Since private law subjects are no longer in a position to provide security, social intervention was (and still is) required. In the article changes in the social risk structure and possible definitions in international, European and comparative law are analysed. Although Member States face similar problems, they might opt for distinctive solutions to overcome them. After presenting the nonsufficient legal solutions before the reform, long-term care scheme in some Member States are discussed. They range from sui generis schemes (Austria), to social care insurance, complemented by private care insurance and care assistance (Germany), residence based scheme (Spain), and mixed scheme (Slovenia). Such diversity might pose problems also for the coordination of national social security systems. One of the core questions is concerning delivery of long-term care. Could it be argued, that benefits in kind advocate professional delivery and benefits in cash promote informal (family) care? It is concluded that sensitive and intimate link between family members should be preserved by promoting external, professional long-term care.
