  • Familie - ein Begriff des materiellen Strafrechts?

    The author shows, how difficult it is to transplant the term Family from the (Slovenian) family law, when this term is defined by law in a very narrow, conservative sense, into substantive criminal ... law. It is difficult to use this term in criminal law context without discriminating other forms of legal heterosexual and homosexual partnership. There are several legal paradoxes hidden in the declaration of such a narrow, conservative conception of family as a good of criminal law, described in the article. The author is very sceptical about the new Slovenian statute of limitations regarding specially the so called family-violence. In his opinion a special system of limitations for crimes against or inside the family, like the one, introduced in the general part of the Slovenian Penal Code in the year 2004 is to be considered as primarily political and as inconsistent not (yet) accepted by the domestic and international criminal law science.
