The European Union in the World: Essays in Honour of Marc Maresceau is dedicated to the academic career of Marc Maresceau, a world-renowned expert in EU external relations law and pioneer in EU ...enlargement and neighbourhood studies. With a special focus on the post-Lisbon legal framework of EU external action, the book builds further upon the implementation of the reforms initiated by the Lisbon Treaty to offer virtually all-encompassing analysis of EU external relations law by top-level specialists.
This article aims to identify the link between EU electoral rights and national citizenship and to situate these rights in the broader context of EU citizenship. For these purposes, two recent ...judgments of the European Court of Justice regarding EU elections dated 12 September 2006 are discussed (Spain v United Kingdom and Eman & Sevinger). These judgments establish important principles for the election of the European Parliament, especially the scope ratione personae of recognised electoral rights of EU citizens and the boundaries framing national policies in this respect. They either leave Member States free to apply residence criteria in order to limit the scope ratione personae of EU electoral rights or to invoke their own constitutional traditions to extend that scope. This is not to say, however, that the Member States enjoy complete freedom in this respect. The paper concludes that the current fundaments of EU citizenship are weak in EU primary law, in particular in the field of political rights. For this reason, the European elections and, more generally, the European democratic process should be discussed once again at the highest political level.
On 21 January 2009 the Belgian Constitutional Court terminated a long-lasting dispute over the conditions for affiliation to the care insurance scheme established by the Flemish Community. What ...started out as a classical conflict over the division of competences in Belgium resulted in a discussion about the impact of European Community (EC) law on the constitutional autonomy of the member states. Despite the entanglement between Belgian constitutional law and EC law, the Flemish care insurance case reveals the different perspectives of both legal orders. In this case, the dialogue between the Belgian Constitutional Court and the European Court of Justice (ECJ) through the preliminary ruling procedure could not prevent reverse discrimination.

Two different dynamics govern the autonomy of the European Union (EU) legal order. On the one hand, autonomy seeks to define what EU law is not, i.e. it is not ordinary international law. Positively, ...on the other, autonomy seeks to define what EU law is, i.e. a legal order that has the capacity to operate as a self-referential system of norms that is both coherent and complete. Yet the concept of autonomy of the EU legal order in no way conveys the message that the EU and its law are euro-centric and that the Court of Justice of the European Union (the ‘Court of Justice’) seeks to insulate EU law from external influences by building walls that prevent the migration of legal ideas. Autonomy rather enables the Court of Justice to strike the right balance between the need to preserve the values on which the EU is founded and openness to other legal orders. The autonomy of the EU legal order is thus part of the very DNA of that legal order as it allows the EU to find its own constitutional space whilst interacting in a cooperative way with its Member States and the wider world.
Le présent article rassemble deux interventions présentées lors du colloque sur les « Fonctions de la procédure dans le droit économique européen ». Il a pour objet d’illustrer le rôle des procédures ...juridictionnelles pour la mise en œuvre du droit économique européen. Il ne s’agit pas exclusivement de mettre en exergue les fonctions classiquement reconnues aux procédures juridictionnelles en droit de l’Union, mais bien plus encore de mettre en lumière les potentielles implications politiques de ces procédures, intimement liées à l’articulation atypique du rôle, d’une part, des juridictions nationales en tant que juges de droit commun du droit de l’Union et, d’autre part, des juridictions de l’Union. En premier lieu, l’article aborde l’utilisation à des fins matérielles du renvoi préjudiciel par les juridictions nationales. En second lieu, il traite des recours directs devant les juridictions de l’Union, introduits tant par les institutions et les États membres que par les particuliers, et examine leur rôle pour le développement du droit économique de l’Union.
Două forţe diferite guvernează autonomia ordinii juridice a Uniunii Europene ("UE"). Pe de o parte, autonomia urmăreşte să definească ceea ce nu este dreptul UE, şi anume că el nu este un drept ...internaţional obişnuit. În sens pozitiv, pe de altă parte, autonomia urmăreşte să definească ceea ce este dreptul UE, şi anume că este o ordine juridică care are capacitatea de a acţiona drept sistem normativ autoreferenţial, coerent şi complet. Noţiunea de autonomie a ordinii juridice a UE nu transmite însă în niciun fel mesajul că UE şi dreptul său ar fi eurocentrice şi că, prin construirea unor ziduri ce ar împiedica migrarea ideilor juridice, Curtea de Justiţie a Uniunii Europene ("Curtea de Justiţie") ar viza izolarea dreptului UE faţă de influenţe externe. Autonomia permite mai curând Curţii de Justiţie să atingă echilibrul corect între necesitatea de a conserva valorile pe care se întemeiază UE şi deschiderea către alte ordini juridice. Autonomia ordinii juridice a UE este astfel parte a ADN-ului acestei ordini juridice, în măsura în care ea permite UE să îşi afle propriul spaţiu constituţional, interacţionând totodată, prin cooperare, cu statele sale membre şi cu restul lumii.
