Building on two case studies, the article explores how the Maya caciques understood the concept of consent and made use of it in concrete political negotiations with the Spanish crown in ...sixteenth-century Yucatan, New Spain. It highlights that the analysis of translation practices is pivotal to unraveling the intricacies of inter-legal communication under imperial rule. Although part of the corpus analyzed in the article was originally written in the Maya Yucatec language, it can be viewed as the result of a process of translation in which two legal cultures were finding ways to be intelligible to one another. The article shows, moreover, that oral exchanges and nonverbal communication – through posture or clothing, and gift-giving – were also crucial in expressing consent in the Spanish empire. (Council of the Indies) in Spain. Special attention will be paid to the ...annotations that appear in the margins of the documents, since they bring light to the activities that were taken over by a wide array of the
Consejo
’s officials in order to treat the information that came from America. We will demonstrate that such activities—classifying, summarizing, but also linking documents to one another across time and space—were at the core of the process of decision-making in the Spanish monarchy. The main challenge of this research, however, is that most of the marginal annotations were anonymous, and that not all of them were written by the same person, nor did they have the same functions. In order to overcome those obstacles, we will combine a visual, paleographic, and textual study of the sources aimed at exploring the links between the overseas reports, the marginal annotations and the royal decrees to which they had given rise. In doing so, we will highlight the paradoxical nature of the archive which, through its classifying process, gives access to a wide range of documents and, at the same time, separates them from one another and even tends to erase the connections that used to exist between them. Examining the margins of the documents will thus enable us to better understand the relationship between archival techniques, political communication and the development of imperial legality in the Spanish monarchy.
El presente artículo analiza a los abogados que representaron a pobres, esclavos e indios en los pleitos ventilados ante el Consejo de Indias y la Audiencia de la Nueva España en el siglo XVI. Se ...esclarece el contexto histórico, las motivaciones políticas y los argumentos que pueden explicar por qué la Corona española decidió nombrar a oficiales encargados de representar a determinados sectores de la población en sus tribunales. También se pone de manifiesto cómo los elementos teóricos y las experiencias circularon y dieron lugar a procesos paralelos de nombramiento de abogados de pobres, esclavos e indios en el Consejo de Indias y la Audiencia de México. El estudio se fundamenta en la normativa real, los nombramientos, las cartas de pago otorgadas a los abogados y las probanzas de méritos elaboradas por los titulares. Se toman en cuenta, asimismo, varios pleitos en que intervinieron para comprender cómo aquellos actores se repartían los negocios americanos.

En Laberintos de justicia Víctor Gayol analizó los oficios menores que permitían que la Real Audiencia de México impartiera justicia en los territorios bajo su jurisdicción. No obstante, el ...historiador dejó a un lado un oficio de suma importancia para comprender el funcionamiento de esta institución: los intérpretes de las lenguas indígenas. ¿Cuántas lenguas autóctonas se hablaban en la Audiencia de México? ¿Quién desempeñó las funciones de intérprete? ¿Eran indígenas, españoles o mestizos? ¿En qué circunstancias estas personas llegaron a ser bilingües? Para contestar a estas interrogantes el presente trabajo analiza una serie de nombramientos de intérpretes otorgados por la Audiencia de México, así como las probanzas de méritos y servicios que algunos titulares enviaron al Consejo de Indias, de manera individual o colectiva, para dar a conocer su trabajo y solicitar mercedes. Gracias a esta documentación, se ofrece una cronología de la ocupación del cargo en el siglo XVI y un análisis del perfil social y étnico de sus titulares. Consideramos que esta reflexión permite entender mejor el proceso de adaptación de las instituciones del Imperio hispánico a la realidad plurilingüística del continente americano.
In Laberintos de justicia Víctor Gayol analyzed the minor offices that enable the Audiencia of Mexico to administer justice in the territories under its jurisdiction. Nevertheless, he did not pay attention to an office that played a crucial role in the colonial courts: the interpreters of indigenous languages. How many native languages were spoken in the Audiencia of Mexico? Were the interpreters Indians, Spaniards, or Mestizos? How did they develop their linguistic skills? This study identifies the interpreters who served the court of Mexico during the sixteenth century in order to provide a chronology of the occupation of the office, as well as an analysis of the social and ethnic profile of its holders. This reflection highlights the process by which the institutions of the Spanish Empire sought to adjust themselves to the multilingual reality of America.

This article analyzes the emergence of applied sciences in the field of two American dyeing materials – the woad called ek and the indigo – in the Spanish Empire. It highlights how the circulation of ...written documents and displays of materials situated local knowledge and experiences in a global framework in which a wide range of actors was engaged from Mexico City, Campeche, Mérida (Yucatan), Seville, Madrid or Milan. We will also show that the Spaniards tended to obscure the Native origin of their so-called “inventions” in order to secure privileges in the production and commercialization of these materials. On the other hand, we examine the Council of the Indies efforts to stimulate the production of knowledge, to organize and intertwine information, and to promote the imperial economic interests. The article thus demonstrates how the analysis of the Spanish Monarchy’s archivistic practices is key to fully understanding the emergence of the Renaissance scientific culture.
El presente trabajo tiene como objetivo explorar las múltiples significaciones que revistió el concepto «usos y costumbres» indígenas en el contexto de reorganización cultural y política que el ...centro de México y Yucatán sufrieron en el siglo XVI. Para ello, se analiza un amplio abanico de fuentes, como diccionarios coloniales, manuales pastorales y de adoctrinamiento misionero, juicios y ordenanzas para el gobierno de tales pueblos de indios. Se concluye que el alto grado de flexibilidad conceptual y práctica de esta figura jurídica contribuiría tanto a consolidar el dominio colonial como a refrendar algunas reivindicaciones de las autoridades nativas.
