Na temelju raščlambe pravnorelevantnih vrela, a slijedom činjenice da su se magistratski skupštinski izbori održavali svake godine tijekom gotovo pet stoljeća Rimske Republike te igrali ključnu ulogu ...u oblikovanju njezina političko-pravnog života, u radu se pokušavaju rasvijetliti dvije bitne točke cjelokupnog izbornog postupka. Tako se, nakon instruktivnih napomena o narodnim kao izbornim skupštinama, u prvom dijelu rada utvrđuju pravno-socijalno-ekonomske pretpostavke nužne za ostvarenje ius honorum pretendorum i način odnosno pravila zakonitog kandidiranja za neku od republikanskih magistratura. U drugom se dijelu rada iznosi tijek postupka izbora u mjerodavnim narodnim skupštinama, pri čemu se distingviraju s jedne strane proceduralne odrednice zajedničke centurijatskoj i tributskoj skupštini, a s druge strane specifičnosti u načinu glasovanja koje su - proizišle iz njihove različite utemeljenosti - rezultirale upadljivije izraženom nejednakošću biračkog (konstitucionalno jednakog) glasa rimskih građana prilikom izbora magistrata u centurijatskoj skupštini čak i nakon provedene strukturne racionalizacije.
U ovom radu, koji predstavlja prvi dio rezultata istraživanja sadržaja –
odnosno pravne prirode i uzora – kaznenih odredbi za zaštitu spolnog morala sadržanih u vrsarskoj pravnoj zbirci, središnji su ...predmet kanonska crimina protiv spolnoga morala koja je za područje Vrsarske grofovije tom zbirkom oblikovao i objavio porečki biskup kao njezin civilni vlastodržac. Riječ je o crimina koja su pripadala općem kanonskom pravu, ali koja – prilagođena mjesnim prilikama Vrsarske grofovije – formalno nisu bila izdana kao izvor partikularnoga kanonskog
prava, nego kao njezino vlastito pravo civilne provenijencije, tj. kao njezina statutarna pravna pravila. U ovome radu autori su priredili analizu navedenih crimina, i to tako da su najprije objasnili specifičnosti pravnog izvora u kojemu su uređena, a koji čini polazište istraživanja, zatim jezik i nomotehničke odrednice izričaja u njemu zastupljenih, a u centralnom su dijelu pojedinačno i iscrpno analizirali
različite oblike i pojavnosti kažnjivih ponašanja kojima se u Vrsarskoj grofoviji vrijeđao spolni moral. Autori su glede pojedinačnih crimina razlučili kako čimbenike koji su uvjetovali osobit zakonodavčev odnos prema tim kažnjivim ponašanjima, tako i pristup vrsarskog zakonodavca njihovu specifičnom uređivanju i kažnjavanju počinitelja, te, napokon, rasvijetlili odrednice kaznenopravne politike porečkog biskupa glede zaštite spolnog morala u Vrsarskoj grofoviji.
This paper, which represents the first part of wider research of the content and legal nature of the legal rules of canon provenance that served as a means for the protection of sexual morality in the legal compilation of Vrsar, focuses on particular criminal offences against sexual morality which were for that territory enacted and published by the Bishop of Poreć, who held sovereignty over Vrsar. The crimina analysed in this paper originated in universal canon law. However, in Vrsar their regimes were not adopted and adapted to the actual needs of a particular community as canon legal rules. Rather, the Bishop of Poreč as the civil sovereign in the territory enacted them as civil rules (i.e. statutory law) and portrayed them as the territory’s own and self-invented criminal offences exclusively belonging to the legal system of Vrsar. In this paper, the authors analyse the relevant crimina. In the first place, they explain the peculiarities of the legal source (the compilation) in which the relevant criminal offences were regulated. The source represents the starting point of this research. Secondly, the authors pay attention to the language and legal drafting of the relevant legal norms and expressions, while the central part of the paper examines individual criminal behaviours against sexual morality in the aforementioned territory. Following an analysis of individual crimina, the authors recognise diverse factors which substantially conditioned the legislator’s specific approach to such behaviours as well as to their specific regulation and to the punishment of people who committed them. Finally, by using the arguments deriving from the analysis of individual crimes against sexual morality in Vrsar, the authors elaborate on the general approaches and guidelines of the criminal law policy of the Bishop of Poreč whose main purpose was most evidently to afford effective protection of sexual morality in the territory governed by him.
Ovaj članak drugi je dio studije o crimina protiv spolnog moralau vrsarskoj pravnoj zbirci te se nastavlja na članak objavljen u ovomčasopisu u vol. 28, broj 1/2021, str. 153–180. Dok je u ...prethodnomčlanku naglasak bio na analizi srednjovjekovnih pravnih pravila vrsarske provenijencije o kaznenim djelima protiv spolnog morala, kojasu nadahnuta rimskim i kanonskim pravnim uzorima, a odražavaju imjesne prilike, u ovome se analizira rimsko pravno uređenje nekolikorelevantnih instituta: preljuba, silovanja, incesta, svodništva i prostitucije. Ni smisao ni cilj ovoga članka nije dokazivanje da je vrsarskizakonodavac supstancijalno preuzimao rješenja iz rimskih pravnihizvora, nego raščlambom rimskih pravnih izvora pokazati da su rimski zakonodavci, posebno u postklasično doba, kada je rimsko pravosnažno nadahnuto kršćanskom mišlju i crkvenim naučiteljstvom, priformulaciji pravnih pravila polazili s istih ili sličnih polazišta. Premdasu rimska pravna rješenja i partikularno uređenje vrsarskog zakonodavca različiti i supstancijalno i s obzirom na vremensku i prostornuodrednicu, ali i s obzirom na provenijenciju pravnih poredaka (a time ipravnih rješenja), ona su u svojoj biti analogna. To se posebno ogledau dobru koje se njima zaštićuje, koje oni, doduše, različito shvaćaju idefiniraju, no u praksi i u većini slučajeva ipak mu je u središtu ženskobiće. Pristup tome donekle je različit, a u evoluciji od rimskog, preko rimskog i kanonskog, pa do partikularnog srednjovjekovnog pravavrsarske provenijencije može se precizno iščitavati afirmacija ženina subjektiviteta i sve snažnija zaštita njezine svekolike pojavnosti kakou fizičkom tako u spolnom, a napokon i u cjelovitom moralnom smislu.
Following the most relevant sources of legal and historical provenance, the authors analyse the regulation of breaches of sexual morality in the history of Roman criminal law. The analysis determines the contents of such criminal acts, their subjects and objects, the persons who were entitled to indict, and, finally, addresses the legal sanctions that are closely connected to the question of good that is intended to be protected. After addressing in the first part of the paper the two Roman foundations which governed the perception of public morals – the concept of honour-shame and socially tolerated prostitution which inevitably led to infamy, the authors elaborate the criminal qualification of extramarital sexual relations of a married woman (or of a reputable woman). The former elaborations refer to the period after the Augustan lex Iulia de adulteriis coercendis until Justinian’s Novels No 117 and No 134. Penalisation of adultery was directed at the preservation of marriage under Roman law and indirectly to the protection of social stability, which was achieved through controls of the sexual morality of the married woman, simultaneously giving men the role of its protectors and of extracting retribution. On the other hand, it meant that sexual relations of that kind with women who were considered infamous were not punishable. In the second part of the paper, the authors briefly elaborate several procedural options of public prosecution and strict penalisation of rape which should be perceived as every violent sexual relation with a virgin or an unmarried woman or a widow. The essentials of the criminal approach to rape consisted of the protection of a woman’s sexual and moral integrity as a foundation of her marital and reproductive potential. The third part of the paper addresses the changes occurring in the field of incest beginning from the Augustan perception, which stood in direct connection exclusively with adulterium and stuprum, and it remained so until the postclassical legal qualifications when the law provided clear definitions of marriages with incestuous elements. The ongoing imperial penalisation in the Principate ended in the Justinian era when a new and more permissive approach towards such acts was promoted in legal policies. It simultaneously meant that the penalties were alleviated which was achieved through property confiscations and the woman’s punishment exclusively if she had committed the act with strong intention. Such an approach affirms the protection of sexual morality as the foundation of marriage under Roman law and of the stability of social relations that were according to Roman perceptions of that time tightly connected to a woman’s dignity and her social position and status. The fourth part of the paper provides insight into the criminal repression of pimping in the context of prostitution as a popular commercial activity. Insight is provided for the period from the Augustan penalisation of adultery until the postclassical era that proclaimed that pimping was a separate criminal offence that necessarily encompasses property gains. With regard to this specific criminal offence, the legislation of the postclassical era evidently reaffirms the prevention of prostitution and the protection of public morals, both as guarantees of the stability of the social order. At the end of each part, the authors provide a comparative insight into the regulations of the particular matter of sexual morality and its criminal threat in the codification of laws in Vrsar. Essentially, such a comparative insight provides the views of the bishop who governed Vrsar and who mainly used the Roman concept of the protection of public morals as the basis of his own ideas, which he remodelled for the purpose of the codification.
Nel presente studio si rivelano in base alle rilevanti fonti giuridiche e storiche le lesioni alla morale sessuale regolate durante la storia romana del diritto penale, al fine di rispondere – con la determinazione del loro contenuto, dei possibili soggetti e oggetti del delitto, del diritto di sollevare accusa e della tipologia delle sanzioni applicate – alla questione del carattere giuridico del bene protetto. In tal senso, in seguito all’impostazione iniziale dei due fondamenti del concetto romano della morale sessuale e pubblica – cioè del concetto onore-biasimo (disonore) e dell’infame ma comunque tollerata prostituzione, nella prima parte di questo lavoro è trattata la normativa giuridico-penale del rapporto sessuale extramatrimoniale della donna sposata e rispettabile (adulterium) a partire dall’augustea lex Iulia de adulteriis coercendis fino alle Novelle Giustinianee (117 e 134). Fu quindi constatato che la punibilità dell’adulterio era soprattutto volta alla preservazione del validi matrimoni romani – indirettamente anche della stabilità sociale in genere – mediante la sorveglianza della castità sessuale delle donne sposate, dove l’uomo assumeva il ruolo del suo difensore/vendicatore, come anche la libertà sessuale, ovvero l’impunibilità nei rapporti con un ampio ventaglio di donne disoneste. Nella seconda parte del lavoro sono esposte alcune possibilità processuali penali di persecuzione pubblica (quali il vis, lo stuprum, l’ iniuria atrox come anche il raptus) e le severe pene comminate nei casi di stuprum – inteso come qualsiasi atto sessuale imposto con forza, con donna vergine, sposata o vedova – nella cui sostanza sta la protezione del rapporto sessuale ossia dell’integrità morale della donna quale pegno del suo potenziale coniugale ovvero riproduttivo. Nella terza parte dello studio, alla luce della prostituzione quale attività commerciale alquanto diffusa, viene presentata l’evoluzione della repressione penale del lenocinio (lenocinium) – a partire dalla repressione augustea dell’inammissibile comportamento del coniuge della donna adultera, fino alla configurazione post-classica del lenocinio quale delitto penale indipendente con il lucro quale suo elemento costitutivo – evincendo il suo fine sostanziale che consiste nel contrastare ed inibire la prostituzione ossia nella protezione della morale pubblica quale garanzia della stabilità dell’intero ordine sociale. Nella quarta parte dello studio sono presentate le evoluzioni ovvero l’ampliamento e l’estensione del contenuto giuridico-penale dell’incesto – dal concetto augusteo del delitto esclusivamente legato all’adulterium ed allo stuprum fino alla sua definizione post-classica nel contesto della normalizzazione e regolazione dei matrimoni incestuosi – evincendo in tal modo che i bruschi adattamenti graduali della repressione imperiale giungono finalmente a termine con l’alleviamento giustinianeo, ossia con la prescrizione della confisca dei beni e della punibilità della donna solo nel caso del suo compimento doloso del delitto, con cui risulta confermata la protezione della morale da una parte, quale fondamento non solo del matrimonio legittimo ma anche del valido funzionamento delle strutture statali, e dell’altre della dignità della donna, ovvero della sua posizione giuridica nella società. Al termine di ogni singola unità nel presente articolo, all’analisi delle fonti e delle strutture romane sono aggiunte, anche se solo in brevi cenni, alcune considerazioni sulle concezioni proprie al legislatore orserese, cioè al vescovo di Parenzo, espresse nelle normative legali da lui emanate ed applicabili nella contea di Orsera, per cui come tali esse stabiliscono il vincolo tematico con la prima parte del presente studio, pubblicato nel numero 28 di questa rivista, n 1/2021, pp. 153-180.

There are many records throughout the Empire from the imperial provinces dating to 1st and 2nd century AD that mention dispute settlements between tribal communities in which the Roman provincial ...administration had significant role. The intention of the Romans to intervene to such disputes was not so much motivated by the need to ordain how the dispute should be settled, but to ensure all the prerequisites that the dispute was ended quickly and efficiently. Romans intervened to all disputes that they perceived as potential dangers to their smooth administration of the province. The more dangerous the dispute was the higher provincial official was concerned with its settlement. Such approach to dispute settlements resulted with a high degree of standardisation of such procedures throughout the Empire which can be qualified as some kind of administrative arbitrations. Moreover, such approach reflected a consistent policy to disputes in those provinces where stabilisation of Roman government was still going on, or where tribal communities did still not fully adapt to the new Roman administrative system and territorial divisions. In their attempts to bring such disputes to an end, the Roman provincial magistrates used certain powers which were typical for their criminal jurisdiction, especially in initiating the dispute settlement and the enforcement of the award.

Through an analysis of relevant sources, this paper attempts to shed light on the development of understanding and legal protection of iniuria in the history of Roman law. In the first part, the ...paper establishes that in the Twelve Tables iniuria carried a dual meaning: a non-technical meaning of injustice or unlawfulness, but also a technical legal meaning of private delict inflicting minor physical injury on a free person, against which it was possible to bring a legis action per iudicis arbitrive postulationem. The second part of the paper deals with the long-lasting and complex process in which praetors in their edicta, beginning with the edictum generale and the action iniuriarum aestimatoria proclaimed through it, both limit delict iniuria to an intentional act, and extend it to non-physical injuries, stressing the specific content and far-reaching role of Sulla's lex Cornelia de iniuriis. The third part of the paper deals with traditional casuistics which shows that learned legal experts included within the meaning of iniurira, as a private delict, beginning with Labeo making iniuria analogous with contumelia, not only decemviri and edictal facts, but also other mutually very different violations of personality which may be processed through an existing action. On the other hand, these legal experts witnessed a new social phenomenon - from the Severan period, iniuria atrox was subjected to extra ordinem repression and was thus raised to the level of a public criminal offence. In the fourth part of the paper, the authors explain how post-Diocletian case law, in spite of the lack of interest shown in this matter by the emperor's legislation and despite the Justinian possibility of vel criminaliter agere vel civiliter, abolished the iniuriarum aestimatoria private legal action and made public law criminal repression the prevailing method for legal protection in the event of iniuria. In the field of criminal law the Romans invented and institutionally elaborated several types of exile, each with its own legal prerequisites and consequences. Each exile might consist of a ...banishment to an island while in most cases this meant that a person was exclusively banned to an island. This paper will explore the role and rationale of the convict’s banishment to a specific island (with specific features) from the perspective of the punishment, the criminal policies and criminal goals that the Roman authorities achieved not solely by selection of an island, but also by confining the convict to local living conditions.
Kazna protjerivanja u povijesnom se razvoju rimskog sustava kažnjavanja manifestirala kao exilium, deportatio i relegatio. Dok su te kazne dobro obrad strok signene u djelima rimskih, poglavito ...klasičnih pravnika, razmjerno su rijetka epigrafska svjedočanstva o konkretnim slučajevima u kojima su bile izrečene. U ovome radu obrad strok signuju se dva natpisa koja dokumentiraju kaznenopravni slučaj roksolanskoga kralja Rasparagana, kojega je car Hadrijan porazio tijekom pohoda na Sarmatiju П7./П8. godine, a potom osudio na relegaciju na Uljanikov otok u Pulskome zaljevu. Slučaj je višestruko zanimljiv jer ne samo što pokazuje obilježja rimskog kaznenopravnog instituta relegatio, odnosno stupanj njegova razvoja u prvim desetljećima II. stoljeća, nego i epigrafskim sagledavanjem tog instituta na Rasparaganovu primjeru potvrd strok signuje različite ciljeve rimske kaznenopravne politike koji su se mogli postići izricanjem kazne relegatio, točnije rečeno relegatio in insulam. Ovim člankom afirmira se i epigrafsko gradivo rimske provenijencije kao izvor za daljnju spoznaju kaznenog sustava u antičkom Rimu.
