Troska o zdrowie człowieka jest jednym z zadań administracji publicznej w jej misji na rzecz dobra wspólnego. Organem, któremu powierzono część zadań z tego zakresu, jest Główny Inspektor ...Farmaceutyczny (GIF)/the Chief Pharmaceutical Inspector. Celem niniejszego opracowania jest zbadanie, czy przyznana Głównemu Inspektorowi Farmaceutycznemu ustawowo kompetencja do wydawania decyzji administracyjnych w zakresie reklamy produktu leczniczego stanowi instrument ochrony zdrowia i czy jest to instrument efektywny. Główny problem artykułu został sformułowany w pytaniu: „Czy decyzje GIF w zakresie reklamy produktu leczniczego stanowią instrument efektywnej ochrony zdrowia?”. Analizy przeprowadzone w opracowaniu doprowadziły do wniosku, że GIF, działając w ramach swoich kompetencji, sprawując nadzór w zakresie reklamy, ingeruje w dwie kluczowe dla demokratycznego państwa prawnego wolności konstytucyjne: wolność wypowiedzi oraz wolność działalności gospodarczej. Robi to jednak, by chronić wartość szczególną, jaką jest zdrowie. Zatem praktyka rozstrzygania spraw w tym zakresie przez GIF jest balansowaniem między wolnością wypowiedzi, wolnością działalności gospodarczej a odpowiedzialnością za zdrowie. Niestety owa praktyka rodzi wiele uwag. Choć decyzje GIF w zakresie reklamy produktu leczniczego stanowią instrument ochrony zdrowia, w praktyce jest on mało efektywny, a społeczeństwo jest poddawane perswazyjnym komunikatom dotyczącym produktów leczniczych, które bardzo często w sposób oczywisty naruszają przepisy ustawy – Prawo farmaceutyczne.
Niniejszy artykuł stanowi próbę analizy stanu wolności słowa realizowanej w ramach praktyk religijnych wykonywanych publicznie w czasie epidemii. Główny problem opracowania stanowi pytanie, czy ...ograniczenia wprowadzane w wyniku epidemii SARS-CoV-2 wpływają na wolność słowa realizowaną w ramach wolności religii. W artykule omówiono normatywne ramy wolności słowa realizowanej w ramach wolności religii, ograniczenia dotyczące funkcjonowania Kościoła Katolickiego, które wprowadzono w Polsce w ramach walki z epidemią SARS-CoV-2 oraz praktyczne konsekwencje tych ograniczeń dla wolności słowa w analizowanym kontekście. Przeprowadzone badania doprowadziły do wniosku, że ograniczanie wolności religii w jej wymiarze zewnętrznym jest także ograniczaniem wolności słowa realizowanej w ramach wolności religii. Ustanowione w Polsce ograniczenia nie spełniają prawnych warunków ograniczania wolności człowieka. W obliczu zagrożeń związanych z epidemią SARS-CoV-2 ograniczanie niektórych praw i wolności w celu ochrony życia i zdrowia jest co do zasady uzasadnione, jednak działania takie powinny respektować wymogi prawa. Działania przeciwne prowadzą do erozji prawa, niszczą jego autorytet, naruszają prawa i wolności jednostki i negatywnie odbijają się na relacji państwo-Kościół. Takich „standardów” sprawowania administracji publicznej nie może usprawiedliwiać epidemia i nie jest możliwe ich zaakceptowanie w demokratycznym państwie prawa.
Temat „Krajowa Rada Radiofonii i Telewizji wobec zagrożeń pluralizmu mediów” wpisuje się w zagadnienie relacji administracji publicznej do współczesnych zagrożeń. Pluralizm mediów jest kluczowym ...elementem wolności prasy, a wolność prasy jest fundamentem demokracji. Główny problem artykułu został sformułowany w formie pytania: „Jaką pozycję zajmuje Krajowa Rada Radiofonii i Telewizji wobec zagrożeń pluralizmu radiofonii i telewizji?”. Badania przeprowadzone w pracy prowadzą do wniosku, że Krajowa Rada Radiofonii i Telewizji nie wypełnia należycie swoich zadań z zakresu wspierania pluralizmu mediów: w minimalnym stopniu eliminuje jego zagrożenia i w minimalnym stopniu zapewnia pluralistyczny charakter radiofonii i telewizji. Problemem nie jest brak instrumentów prawnych do podejmowania działań w tym zakresie, jak twierdzi Krajowa Rada Radiofonii i Telewizji, ale jej polityczna zależność, jako organu kolegialnego, od organów powołujących jej członków. Działaniem priorytetowym powinno więc być odzyskanie niezależności przez ten organ, co rodzi również pytanie o zasadność utrzymywania dotychczasowego modelu jego powoływania.
Na progu przemian ustrojowych w Polsce, w latach 90-tych ubiegłego wieku, wykonywanie zadań publicznych w zakresie radiofonii i telewizji powierzono Krajowej Radzie Radiofonii i Telewizji. Przed ...kilku laty ustawodawca zdecydował o utworzeniu Rady Mediów Narodowych (RMN), której także powierzył kompetencje w obszarze radiofonii i telewizji. Celem niniejszego opracowania jest zbadanie czy obowiązującym stanie prawnym w Polsce funkcjonowanie dwóch organów administracji publicznej w obszarze radiofonii i telewizji wpływa na wykonywanie zadań przez organ konstytucyjny, utworzony wcześniej, czy taki efekt nie zachodzi. Główny problem artykułu został sformułowany w pytaniu „czy utworzenie kolejnego organu administracji publicznej w obszarze radiofonii i telewizji, w postaci RMN, może rodzić problemy w wykonywaniu zadań przez KRRiT?”. Analizy przeprowadzone w opracowaniu doprowadziły do wniosku, że choć polskie prawo nie wyklucza możliwości funkcjonowania kilku organów administracji publicznej w obszarze radiofonii i telewizji, rozwiązanie wprowadzone w naszym kraju nie może być ocenione pozytywnie, ponieważ przyjęty przez ustawodawcę model funkcjonowania dwóch organów administracji publicznej w obszarze radiofonii i telewizji doprowadził do sytuacji, w której KRRiT nie ma możliwości poprawnego pełnienia swojej funkcji ustrojowej, wyznaczonej przez przepisy Konstytucji. Utrzymywanie tej sytuacji w polskim porządku prawnym i rzeczywistości społecznej jest sprzeczne z zasadami demokratycznego państwa prawnego.
On the threshold of the political changes in Poland in the 1990s, the National Broadcasting Council was entrusted with performing public tasks in the field of broadcasting. A few years ago, the ...legislator decided to establishthe National Media Council, which was also given responsibility in the field of broadcasting. This study aims to examine whether, under the current legal status in Poland, the functioning of two public administration bodies in the field of broadcasting affects the performance of tasks by the constitutional body created earlier or whether such an effect does not occur. The main problem of the article is formulated in the question of “whether the creation of another public administration body in the field of broadcasting, namely the National Media Council, may give rise to problems in the performance of tasks by theNational Broadcasting Council?”. The analyses carried out in the study led to the conclusion that although the Polish law does not exclude the possibility of functioning of several public administration bodies in the field of broadcasting, the solution introduced in our country cannot be assessed as positive because the model adopted by the legislator of functioning of two broadcasting publicadministration bodies led to a situation in which the National Broadcasting Council is not able to perform its systemic function correctly, as determinedby the provisions of the Constitution. Maintaining this situation in the Polish legal order and social reality is contrary to the principles of a democratic state of law.
The present paper is an attempt to analyze the state of freedom of speech exercised during public religious practices at the time of the epidemic. The main research problem addressed in the study is ...whether the restrictions introduced due to the SARS-CoV-2 epidemic affect freedom of speech exercised within freedom of religion. The paper discusses the normative framework of freedom of speech exercised within freedom of religion, the restrictions on the functioning of the Catholic Church established to control the SARS-CoV-2 epidemic in Poland, and the practical consequences of these restrictions for freedom of speech in the context under discussion. The conducted analyses have led to the conclusion that restricting freedom of religion in its external dimension also means restricting freedom of speech exercised within freedom of religion. The restrictions in place in Poland do not meet the legal conditions for limiting human freedom. Therefore, it should be emphasized that in the face of the threats posed by the SARS-CoV-2 epidemic, limitations of certain rights and freedoms introduced in order to protect life and health are essentially justified, but such actions should respect legal requirements. The opposite may lead to the erosion of the law, destroy its authority, violate the rights and freedoms of individuals, and negatively affect Church-State relations. Such “standards” of public administration cannot be justified by an epidemic and it is not possible to accept them in a democratic state ruled by law.
The idea of legal restrictions on TV advertising of a medicinal product is – in its core – the question of advertising of a very particular and sensitive product through a particular and strong ...affectting medium. Above mentioned aspects of the problem along with the need to protect human life and health justify the legal restrictions set by the state legislator. The article ,structured into five parts, consists of the author’s analysis of the legal regulations concerning the main problem and her attempt to answer the underlying question. The researcher points to the legal model of TV advertising of a medicinal product – defines basic concepts, presents limitations (substantive and formal) on TV advertising and draws finally conclusions.
Disinformation regarding the COVID-19 pandemic is a global phenomenon. It constitutes a threat to the values protected under the law, health in particular. The primary issue tackled in ...“Disinformation regarding COVID-19 in the light of priorities of the European Commission and the legal regulations binding and currently drafted in Poland” paper is an attempt at answering the following question: Is eliminating COVID-19 disinformation from public space possible in light of the priorities of the European Commission and the legal regulations already effective and currently being drafted in Poland? The analyses conducted under the paper lead to the conclusions that the provisions currently regulating freedom of expression theoretically constitute a basis for eliminating disinformation from public space but are, in practice, not very effective. This leads to the need for searching for other, more effective legal instruments in this field, both on the level of European Union law making and domestic legislation. Although we may speak of a consensus concerning assessment of the very phenomenon of disinformation the legislative and practical actions taken, both on the domestic level and the European Union level, enable us to indicate substantial and frequently disturbing differences regarding shifting the aspects emphasized by legislation. As compared to the proposed solutions drafted by the European Commission and the drafts of domestic acts, the vastly different approach to the idea of controlling disinformation is clearly visible. Therefore, it must be stated that such circumstances will lead to development of varied legal effects of the drafted regulations that will decide, among other issues, the practical effectiveness or lack thereof in the case of the drafted solutions. In the course of the analysis of the issue constituting the subject of this paper we should concurrently bear in mind that freedom of expression is one of the principles in a democratic state governed by the rule of law.
The issue of the conflict of values in the licensing procedure for broadcasting radio and television programmes is a special case of such a clash in public economic law. The study entitled “Conflict ...of values in the licensing procedure for broadcasting radio and television programmes in Poland” aimed to conduct analyses to identify the values underlying licensing proceedings for broadcasting radio and television programmes in Poland, examine their potential for conflict and identify ways of resolving disputes arising in this area. The main issue of the article is formulated in the following question: “can the values determining the licensing procedure for broadcasting of radio and television programmes give rise to axiological conflicts, and if so, how should the conflicts be resolved?” The analyses conducted as part of the study led to the conclusion that the Polish broadcasting licensing procedure is determined by a number of values that may clash with one another. The entities responsible for resolving conflicts in practice and specific cases include the National Broadcasting Council and its President at the level of the administrative proceedings and the administrative courts at the level of administrative court proceedings. The settlement is based on the law, which, however, contains a number of general clauses. In order to interpret them correctly and, consequently, fairly resolve the conflict, it is crucial to refer to the fundamental source of all human rights and freedoms, including economic freedom and freedom of expression, paramount in this process – human dignity.
