U radu se analizira novi legislativni okvir uređenja kazališne politike i kazališne djelatnosti u Republici Hrvatskoj, te su predstavljene novine i najbitniji elementi osnivanja, statusa, ustrojstva, ...upravljanja i financiranja kazališta, kao i novo uređenje radno-pravnog položaja kazališnih umjetnika i drugih kazališnih radnika u kazalištima, posebice javnim kazalištima. Rad ima za cilj ukazati na nedostatke u novoj kazališnoj regulativi koji se mogu reflektirati i na kazališnu poslovnu praksu, kao i naznačiti pravce moguće izmjene i dopune sada važećih rješenja kojima bi se doprinijelo jasnoći i cjelovitosti pravnog normiranja kazališne djelatnosti, pravnoj sigurnosti i jasnom pružanju optimalnih mogućnosti za realizaciju kazališnih umjetničkih projekata. Posebice su detektirani potrebni pomaci u regulaciji sastava i ovlaštenja kazališnih vijeća, koja se ponovno implementiraju u Zakonu o kazalištima iz 2023. kao spona između osnivača i samog kazališta, s takvim upravljačkim funkcijama koje i dalje omogućavaju politički utjecaj na kadrovsku politiku, upravljanje i djelovanje kazališta, ne samo u poslovnom nego indirektno i na umjetničkom planu.
The paper analyzes the new legislative framework regulating theater policy and theater activities in the Republic of Croatia, and presents the novelties and the most important elements of the establishment, status, organization, management and financing of theaters, as well as the new regulation of the labor-legal position of theater artists and other theater workers in theaters, especially public theaters. The aim of the paper is to point out the shortcomings in the new theater regulations that can be reflected in the theater business practice, as well as to indicate the directions of possible changes and additions to the currently valid solutions that would contribute to the clarity and completeness of the legal regulation of theater activity, legal certainty and the clear provision of optimal possibilities for the realization of theatrical art projects. In particular, necessary changes were detected in the regulation of the composition and powers of theater councils, which are re-implemented in the Act on Theaters from 2023 as a link between the founder and the theater itself, with such management functions that continue to enable political influence on the personnel policy, management and operation of the theater, not only in business, but also indirectly in the artistic field.

Vatrogastvo je stručna neprofitna i humanitarna djelatnost koja je usmjerena ka prevenciji zaštite od požara i tehnoloških eksplozija, odnosno ka pružanju stručne tehničke pomoći kod požara, ...eksplozija i drugih situacija u kojima postoji ugroza ljudskih života, zdravlja stanovništva i materijalne imovine. U organizaciji i obavljanju vatrogasnu djelatnost sudjeluju vatrogasne postrojbe i vatrogasne organizacije sa svojim organizacijskim oblicima. Temeljnu pravnu regulaciju vatrogastva u Republici Hrvatskoj predstavlja novi Zakon o vatrogastvu iz 2019. Djelovanje vatrogasnih subjekata izaziva niz otvorenih pitanja s poreznog aspekta, posebice u slučaju obavljanja i određenih gospodarskih aktivnosti ovih subjekata.

U ovom radu analizira se adekvatnost postojećeg pravnog okvira u području kulture odnosno uređenja statusa, upravljanja i financiranja javnih ustanova u kulturi, posebice onih koje nisu regulirane ...posebnim zakonima. Namjera je bila u ovom radu ukazati na moguće nedostatke u postojećoj regulativi i samoregulativi, te predložiti potencijalna unaprjeđenja pravne regulative, sve u cilju uspostavljanja modernog normativnog okvira za poboljšanje uvjeta upravljanja i financiranja javnih ustanova u kulturi u Republici Hrvatskoj. Posebno se ukazuje na poziciju i ovlasti kulturnih vijeća kao tijela koja imaju važnu ulogu o odlučivanju o dodjeli financijskih proračunskih sredstava kulturnim projektima, kao primjer suvremene kulturne politike. Međutim, u njihovu radu postoji mogućnost nastanka sukoba interesa s obzirom na disproporciju njihova statusa u kulturnom području, te je nužno stvoriti odgovarajuća legislativna rješenja koja će otkloniti mogućnost zloupotreba pozicija odnosno interesnog subjektivnog postupanja kod raspolaganja javnim sredstvima za javne potrebe u kulturi. Osnivanjem kulturnih vijeća, kulturna politika Republike Hrvatske prati načela suvremene kulturne politike pri čemu se odlučivanje i suodlučivanje o pitanjima o kulturi decentralizira i usmjerava na razine jedinica lokalne i regionalne uprave: županije, gradove ili općine, uz uvođenje različitih modaliteta sudioničkog upravljanja, uključujući osnivanje kulturnih vijeća. U ovom radu ukazujemo na određene zakonske manjkavosti i u tom smislu potrebu daljnjeg noveliranja propisa, te navodimo rješenja koja se nadovezuju na zakonske odredbe, a trebaju biti sadržana u aktima o osnivanju, statutima i drugim općim aktima samih ustanova u kulturi.
This paper analyzes the adequacy of the existing legal framework in the field of culture, i.e. the regulation of the status, management, and financing of public cultural institutions, especially those that are not regulated by special laws. The intention of this paper was to point out possible shortcomings in the existing regulation and self-regulation and to propose potential improvements to the legal regulation, all with the aim of establishing a modern normative framework for improving the conditions of management and financing of public cultural institutions in the Republic of Croatia. The position and powers of cultural councils as bodies that have an important role in deciding on the allocation of financial budget resources to cultural projects, as an example of contemporary cultural policy, are particularly pointed out. However, in their work, there is a possibility of a conflict of interest due to the disproportion of their status in the cultural field, and it is necessary to create appropriate legislative solutions that will eliminate the possibility of abuse of positions, i.e. interest-based subjective treatment when disposing of public funds for public needs in culture. By establishing cultural councils, the cultural policy of the Republic of Croatia follows the principles of contemporary cultural policy, whereby decision-making and co-decision-making on cultural issues are decentralized and directed to the levels of local and regional administration units: counties, cities, or municipalities, with the introduction of various modalities of participatory management, including the establishment of cultural Council. In this paper, we point out certain legal deficiencies and, in this sense, the need for further amendments to the regulations, and we list solutions that follow from the legal provisions and should be contained in the founding acts, statutes and other general documents of the cultural institutions themselves.

Autor u radu pregledno analizira pravni okvir međunarodnog, europskog i hrvatskog sportskog prava, kao podlogu za izradu strategija razvoja sporta na nacionalnoj razini i razini lokalne samouprave u ...Republici Hrvatskoj. U okviru rasprave o ovoj temi upućuje se na referentne odredbe revidiranog Zakona o sportu i kao i na svrhu i ciljeve novog Nacionalnog programa športa 2019. 2026. U radu se finalno istražuju strateški dokumenti jedinica lokalne i područne (regionalne) samouprave u Republici Hrvatskoj u području razvoja sporta i sportske rekreacije, te ukazuje na potrebe nove zakonske i strategijske podloge na nacionalnoj razini.
Singing the controversial international ACTA Agreement, initial role of the most developed countries, joining of most of EU member states, increase of counterfeiting and piracy at the world market, ...tempestuous public response, many protests, hacking spree against state websites, insistence on a right to respect digital, personal and privacy rights are all the parts of the recent global scene concerning this problematic issue, which also opens many questions relating to legal protection of intellectual property nowadays. One more questions that remains unresolved is the one regarding the realization of basic human rights. In this Paper the author analyses the question- does ACTA Agreement brings novelties in the area of penal protection of differentiating trademarks on the Internet, while comparing the abovementioned agreement with existing provisions of international and European Union legislation.
