The Mulukī Ain of 1854—the law code with constitutional features drafted at the initiative of Prime Minister Jaṅga Bahādura Rāṇā—is the foundational legal text for modern Nepal. It covers almost ...every aspect of public, criminal, private and religious law, ranging from the organisation of the state and courts to murder and other delicts, the workings of the caste system and the joint family, matters of purity and penance, customary law, widow-burning and witchcraft. As such, the Mulukī Ain is a unique source not only for the political, social and economic life of 19th-century Nepal, but also for the place of traditional Hindu jurisprudence in South Asian legal cultures.
Der Mulukī Ain von 1854, das erste Gesetzbuch Nepals, gehört zu den bedeutendsten Werken der modernen nepalesischen Rechtsgeschichte. Vom Staatsaufbau und Gerichtswesen über Tötungs- und Eigentumsdelikte bis hin zu Kasten- und Reinheitsvorschriften werden nahezu alle Aspekte des Straf- und Privatrechts, des öffentlichen, religiösen und Gewohnheitsrechts eingehend behandelt. When thinking of India, it is hard not to think of caste. In academic and common parlance alike, caste has become a central symbol for India, marking it as fundamentally different from other places ...while expressing its essence. Nicholas Dirks argues that caste is, in fact, neither an unchanged survival of ancient India nor a single system that reflects a core cultural value. Rather than a basic expression of Indian tradition, caste is a modern phenomenon--the product of a concrete historical encounter between India and British colonial rule. Dirks does not contend that caste was invented by the British. But under British domination caste did become a single term capable of naming and above all subsuming India's diverse forms of social identity and organization.
This innovative work of historical anthropology explores how India's Dalits, or ex-untouchables, transformed themselves from stigmatized subjects into citizens. Anupama Rao's account challenges ...standard thinking on caste as either a vestige of precolonial society or an artifact of colonial governance. Focusing on western India in the colonial and postcolonial periods, she shines a light on South Asian historiography and on ongoing caste discrimination, to show how persons without rights came to possess them and how Dalit struggles led to the transformation of such terms of colonial liberalism as rights, equality, and personhood. Departing from analyses that have stressed the role of integration, Dwaipayan Sen demonstrates how a wide range of coercions shaped the eventual defeat of Dalit politics in Bengal. The region's acclaimed 'castelessness' was born of the historical refusal of Mandal's struggle to pose the caste question.

Development programs and global agribusiness promote ...genetically modified seeds and organic certification as a path toward more sustainable cotton production, but these solutions mask a complex web of economic, social, political, and ecological issues that may have consequences as dire as death. In Cultivating Knowledge anthropologist Andrew Flachs shows how rural farmers come to plant genetically modified or certified organic cotton, sometimes during moments of agrarian crisis. Interweaving ethnographic detail, discussions of ecological knowledge, and deep history, Flachs uncovers the unintended consequences of new technologies, which offer great benefits to some-but at others' expense. Flachs shows that farmers do not make simple cost-benefit analyses when evaluating new technologies and options. Their evaluation of development is a complex and shifting calculation of social meaning, performance, economics, and personal aspiration. Only by understanding this complicated nexus can we begin to understand sustainable agriculture. Although each group focuses on its own problems, a global solution nonetheless emerges that optimizes irrigation flows for everyone. Did someone have to design Bali's water temple networks, or could they have emerged from a self-organizing process?
Perfect Order--a groundbreaking work at the nexus of conservation, complexity theory, and anthropology--describes a series of fieldwork projects triggered by this question, ranging from the archaeology of the water temples to their ecological functions and their place in Balinese cosmology. Stephen Lansing shows that the temple networks are fragile, vulnerable to the cross-currents produced by competition among male descent groups. But the feminine rites of water temples mirror the farmers' awareness that when they act in unison, small miracles of order occur regularly, as the jewel-like perfection of the rice terraces produces general prosperity. Much of this is barely visible from within the horizons of Western social theory.
The fruit of a decade of multidisciplinary research, this absorbing book shows that even as researchers probe the foundations of cooperation in the water temple networks, the very existence of the traditional farming techniques they represent is threatened by large-scale development projects.

As ...emblems of Bengali culture, Bauls have long been a subject of scholarly debates which center on their esoteric practices, and middle class imaginaries of the category Baul. Adding to this literature, the intimate ethnography presented in this book recounts the life stories of members from a single family, shining light on their past and present tribulations bound up with being poor and of a lowly caste. It shows that taking up the Baul path is a means of softening the stigma of their lower caste identity in that religious practice, where women play a key role, renders the body pure. The path is also a source of monetary income in that begging is considered part of their vocation. For women, the Baul path has the added implication of lessening constraints of gender. While the book describes a family of singers, it also portrays the wider society in which they live, showing how their lives connect and interlace with other villagers, a theme not previously explored in literature on Bauls.
A novel approach to the study of women, the body and religion, this book will be of interest to undergraduates and graduates in the field of the anthropology. In addition, it will appeal to students of everyday religious lives as experienced by the poor, through case studies in South Asia. The book provides further evidence that renunciation in South Asia is not a uniform path, despite claims to the contrary. There is also a special interest in Bauls among those familiar with the Bengali speaking region. While this book speaks to that interest, its wider appeal lies in the light it sheds on religion, the body, life histories, and poverty.
