Bei der Nutzung von Apps oder dem Besuch von Websites sind immer mehr Akteure daran beteiligt, personenbezogene Daten zu vielfältigen Zwecken zu verarbeiten. Oftmals sind sie für Betroffene nicht ...sichtbar, in ihrem Handeln kaum kontrollierbar. Gleichzeitig stellen mächtige Plattformen meist die Infrastruktur für Verarbeitungen. Diese Entwicklung stellt die Angemessenheit des privaten Datenschutzrechts und seiner Zuschreibung von Verantwortlichkeit auf die Probe. In diesem Spannungsfeld nutzt Florian Wittner interdisziplinäre Erkenntnisse, um die wichtigsten Akteursrollen und ihre Kontroll- und Einflusssphären aufzuzeigen und mit dem Verantwortlichkeitskonzept der DSGVO unter Berücksichtigung der EuGH-Entscheidungen Wirtschaftsakademie und Fashion ID abzugleichen. So werden Defizite aufgezeigt und Vorschläge für eine Weiterentwicklung des Regulierungskonzepts der DSGVO auf Basis einer neuartigen datenschutzrechtlichen Plattformverantwortlichkeit gemacht.

Die Möglichkeiten des Rechts, aber auch die Schwächen bisheriger Regulierung werden zum Thema. Der Autor plädiert für eine transdisziplinär inspirierte und transnational informierte Rechtswissenschaft, die nicht nur die Mikrowirkungen der Setzung und Anwendung von Recht, sondern auch die infolge der digitalen Transformation besonders bedeutsamen Makrowirkungen in den Blick nimmt.

Die digitale Revolution fordert ihren Tribut: Globale Plattformen wie Facebook, Twitter oder TikTok verdrängen immer mehr die traditionellen, national verankerten Medien. Dies führt auch ...regulatorisch zu gewaltigen Umbrüchen. Im Zentrum möglicher Regulierungen steht immer stärker die öffentliche Kommunikation als Totalphänomen mit pathologischen Begleiterscheinungen wie Fake News, Desinformation und Hate Speech. Urs Saxer analysiert die Möglichkeiten und Grenzen des nationalen Rechts beim Schutz von Grundrechten sowie von Rechtsgütern des Einzelnen und der Allgemeinheit sowie die Rolle der Plattformen als globale Kommunikationsinfrastrukturen. Des Weiteren untersucht er die komplexen Grundrechtsverhältnisse im Verhältnis zwischen Staat, Plattformen und individuellen Nutzern sowie den Einfluss der europäischen und globalen Regelungsebene. Das traditionelle Medienrecht erweist sich als Auslaufmodell. Es wird von einem mehrdimensionalen Neben- und teilweise auch Durcheinander diverser Normen und Regeln auf verschiedenen Ebenen mit unterschiedlicher normativer Qualität abgelöst. The article analyses the administrative law as a legal basis for the implementation of public administration, based on whose convictions of the authors that the public administration is the ...management of private, and, therefore, is the subject of legal regulation of private law. The authors argue that in the conditions of constant development of normative acts regulating the activity of governing bodies in Ukraine, the urgent problem in building a scientific approach to public administration is to understand the essence of public administration as a public administration process. Therefore, public administration should be analysed as a legal, managerial, and social category. It is substantiated that the application of public administration requires taking into account the basic principles of distinguishing political and administrative issues; comparative analysis of national, political, and economic problems and interests and the problems and interests of business organisations; increasing the efficiency of managerial service by introducing business administration practices to public administration. All this actualises the novelty of the article, which provides for the study of administrative and legal support for the implementation of public administration.

Gerade dieser Grundsatz ist es, der von einer zunehmenden Zahl ökonomisch geprägter Rechtswissenschaftlerinnen und Rechtswissenschaftler aus den USA in Frage gestellt ...wird. Neue Informationstechnologien ermöglichen es, Werbung und Preise zu personalisieren und so Gewinne zu maximieren. Warum sollten dann nicht auch die Rechtsnormen unter Zuhilfenahme von Big Data personalisiert werden, sofern sich damit Wohlstandsgewinne erzielen lassen? Philip Maximilian Bender tritt diesem Personalisierungsprojekt entgegen. Sein Ziel ist es, Bewusstsein für den Wert generellen Rechts zu schaffen, um einem schleichenden Systemwandel vorzubeugen. Eine auf Algorithmen aufbauende, allein an ökonomischen Erwägungen ausgerichtete Rechtssetzung würde - so die zentrale These - die Grundlagen einer liberalen Gesellschaftsordnung angreifen und in ein System mikrosozialistischer Fremdsteuerung münden.
The article points to the problem of a lack of adequate mechanism for correcting errors of state institutions in their performance of public administration functions. It analyses the legal regulation ...and case law on the above issue. The analysis of court cases identified in the paper shows that for a long time there was a tendency to place on the citizens the burden of correcting the mistakes made by state institutions. In this way, property rights on legally acquired property were restricted or invalidated. This problem was in the Lithuanian context broadly discussed by the international courts. The aim of the article is to present the scale of the problem and the evolution of legal regulation and case law aimed at remedying it.
The present analysis is justified by the challenges generated by the regulation of the normative framework of public power intervention in the management of some new social realities, with a direct ...impact on the state-citizen relations, in the context of the COVID-19 pandemic. Undoubtedly, some measures established by the Law No 136/2020 on the establishment of some measures in the field of public health in situations of epidemiological and biological risk, taken most often with celerity, will be subject to the control of legality of the courts of law. It would be absurd for acts that ultimately affect fundamental rights and freedoms not to be subject to the means of appeal and not to pass through the judge’s filter, the latter being the one who will, actually, decide on the fairness of the measure adopted. At the boundary between the analysis of the legality and the appropriateness of the measures adopted by the competent authorities of the state, the court of law will have to rule so that both the citizen, viewed individually, and the community feel safe in front of a threat that humanity never faced before. From this analytical perspective, the authors intend to address the issue of the possibility to invoke in court the exceptions of illegality in the context of the provisions provided by Article 17 of the Law No 136/2020.
The notion of “habitual residence” of the child is referred to in different juridical instruments, belonging to both national and international areas, which nevertheless do not define the notion. ...Given that the habitual residence must be determined in concreto in case of litigations, courts worldwide (national and international) have been forced to shape their own standards. The purpose of the article is to analyse this notion in the particular situation of international child abduction, given the continuously increasing number of cases where children are moved from one state to another, in the context of both free movement of citizens, but also respect for family life. Hence, the objectives of the present study are to identify legal instruments applying in case of an international child abduction and also the case law of both national and international courts, relevant in connection to the notion of “habitual residence”. Furthermore, in the context of lack of definition, absent juridical criteria and divided case-law, the study aims to identify the criteria that should be taken into consideration by national courts when establishing the state of habitual residence of the child.
