The court has the duty to establish his/her ...habitual residence taking into account the place where such person has the main centre of his or her interests and a stable presence.

The research ...aims to examine whether the citizenship status of the children of such marriages is based on the doctrine of revival or habitual residence. Using a literature review method with a descriptive qualitative approach, this research investigates the concepts and legal implications surrounding citizenship status in such marriages. The findings of this study reveal that the citizenship status of children born from Acehnese-Rohingya marriages follows habitual residence, even though their Rohingya parents adhere to the doctrine of revival The legal status of these children is subject to the Indonesian marriage law system. This is in line with Jasser Auda’s concept of maqāṣid sharī’ah because it prioritizes aspects of the benefit of these children. This research provides important insights into the issue of citizenship In Acehnese-Rohingya marriages and offers valuable meaning for understanding the dynamics of citizenship in these marriages.
The legal concept of domicile can be historically back traced at least to Roman law as domicilium, having already established at the time the distinction to the neighboring concept of municipal ...citizenship (origo) and frequently helping to determine the applicable law and the forum or litigation venue. The migrations of late Antiquity and early Middle Ages had temporarily diminished the importance of this point of connection in determining the applicable law, having temporarily assured the dominance of the personality of the laws on ethnic and tribal criteria. Once the feudal system and the principle of territorial sovereignty were firmly established, the concept of domicile in its historically relevant guise had regained its importance in private law, its role being once again diminished only in the last few decades by the rise in European and international law of the related but more flexible concept of habitual residence. This presentation will attempt, using mainly the historical approach and limiting itself to the European legal area, to identify the most important waypoints of the evolution of the private law concept of „domicile”, from the Roman antiquity to the present days.
Cuando se ponen en contacto dos formas distintas de resolver la duda de cómo afecta un cambio de residencia habitual a la competencia judicial internacional en materia de protección de menores ...(perpetuación de la jurisdicción en Bruselas II o transferencia de la competencia en el Convenio de La Haya sobre protección de menores de 1996), hay que optar, y eso es lo que hace la sentencia del TJ de 14 de julio de 2022, anclando su respuesta en motivos propios del Derecho de los tratados, y haciendo prevalecer en consecuencia la solución del Convenio.
En la RDGSJyFP, de 31 de enero de 2022, se analiza si la venta de un inmueble, realizada por los tres copropietarios del mismo, necesita el consentimiento del cónyuge de uno de ellos por tratarse de ...la vivienda habitual de la pareja. La exigencia del consentimiento del cónyuge no titular de la vivienda habitual puede venir impuesta por la ley rectora del régimen económico matrimonial o puede tener que aplicarse por formar parte del orden público del foro. En nuestro caso, el ordenamiento regulador de las relaciones patrimoniales de los cónyuges es el británico, en virtud de la primera conexión del artículo 9.2 CC, y, según el mismo, existe total libertad a la hora de que el cónyuge disponga de los bienes que son privativos de él. Por esta razón se plantea si puede exigirse el consentimiento del cónyuge no titular por la aplicación del artículo 1320 CC, como norma de orden público del ordenamiento español. Finalmente, se considera que el inmueble no constituye la vivienda habitual de la pareja y, por ello, no es necesario el consentimiento del cónyuge para que la venta del bien sea válida e inscribible.
Understanding the domicile and nationality is the key to properly adjudicating a case involving a foreign element by the judiciary. In this milieu, this paper aspires to analyse the concept of ...domicile and nationality with its evolving trend and evaluate the Nepalese judicial and legal policy on domicile and nationality through observation of international and local practices. Furthermore, this paper aims to trace the current policy gap in the legal and judicial interpretation of the domicile and nationality in the Nepalese context, including the citizenship bill. The paper concludes that connecting factors need to be used contextually on a case-to-case basis with proper policy genesis. It also prescribes key recommendations to address existing gaps, such as interpreting the habitual residence and nationality, domesticating the various Convention on the PIL such as Hague Conference on PIL, Law Applicable to Matrimonial Property Regimes, 1978, Celebration and Recognition of the Validity of Marriage, 1978, etc.
International child abduction is a problem, seen as growing, and increasingly as an activity that should be ruthlessly stigmatized and, if possible, eliminated from practice. The objectives of ...reducing, stigmatizing and ultimately eliminating international child abduction are served by a variety of measures within the framework of the Hague Conference on Private International Law and the European Union, including the creation of some sort of rapid response system. In the context of the operation of this combined system, in November 2020, the Court of Justice of the European Union received a preliminary question from the UK High Court of Justice (England & Wales), Family Division, in relation to doubts arising in the course of newly instituted court proceedings concerning jurisdiction in parental matters in situations of child abduction to a third, non-EU country. The issue is important as it relates to the possibility of initiating proceedings in the country from which the child has been abducted when the country to which the child has travelled is not in the EU.
En el presente auto la Audiencia Provincial de Valencia aborda una vez más el problema de fijar los límites, en frecuentes ocasiones difusos, entre el cambio de la residencia habitual o el mero ...traslado temporal. Concretamente, debe decidir si el traslado de residencia habitual con vocación de permanencia que resulta frustrado al cabo de dos únicos meses por la existencia de una crisis matrimonial sobrevenida e inesperada, determina la pérdida del carácter habitual de la residencia anterior.

La Audiencia provincial de Valencia estima el recurso, y luego de realizar algunos apuntes sobre la nacionalidad de los interesados, así como sobre su residencia habitual, declara competentes a los tribunales españoles para conocer sobre del proceso sobre responsabilidad parental y sobre la reclamación de alimentos revocando el auto de instancia.
La residencia habitual como criterio atributivo de competencia judicial internacional presenta indudables ventajas por tratarse de una conexión fáctica y realista, pero también deriva importantes ...inconvenientes derivados, en el ámbito europeo, de la ausencia de un concepto único y uniforme. Verificada esta realidad a partir de la práctica judicial española, y tras el análisis de la labor desarrollada por el Tribunal de Justicia entorno a la delimitación de esta figura, nos cuestionamos la necesidad de consagrar un concepto único y uniforme de residencia habitual que aborde todos los supuestos y facilite la concreción del tribunal internacionalmente competente para conocer de los litigios relativos a crisis matrimoniales y otras medidas vinculadas y relativas a responsabilidad parental, regímenes económicos y obligaciones alimenticias.
