Sont-ce les nouvelles formes de terrorisme qui sont à l’épreuve du droit, ou plutôt le droit qui est à l’épreuve et éprouvé par les nouvelles formes de terrorisme ? Le temps du droit n’est pas celui ...du terrorisme a souligné le professeur Dhommeaux dans son rapport de synthèse. L’objet de cet ouvrage collectif tend à préciser si les réponses du droit international et les réponses du droit français dans toutes ses disciplines sont efficaces pour contrecarrer la menace terroriste dans ses nouvelles manifestations. Les deux journées d’études des 5 et 6 novembre 2015 organisées par les doctorants du Centre de Droit Éthique et Procédures (CDEP) ont été l’occasion de fournir des clés pour comprendre ce qui se passe aujourd’hui en France et dans le monde en partant de la conceptualisation et de la rhétorique du terrorisme jusqu’à l’indemnisation de ses victimes. Face à un phénomène mondial, la réponse doit être globale, et le droit à lui seul ne suffit pas en réalité à répondre à toutes les questions soulevées par les nouvelles formes de terrorisme. Aux côtés des questions juridiques, la lutte contre la menace terroriste suscite des points de vue religieux, philosophiques, sociologiques, linguistiques et culturels et politiques. Le succès de ces journées de réflexion s’explique par leur approche pluridisciplinaire et l’originalité des thèmes peu abordés sur le plan théorique et pratique. La transversalité des thèmes abordés, le désenclavement des disciplines et l’entrecroisement fécond de tous les débats de ces deux journées d’étude consacrées au « droit à l’épreuve des nouvelles formes de terrorisme » ont permis de favoriser la complémentarité des savoirs, l’esprit d’ouverture sur un phénomène devenu mondial et de prendre la pleine mesure de tous les aspects de ce phénomène à la fois ancien et nouveau.
Tüzel kişilerin ceza hukuku karşısındaki konumu her zaman tartışmalı olmuştur. Özellikle paravan şirketler aracılığıyla işlenen suçlar karşısında tüzel kişilere para cezası yahut kapatma gibi cezalar ...verilmesi gerektiği savunulmuştur. Öte yandan bu görüşe karşı olanlar tüzel kişiler hakkında ceza yaptırımı uygulanmasının sorumluluk alanını genişlettiğini ifade etmişlerdir. Bugün gelinen noktada ise ağırlıklı olarak ceza sorumluluğunun tüzel kişiyi oluşturan gerçek kişilere ait olduğu kabul edilmektedir. Mali faaliyetlerini tüzel kişiler aracılığıyla yürüten devlet bakımından ceza sorumluluğu gerektiren fiillerin ne şekilde cezalandırılacağına da değinmek gerekir. Devletin özel hukuk tüzel kişileriyle girdiği hukuki ilişkiler bakımından sorun TCK’da yer alan genel kurallara göre çözülecektir. Ancak diğer yandan devlet adına eylem ve işlemlerde bulunan kamu görevlilerinin durumu farklılık arz etmektedir. Kamu görevlilerinin ceza sorumlulukları bakımından ayırt edici iki nokta vardır. Kamu görevlileri 4483 sayılı kanun gereğince bir izin prosedürünün ardından yargılanabilirler ve TCK’da kamu görevlileri için öngörülen ve özgü suç adı verilen müstakil suç tipleri mevcuttur. Kamu görevlilerine hitap eden bu suç tipleri devletin mali saydamlığının sağlanması açısından ciddi bir önlem niteliği taşırlar. Bu çalışmada da öncelikle kamu görevlilerinin yargılanma usulüne ilişkin kısaca bilgi verilecek ardından da mali saydamlığın sağlanmasında kamu görevlileri hakkında uygulanabilecek suç tiplerine ilişkin bilgi verilecektir. Son olarak ise karşılaştırmalı hukuktaki durumdan söz edilecek ve önerilerde bulunulacaktır.
The status of legal persons before law has always been controversial. According to some scholars especially crimes committed by means of shell companies require fines or closure as sanctions. On the other hand, the opponents state that punishing legal persons broaden the scope of criminal liability. In todays modern understanding, criminal liability belongs to the real persons which establish the legal person. As the state carries out fiscal transactions by it’s officials, the criminal law regime for these officials should be discussed. Private law transactions of the state require a criminal investigation according to general rules of criminal code. On the other hand, the regime is different for public officials who act on behalf of the state. There are two main differences in the criminal law regime of public officials. Public officials can only be prosecuted after a permit procedure according to code nr. 4483 and there are special crime types for these officials. These crimes play an important role to ensure fiscal transparency. In this study first the prosecution process of public officials will be addressed and then criminal law provisions that apply to these officials will be discussed. The last part constitues of comparetive law and suggestions.
Fransız İhtilali ile başta Avrupa olmak üzere tüm dünyayı etkisi altına alan demokratikleşme düşüncesinin Osmanlı devlet ve toplumunu da etkilememesi düşünülemezdi. Osmanlı devlet adamı ve aydını ...tanıdığı ve Avrupa’nın ilerlemesinin sebebi olduğunu düşündüğü demokrasi kurum ve kavramlarını Osmanlı Devleti’nin kurtuluşu için bir araç olarak kullanmaya çalışmıştır. Ancak demokrasi Osmanlı Devleti için daima bir mücadele sahası olmuş ve özellikle egemenliğin kaynağının ilahî mi yoksa beşerî mi olduğu noktasında düğümlenmiştir. Bu çalışmada Osmanlı Devleti’nde yaklaşık bir asır boyu verilen demokrasi mücadelesi ve nihayet Kanun-ı Esasi ile gelinen nokta, dönemin şartları göz önünde bulundurularak değerlendirilmektedir.
Doğa olaylarının afet şeklini alması insanların oluşturduğu sistemlerin bir sonucudur. Bu sistemlerin devamlılığını ya da sürekliliğini sağlayan ise, tabi oldukları yasal dayanaklar ve ...yönetmeliklerdir. İlgili mevzuat çerçevesinde tanımlanan kurallar da, zaman içerisinde teknoloji ve ihtiyaçlar doğrultusunda değişirler. Türkiye’de afet zararlarını azaltma çalışmalarına yönelik ilgili yasa ve yönetmeliklerde yapılan değişimler hep yaşanan afetler, talihsiz olaylar ve tecrübeler sonrası gerçekleşmiştir. Cumhuriyet tarihimizde 1939 Erzincan Depremi ile başlayan depremlerin neden olduğu zararları azaltılma çalışmaları bugün dahi istenilen düzeye erişememiştir. Hatta 1999 Marmara depremine kadar yapılmış çalışmaların çoğunun afet sonrası oluşan zararların giderilmesi yönünde olduğu gözlenmektedir.Bu bağlamda, yaşanan 1999 Marmara depremi sonrası, Türkiye’de afet zararlarını azaltma çalışmalarına yönelik denetim ve mevzuat yetersizlikleri sorgulanır hale gelmiştir. Oluşturulan yeni gündem neticesinde, TÜBİTAK ve çeşitli üniversitelerin de katıldığı “proje odaklı” uygulamaya dönük bir dönem başlamıştır. Bu çalışmada, Osmanlı döneminden günümüze kadar geçen süreçte, ülkemizde yürürlüğe girmiş yasal düzenlemeler kapsamında yapılan uygulamalarla birlikte ne tür sorunlar ile karşılaşıldığı ve çözüm önerilerine yönelik genel bir değerlendirme yapılmıştır. Starting from the 1939 Erzincan earthquake of harm reduction efforts is not at the desired level even today.. In fact, it is observed that most of the work until 1999 Marmara earthquake is the elimination of the losses occurred after disasters. In this context, after the 1999 Marmara earthquake, lack of supervision and legislation for disaster mitigation work in Turkey has become questionable. Created as a result of the new agenda, TUBITAK and the participation of various universities "project-oriented" applications began facing a period.. In this study, a general assessment of solutions was made about the applications under the legislation and the problems that our country is faced in the period from the Ottoman to the present day. In addition, which is still in force today “the Law on Transformation of Areas under the Disaster Risk No. 6306” was examined in a critical perspective.
This article will view specifically codification of Islamic Criminal Law in `Muslim community, such as Brunei Darussalam, a country based on Islamic principles, and Aceh is a part of Indonesian ...territory administratively, granted special autonomy to implement Islamic Sharia. Despite having different qualities, -as a country and a province- both have in common as a political power which apply Islamic Criminal Law. Refer to both qānūn jināyat in Brunei and Aceh, the author’ll explain the substance of the criminal law in both area, while also reinforces the implementation of Islamic Criminal Law in the framework of a modern state. The article concludes that basically the application of Islamic Sharia, particularly the Islamic Criminal Law, is closely related to the situation and socio-political conditions of a community or country. The differences of political system, for example, has contributed to the difference in the output of product or policy made by a particular country or territory. On the other hand, Brunei and the Aceh case show that there has been adjustment Islamic Criminal Law specifically set forth in the books of fiqh (as illustration of the Qur'an and Sunnah) with the needs of the community itself
In societies where it has been known and applied, bloodfeud is described as a possibly outdated and uncivilized mechanism, but often effective to limit violence. Indeed, both in form and substance ...the phenomenon itself is hard to be perceived and understood by the modern citizen of every country of the world, including Albania, where it is still active in some regions in respect of “Kanun”. In fact, the Albanian term 'Kanun' describes the body of traditional norms/standards and rules governing society in the field of criminal, civil and procedural laws. Its application or merely its existence in moral and legal standards makes a society safer, certainly referring to a society where the power of central authority, namely of the state, either did not exist or lacked. The greatest anthropological dilemma is just there, why does Kanun work in a modern state? In societies where blood feud has been present as a regulatory element of social conflicts it is accepted that its abolition or decline occurred only when another subject (the state), took over to intervene in these conflicting relationships, and to provide the resolution and regulation of social and economic relations through enforcement of rule of law, or the public order. And the question arises by itself: why the Albanian state did not take over the blood feud solution by use of public order? The Kanun does not recognize the state or the state does not recognize the Kanun? Why? It is not easy to get into such historic and social dilemmas, but a modest effort should be made. The answer to this fact should be found by the history of Albania. As a questioning remark, the reason for the long life of Kanun, rather called as self-regulatory law of the society, is due to the historic absence of a state on the side and interests of its citizens.

The Kanun is an important manifestation of Albanian consuetudinary law in force at a given historical moment. It is characterized by the absence of institutions or bodies set up to design and impose ...rules, norms or precepts that could maintain order and ensure that within the community, the associates can live and carry out their activities in observance of and compliance with the rules and precepts imposed by the State authorities. Active operation according to the Kanun rules is not only common among the populations settled in the mountains of Albania but also, and above all, in the context of Albanian criminality which, as is well known, has also spread to Italy, creating partnerships and cross-contaminations with Italian crime. The research was carried out mainly in Albania at the bodies and institutions responsible for dealing with and controlling crime in the nation, but also focuses on the issue of connections with, and influences on, Italian crime.

Özellikle silahlı kuvvetler bünyesine ...girmiş ve çok iyi bir şekilde kendini kamufle etmeyi başarmış örgüt/örgütler, gerek darbe girişimi ve gerekse darbe sonrası Olağanüstü Hal-OHAL kapsamında çıkarılan Kanun Hükmünde Kararnameler-KHK’lar ile olayın vahametini bir kez daha gözler önüne sermiştir. Söz konusu durumun meydana gelmesinin pek çok nedeni olabilir. Ancak, yönetim bilimi açısından konuyu rasyonellik ve yarı rasyonellik boyutu ile irdelemek gerekmektedir. Yönetsel karar verme süreci, etik boyutları ve rasyonel temelleri olan bir süreçtir. Ancak Herbert A. Simon’un Sınırlı Rasyonellik Yaklaşımında, yöneticilerin pek çok kısıtlamalardan dolayı gerçekçi ve mantıklı karar veremediklerini ileri sürmektedir. Bu çalışmanın amacı, Türkiye’de kamu kurumlarına, özellikle askeri kurumlara personel alımlarını ve kariyer durumlarını sınırlı rasyonellik yönünden analiz etmektir. Bu nedenle, önce Simon’un sınırlı rasyonellik modeli üzerinde durulacaktır. Daha sonra ise, söz konusu terör örgüt/örgütlerinin özellikle askeri yapılara nasıl girdikleri, kariyer basamaklarını hızla tırmanırken hangi yöntem ve referansları kullandıkları tespit edilmeye çalışılacak ve KHK’lar ile bu kurumlardan atılan personelin nitelik ve nicelikleri analiz edilerek elde edilen sonuçlar sınırlı rasyonellik yaklaşımı bağlamında değerlendirilecektir.
In the world history, the nineteenth century witnessed globally major economic, politic, and social changes. More importantly, their implications constitute today’s challenges particularly for modern ...Muslim-majority states where the tension between state, religion and society has not been settled. There is no doubt that looking at the past where the separation between sharī‘a and state started clearly to appear serves for a better understanding of today’s struggle in locating the role of sharī‘a in legal systems of modern Muslim-majority states. Many of them, i.e. the Middle Eastern and some North African states are the successors of the Ottoman Empire. The Ottomans ruled over continents for centuries thanks to their well-established governmental policy and legal system. However, they were also obliged to introduce some remarkable changes in social, political and legal spheres in the nineteenth century. The era is generally called as the process of Ottoman modernization and secularisation referring to Tanzimat Edict and following legal reforms. This study seeks to analyse the way Ottoman law has been transformed in the nineteenth century, as well as its roots, challenges and implications. To this end, the paper offers an answer to the questions as to whether secularisation of Ottoman law was evolutionary or revolutionary, why it had to go through a process of secularisation, and to what extent classical Ottoman system could serve this secularisation process. To address these inquiries, the study is divided into two principle sections: the first part evaluates the classical Ottoman legal system and its religious and non-religious characters, arguing that the Turkish state tradition with its influence on government and law making were in fact the changeable features of the Ottoman law
