Namen prispevka je proučiti in jasno opredeliti pojme javno dobro, skupni viri in skupno. V članku smo na podlagi prostorsko-časovne analize, intervjujev in delavnic med splošno in strokovno ...javnostjo osvetlili dojemanje javnega dobra in skupnega v Sloveniji kot tranzicijski družbi. Analiza je pokazala, da na razumevanje teh pojmov med splošno javnostjo še vedno močno vpliva poudarjanje socialne pravičnosti, enakosti in dostopnosti dobrin za vse iz obdobja socializma, kar je lahko v nasprotju s pravico do zasebne lastnine. Neustrezno upravljanje dobrin, ki so dojete kot javno dobro, v resnici pa so skupni viri, lahko vodi v konflikte in razvrednotenje skupnih virov, s čimer bomo izgubili prednosti, ki nam omogočajo kakovostnejše življenje. Ker smo od omejenih naravnih virov življenjsko odvisni, je treba o njih nujno ozavestiti splošno in strokovno javnost, izpostaviti ranljivost teh virov in pojasniti, dane morejo biti dostopni vsem v neomejenih količinah. V mednarodnem okolju želimo s predstavljenim slovenskim primerom prispevati k boljšemu razumevanju človeškega vedenja in pričakovanj do javnega dobra in skupnih virov v postsocialističnih tranzicijskih družbah.

This article covers all the most relevant aspects of judicial expertise in the field of land surveying. It is focused on non-contentious civil procedures for the regulation of boundaries, for the ...division of common property, enforcement procedure for the division of property. Among them, the problems of division into divided co-ownership (condominium) were also taken into consideration. The author explains how the judge and the expert co-operate in the public hearing or outside of it to issue a court decision that is (together with expert's specific input) appropriate for inscription into the cadastre. In case of division of land with parcelling or in the case of division into a condominium, a further inscription into the land register is necessary. The advantage of this contribution is in author's taking a position on disputed questions in relationship between the legal and land surveying professions, by taking into consideration the legal sources from both sides.
V članku je opisana raziskava o obravnavi lastnine velikih lastnikov v projektu obveščanja. Oblikovan je bil vzorec sedmih lastnikov, ki jih lahko opredelimo kot reprezentativne predstavnike glede na ...lastnosti nepremičnin v njihovi lasti in »vrsto« lastništva. Na vzorcu teh sedmih lastnikov so bila obravnavana razmerja med njihovimi internimi evidencami in podatki registra nepremičnin ter opredeljene težave, s katerimi so se srečevali med obveščanjem o poskusnem izračunu vrednosti nepremičnin. V vzorec je bilo uvrščenih 26.792 sestavin nepremičnin, kar pomeni 0,4 % vseh sestavin nepremičnin v registru nepremičnin. Neskladja so bila uvrščena v štiri sklope, podane so značilnosti teh sklopov. V članku je predstavljena tudi vključitev zasebnega sektorja v projekt obveščanja. Rezultati analiz kažejo, da je vzrok za večino zaznanih neskladij odnos do lastnine, in sicer odnos do lastnine vsakega posameznika in naše družbe kot celote ; This article describes an examination of the property of large real estate owners in the Information of Test Property Value Calculation project. A pattern of seven owners has been made, which can be considered representatives of property, considering the characteristics of their property and the type of ownership. Based on this pattern, the relationships between their internal records and the real estate registry database have been analysed, and problems that occurred during the informing of the test property value calculation have also been noted. The pattern consisted of 26,792 constituent parts of real estate, which represents 0.4% of all the real estate parts noted in the real estate registry. Discrepancies have been divided into four sets, and characteristics of these sets have also been given. The article also presents the inclusion of the private sector in to the information process. Analysis results show that the cause of most of the detected discrepancies is the lack of responsibility of owners towards their property.
Das Buch behandelt die Haftung der Intermediäre aus der Sicht des Internationalen Privat und Zivilverfahrensrechts. Im Mittelpunkt steht die Frage, welches Recht bei grenzüberschreitenden ...Sachverhalten, wie sie typischerweise im Internet entstehen, über die Haftung des Intermediärs, der eine Immaterialgüterrechtsverletzung durch Bereitstellen einer Plattform oder eines Zugangsdienstes ermöglicht, entscheidet. Ausgehend von den Vorgaben des immaterialgüterrechtlichen Territorialitätsprinzip und der darauf aufbauenden Schutzlandanknüpfung sowie deren Grenzen, den Vorgaben des Unionsrechts und der materiellrechtlichen Ausgestaltung verschiedener Formen der Haftung für die Ermöglichung von Immaterialgüterrechtsverletzungen im deutschen, französischen und US-amerikanischen Recht wird für die Haftung der Intermediäre eine eigenständige kollisionsrechtliche Anknüpfung befürwortet, die zur Anwendung eines vorhersehbaren Rechts führt.
V prispevku so obravnavane pojavne oblike javnega dobra, ki jih danes lahko zasledimo kot lastnike, vpisane v zemljiško knjigo, in se kot prevzet podatek pojavljajo tudi v zemljiškem katastru. ...Oblikovan je bil vzorec 80 zemljiškoknjižnih vložkov, ki so bili preučeni glede na pojavno obliko naziva javno dobro v listu B zemljiške knjige in glede na pravne podlage za vknjižbo. Izvedena je bila tudi primerjava med podatki o lastniku v zemljiški knjigi in zemljiškem katastru. Poleg tega je bil opravljen pregled uporabe termina javno dobro v zakonodaji, ki ureja področje zemljiške knjige od leta 1871 do danes. Rezultati preučevanja kažejo, da se kljub določilom Zakona o zemljiški knjigi (ZZK-1), ki uvaja pojem zaznambe javnega dobra in ne javnega dobra kot lastnika, ta še danes pojavlja kot oseba, vpisana v listu B zemljiške knjige. This research paper deals with the different forms of public good that are indicated as owners registered in the land registry; a copy of this information can also be found in the land cadastre. A sample of 80 land registry ledgers was assembled; these were examined in terms of the form of the title “Public good” in the B folio of the land registry and of the legal basis for the registration. A comparison of ownership data in the land registry and land cadastre has also been made. Use of the term “public good” in legislation governing the public registry system from 1871 until today has also been examined. The results indicate that The Land Registry Act provisions introduced theannotation of public good, but not public good as an owner; nevertheless, the results show that the latter is still listed as a person registered in the B folio of the land registry.
Avtorica v prispevku raziskuje pomene »ukoreninjenosti« ali lokalnosti v južnoalbanski vasi Dhërmi (uradno albansko ime) oziroma Drimades (lokalno grško ime) in se sprašuje o razmerju med lokalnostjo ...ter zemljo in lastnino. S sodobnimi procesi privatizacije, ki pogosto povzročajo zemljiške spore, pa so začele na lokalnost vplivati individualne zahteve po zemljiški lastnini. V članku opiše in pojasni, kako se vaščani, ki nenehno potujejo in se selijo, odzivajo in kako upravljajo in ustvarjajo lokalnost in pripadnost ter si na ta način zagotavljajo zemljiško lastnino, in obratno. Avtorica se na podlagi štirinajstmesečnega antropološkega terenskega dela v omenjeni vasi osredotoča na domačine, povratnike in lastnike turističnih storitev na vaški obali ter izseljence, ki se vsako leto v poletnih mesecih vrnejo v vas. Predpostavlja, da ko domačini in povratniki razvijajo občutke lokalnosti in pripadnosti, nenehno rekonstruirajo in utrjujejo vezi z zemljo in lastnino, vzpostavljajo nadzor nad delom, produkti in dohodki, določajo prevlado nad zemljo ter ustvarjajo pomen lastnine.
