The subject of this paper is non-contractual liability of physicians in Roman law. Contrary to the common perception of Roman society, where “only a physician can commit homicide with complete ...impunity” (Plinius, Nat. Hist. 29,8), parallel to the development of medicine, rudimentary stages of a physician's liability for damage through negligence also evolved. Through the interpretation of available legal sources, focusing particularly on situations concerning slaves and free persons as patients, the forms of legal protection of patients are primarily determined. Special attention in the central part of the paper is devoted to the problem of causality and the development of fault-based liability. The last part of the paper examines the forms of compensation for damage, based on which conclusions are finally drawn about the extent of the development of medical liability ex delicto.
Predmet rada je deliktna odgovornost liječnika u rimskom pravu. Suprotno uvriježenoj percepciji rimskog društva da je "liječnik jedina osoba koja može nekažnjeno ubiti čovjeka" (Plinius, Nat. Hist. ...29,8), paralelno s razvojem medicine pojavljuju se začetci odgovornosti liječnika za štetu prouzročenu vlastitom nepažnjom. Interpretacijom dostupnih pravnih izvora, osvrćući se osobito na situacije kada se u ulozi pacijenata nalazi rob te slobodna osoba, utvrðuju se ponajprije oblici pravne zaštite pacijenata. Posebna pozornost u središnjem dijelu rada posvećena je problemu kauzaliteta i razvoju subjektivne odgovornosti. Posljednji dio rada propituje oblike naknade štete te se na tim osnovama naposljetku donose zaključci o dosegu razvoja liječničke odgovornosti ex delicto.
Según nos comenta el célebre romanista Juan Iglesias7, en la época clásica la pena privada tenía un carácter punitivo, sin embargo en la época justinianea esta pena degeneró en una sanción tendiente ...al resarcimiento, pero no hasta el punto de perder por completo su viejo efecto expiatorio, de manera que la acción se transformó de ser una penal, a una mixta -penal y reipersecutoria- de modo que a una restricción del efecto típico de la pena, corresponde una mayor consideración del resarcimiento, de la reparación material del daño. Por otra parte, según Coppa-Zuccari45, el primero en utilizar el término compensación de culpas fue Demelius, sin embargo, según Brandâo46 y Medina47, el primero en teorizar la doctrina de la compensación de culpas fue Johann Friedrich Eisenbach en su tesis doctoral "De Compensatione circa maleficia, vel quasi occasione legis XXXVI Digesta de dolo malo" de 1778, formulando esta idea para los daños recíprocos, donde se compensan las culpas de los dos sujetos, víctima y agente, sin ser aplicable al caso de los daños que solo una de las partes sufría; y más tarde fue aplicada por los pandectistas del siglo XIX al problema de la culpa de la víctima. Precisa San Martín que "si bien en el Corpus Iuris se han identificado diversos pasajes en que la culpa de la víctima actúa como eximente de responsabilidad, de ellos no se sigue que en Roma hubiera regido un principio de compensación de culpas, pues falta la ilicitud de la conducta del agente, ya sea por ausencia del elemento in iura o porque el perjudicado asumió el riesgo de la lesión"69. El artículo analiza la relación de causalidad en la lex Aquilia y cómo ésta fue desarrollada desde la regla "damnum corpore corpori datum". En ese contexto, el artículo propone categorías de casos, ...en que la culpa se emplea como mecanismo de determinación de la causalidad, para el otorgamiento de acciones directas o acciones in factum, según si el autor del daño ha tenido el dominio inicial del hecho.

The author, studying the reception of Roman law in medieval Serbia, examines the case of famous lex Aquilia. First, Roman legal sources were analysed, then their transformation through Byzantine law ...and finally their reception in the Serbian medieval law. Lex Aquilia and its interpretation by Roman iurists is present in the medieval Serbian law in the very modest way. It is reduced down to only two or three fragments respectively, from the Justinian's Codex and the Digest title 9.2. Ad legem Aquiliam. The fragments are concerned with the cases of damage caused by killing pecora C.3.35.5 and by burning - urere: D.9.2.30.3 (Paulus libro 22 ad edictum), D.9.2.49.1 (Ulpianus libro nono disputationum). The above mentioned fragments first found their place in the Byzantine compilations (Ekloga, Proheiros Nomos, and the Syntagm of Matthew Blastares). Then they became part of the Serbo-Byzantine compilations: the Nomocanon of Saint Sava (ca. 1219), chapter 55 called City-statute (translation of Proheiros Nomos), the Syntagm of Matthew Blastares (14. century) translated into Serbo-Slavonic language (E-7). The abridged version of the Syntagm of Matthew Blastares (E-4) was made in medieval Serbia by reducing ecclesiastical law and preserving civil and criminal provisions. The compilation entitled Constantine Justinian's Law is based mainly on the Syntagm of Matthew Blastares. The way of reception shows decay and vulgarisation of the Justinianic tradition. For example, above mentioned texts were associated with criminal law and merged with the fragments from the Digest' book 47, title 9 (De incendio ruina naufragio rate nave expugnata), and the cases of incendium - D.47.9.9 Gaius libro quarto ad legem duodecim tabularum, D.47.9.11 Marcianus libro 14 institutionum. The fragments of Roman iurists were abridged by dropping out all teorethical issues. Only pure casuistry is preserved.
The paper addresses the meaning of the Digest of Justinian 9.2.27.14, which deals with the case of damage caused by contamination of the soil by weeds. The author of this paper concludes that neither ...Celsus nor Ulpian had any doubt that in the case of the contamination of soil an interdictum quod vi aut clam could be brought, but only within a period of one year following the damage. This interdict is granted to either the owner, and, if the land was subject of the contract of lease, to the tenant (lessee), but only to one of them. Furthermore, an Aquilian action could also be brought, but only one of these two legal instruments could be used. The lawsuit could be brought both by the owner or by the tenant. The actio is granted to both the the owner and the lessee, not as an actio directa, but as an actio in factum ex lege Aquilia. The reason for this cannot be established with certainty.
La Lex Aquilia del derecho romano, plebiscito aprobado en el siglo III a. C., es el origen del moderno régimen de responsabilidad civil extracontractual de aquellos ordenamientos que son parte del ...sistema jurídico romanista, por lo que su estudio constituye hoy por hoy una necesidad, pues nos permite una comprensión más sólida de las previsiones de los códigos civiles actuales, tanto europeos como latinoamericanos.Por ello, el presente artículo analizará en una primera parte el contenido de los tres capítulos del plebiscito y las posibles cláusulas procesales que le seguían; luego en una segunda parte se analizaran los elementos estructurales del damnum iniuria datum, delito regulado por los capítulos primero y tercero de la ley, así como la evolución que sufrió cada uno de estos elementos a través de la interpretación de la jurisprudencia; en la tercera parte se analizará cómo la actividad del pretor amplió el campo de acción de la lex Aquilia mediante acciones pretorias; y por último se expondrá sintéticamente el estado de cosas en la Codifi cación de Justiniano.
