En el presente trabajo se va a realizar el análisis de una cita del Digesto de Justiniano sobre el corte de árboles furtivo de Paul., 9 ad Sab., D.47.7.1 respecto de cuál es el alcance de la ...aplicación de la Lex Aquilia en la responsabilidad por el daño causado sobre cosa ajena, y su eventual confluencia o superposición con otras normas jurídicas, en éste caso, con la Lex de las XII Tablas de más antigua data, los juristas intervinientes y su obras jurídicas para ubicarlos en un contexto de formación jurídica que han tenido en su época. El objetivo central es buscar una solución jurídica en el contexto tan complejo de la casuística romana. El método que se aplica es el exegético, el más utilizado para el estudio de las normas romanas y por último analizar las normas, posiciones, superposiciones, y el resultado final de aplicación de la norma superadora de la casuística romana.
The purpose of this paper is to continue deepening everything related to the lex Aquilia; in this case, the different groups of actions related to Aquilian previsions: from direct action to other ...actions in factum, utilis, ad exemplum and quasi damni iniuriae legis Aquiliae.
El objeto de este trabajo es seguir profundizando sobre todo lo relacionado con la lex Aquilia; en este caso, los distintos grupos de acciones relacionados con las previsiones aquilianas: desde la acción directa a las otras acciones in factum, utilis, ad exemplum y quasi damni iniuriae legis Aquiliae
El presente artículo persigue analizar las distintas posiciones que en la romanística moderna se han elaborado en relación con el concepto de la culpa y su papel en el régimen del delito aquiliano. ...Destacaremos tres posiciones: aquella que concibe la culpa como un producto de la época justinianea, entendiendo que la culpa equivalía a la imputabilidad o la mera relación causal en el período clásico; otra, por el contrario, sostiene que la culpa, en el período clásico, correspondía a la negligencia, entendida como la desviación del estándar del buen padre de familia. Según una tercera teoría, tanto en el período clásico como posteriormente, la culpa expresaba la conducta que podía ser considerada como una materia de reproche individual. En una segunda parte del artículo, se expondrá la crítica metodológica, especialmente a la aplicación de las categorías responsabilidad objetiva-subjetiva para el Derecho romano. Por último, se propone analizar el concepto de la culpa a la luz de sus relaciones con la causalidad, lo que permite descartar la tesis objetiva.

Nowadays it is generally held, that the owner who brought an actio legis Aquiliae usually claimed no more than his loss, perhaps already in Ulpian's time, for certain in Justinian's. For the ...sum of condemnation based upon the estimation-clauses of the lex Aquilia would only then exceed his damages, if either the injured object's value had decreased in the last year or 30 days (Inst. 4,3,9) or the wrongdoer had denied having caused the damage (C. 3,35,4). There is, however, a third reason, which the Roman texts fail to mention: a possible residual value of killed lifestock, wounded slaves, and damaged objects, which benefitted the owner. Only a few later jurists took this into account: in medieval times Jacques de Révigny and Pierre Jacobi, Johann Oldendorp in the Early Modern era. The notion prevailed that the lex Aquilia obliged to pay at least the object's full value.
As the jurisprudential interpretatio was expanding the list of damages subject to the Aquilia law ordering the praetor to demand the relative responsibility of the author of the damnum through ...actiones utiles, acquires relevance the concept of causality to demand reparation due exceeding the original limits of the chapter I of the law (occidere corpore suo) to sanction the damnum alio modo datum, and it may be attributed to Gaius 3,219 the contribution of the bases for a general exposition of the causality, that numerous texts carry in the guilty behavior of the offender, treating jurists of find a causality as an inspiring criterion of their decisions, which had no philosophical anchors but practical and immediate.
A medida que la interpretatio jurisprudencial fue ampliando el elenco de daños sujetos a la ley Aquilia ordenando el pretor exigir la relativa responsabilidad del autor del damnum mediante actiones utiles, adquiere relevancia el concepto de causalidad para exigir la reparación debida que supera los límites originarios del cap. I de la ley (occidere corpore suo) para sancionar el damnum alio modo datum, y acaso pueda atribuirse a Gayo 3,219 la aportación de las bases para una exposición general de la causalidad, que numerosos textos cargan en la conducta culposa del delincuente, tratando los juristas de encontrar una causalidad como criterio inspirador de sus decisiones, que no tenía anclajes filosóficos sino prácticos e inmediatos.
El artículo indaga las conexiones entre las expresiones griegas ἁμαρτία y ἁμάρτημα empleadas por Aristóteles a propósito del tratamiento de los actos voluntarios e involuntarios y la noción romana de ...culpa. Una parte de la doctrina ha identificado dichos términos con la negligencia, en tanto que ἀδικία o ἀδικημα se identificarían con el dolo y ἀτύχημα con el casus. Otro sector sostiene la independencia de la culpa romana o su identificación, en un sentido más amplio de la expresión, con ἀδικία. El artículo concluye que la expresión ἁμάρτημα toca el nervio de la culpa, puesto que en ambos conceptos aparece como elemento central la falla en la conducta (no en la voluntad). Y por eso la ignorancia también transita en el concepto de la culpa, porque el sujeto ignora, ha errado o falla en la previsión exigida. Desde esta inicial coincidencia, puede afirmarse, sin embargo, que la noción de culpa elaborada por la jurisprudencia romana constituyó un genuino aporte técnico al Derecho.
Ἡ τοῦ διπλοῦ ἀπαίτησις (the actio in duplum) for wrongful damage - A mystery in Byzantine law. In addition to the actio legis Aquiliae utilis and the actio in factum from classical and justinianic ...law, for cases of indirectly caused damages, Byzantine law also grants an actio in duplum. In this actio in duplum, unlike the two remedies first mentioned, the fine increases to the twofold. Curiously enough, this doubling does not depend on whether or not the defendant denies the damage. In the Basilica we can find for cases of damage to property, when direct causation is lacking, two different remedies for claiming the double, the actio legis Aquiliae with litiscrescence and the actio in duplum. These remedies originate more or less from two different periods. The first remedy we mainly find in jurists from the sixth century. It was only applied in cases of direct caused damages, in which the defendant denied. The jurists do not yet mention the actio in duplum and substantively follow justinianic law. The second remedy we particularly find in late Byzantine law. In the period between the early and late Byzantine law Basilica remarks of jurists can be found who display a move from the actio legis Aquiliae with litiscrescense unto an independent actio in duplum. Because of contradictions, mistakes and differences of opinions no clear explanation for the development of the actio legis Aquiliae (utilis) and the actio in factum to an actio in duplum can be discovered.
Neben der actio legis Aquiliae utilis und der actio in factum aus dem klassischen und justinianischen Recht erteilt das byzantinische Recht bei indirekt verursachtem Schaden auch eine actio in duplum. Seltsamerweise hängt die Verurteilung auf das Doppelte aber - anders als im klassischen Recht - nicht davon ab, ob der Beklagte leugnet, für den Schaden verantwortlich zu sein. In den Basiliken finden sich für Fälle indirekter Schadenszufügung zwei verschiedene Klagen auf das Doppelte, die actio legis Aquiliae mit Litiskreszens und die actio in duplum. Diese Klagen stammen aus zwei verschiedenen Perioden: Die erste Klage begegnet hauptsächlich bei Rechtsgelehrten des sechsten Jahrhunderts; sie wird nur erteilt, wenn der Schaden direkt verursacht wurde und der Beklagte leugnet. Diese Juristen sprechen noch nicht von der actio in duplum und folgen dem materiellen justinianischen Recht. Die zweite Klage findet man vor allem im späten byzantinischen Recht. Dazwischen finden sich Scholien, die die Verschiebung von der actio legis Aquiliae mit Litiskreszens zu einer selbständigen actio in duplum zeigen. In this paper two citations from the same paragraph of Ulpian's XVIII book on edict are discussed, one of which is preserved in Justinian's Digest and another in Collatio legum Mosaicarum et ...Romanarum. Texts differ in a part containing legal solution of the case, and it is obvious that at least one of two texts was edited. Author tries to determine which of them is interpolated.
