The response of the authorities confirmed that the democratic rights guaranteed by the Constitution are indeed threatened.
This book bridges the study of European constitutionalism with the study of 'fiscal federalism' – the subfield of public economics concerned with structuring public finances between different levels ...of government in federal states. On one axis, this book delves into European Union and Member State constitutional law from all EU Member States in order to investigate and identify the existence of permanent constitutional boundaries that will impinge upon the selection of proposed models for EU fiscal federalism. On the second axis, this book engages the study of fiscal federalism in order to determine which institutional configurations known to that field remain legally and economically implementable within those boundaries. It provides a far-reaching investigation of which models of fiscal federalism are compatible with the constitutional boundaries of the European legal order.
U tekstu se prikazuju neke nove paradigme koje najizravnije ukazuju na organsku i vitalnu vezu ustavnog i upravnog prava unutar kompleksa javnog prava. Stajalište autora je da primjeri ''vladavine'' ...(governance), ''administrativnog konstitucionalizma'' (administrative constitutionalism), zatim ''libertarijanskog administrativnog prava'' (libertarian administrative law)... demonstriraju dinamični proces artikulacije suvremenog javnog prava i njegove adaptacije političkom procesu suvremene države i njenim transgraničnim asocijacijama. Iako su navedene i druge paradigme još daleko od konačnih odgovora, evidentna je i neporeciva praksa da upravo one pokazuju permanentno nastojanje ustavnodemokratske države ka usavršavanju. U tom smislu navedene paradigme uvijek upućuju na postojanje cjelovitog državnopravnog procesa detekcije i rješavanja određenih pitanja. Zato ustavno-zakonodavna obrada temeljnih ustavnopolitičkih pitanja i problema, njihovo administrativno procesuiranje te sudbena detekcija i rješavanje stalno ukazuju na potrebu za unutrašnjim integritetom i koherencijom javnopravnog kompleksa države i prava.
This text demonstrates some new paradigms which most directly point out the organic and vital connection of constitutional and administrative law in public law. It is the author's viewpoint that the examples of '' governance ‘‘, '' administrative constitutionalism '', and ‘‘ libertarian administrative law '' demonstrate the dynamic process of adaptation and articulation of contemporary public law to the political process of the modern state and its transborder associations. Even though the stated and other paradigms are still far from final answers, it is evident and undeniable practice that precisely they show the permanent efforts of a constitutionally democratic state towards perfection. In this sense, paradigms always point to the existence of a holistic legal process of detection and resolution of certain issues. This is why constitutional-legislative analysis of fundamental constitutional political issues and problems, their administrative processing and judicial detection and resolution constantly demonstrate the need for internal integrity and coherence of the public legal complexity of state and law.
Sportski sektor je samo jedno u nizu područja teško pogođenih pandemijom Covid-19 i mjerama koje su državne vlasti širom svijeta poduzele protiv širenja smrtonosnog virusa. Odgode i otkazivanja ...većine sportskih natjecanja, počevši od Olimpijskih igara u Tokiju 2020. preko niza drugih događaja međunarodnog, nacionalnog i lokalnog značaja, još su jednom ukazale na nezamjenjivu ulogu i značaj koordinirane akcije politike i prava na svim razinama. Ova nam je situacija ponovno otkrila važnost ustava izvanrednog stanja (emergency constitution) u javnom pravu, ali i drugih pravnih klauzula (force majeure) s kojima će se konfrontirati sportske federacije, organizatori natjecanja, klubovi i sami sudionici u nastojanju razrješenja ozbiljnih ekonomskih i financijskih izazova te posljedica glede pravnih obveza koje su nastale ugovorima na području sponzorstva, prodaje i prijenosa sportskih događaja, itd. U ovom tekstu autor ukazuje na postojanje ustava izvanrednog stanja, njegove oblike i primjere u komparativnom ustavnom pravu, kao i na karakter događaja koji su tijekom 2020. godine pratili nastanak i djelovanje institucija u pokušaju zaštite društva. Pritom je jedno od temeljnih pitanja i je li Republika Hrvatska koristeći de iure ili de facto izvanredno stanje pomogla ili odmogla sportu.
The sports sector is just one in a series of areas hard hit by the Covid-19 pandemic and measures taken by state authorities around the world against the spread of the deadly virus. The delays and cancellations of most sports competitions, starting with the Tokyo 2020 Olympics through a series of other events of international, national and
local significance, have once again highlighted the irreplaceable role and importance of coordinated policy and law action at all levels. This situation has revealed to us again the importance of the emergency constitution in public law, but also other legal clauses (force majeure)
that will be confronted by sports federations, competition organizers, clubs and the participants themselves in an effort to address serious economic and financial challenges. and the consequences regarding legal obligations arising from contracts in the field of sponsorship, sale and
transmission of sporting events, etc. In this text the author points to
the existence of the emergency state constitution, its forms and examples in comparative constitutional law, as well as the nature of events monitored the emergence and operation of institutions in an attempt to protect society. One of the fundamental questions is whether the Republic of Croatia, using a de jure or de facto state of emergency,
helped or hindered sports.

This book addresses the question of social constitutionalism, especially with regard to its role in the contemporary European project. For reasons of history and democracy, Europeans share a deep ...commitment to social constitutionalism. But at the same time, Europeans are concerned about an overconstitutionalization and the balancing-away of less-favoured rights, leading to the entrenchment of the status quo and stifling of the living constitutionalism and democracy. The book challenges the common view that constitutionalization means de-politicization. Without claiming for themselves the final word, courts can exert a more indirect—forum-creative and agenda-setting—role in the process of an ongoing clarification of the meaning of a right. In exerting this role, courts rely less on a pre-existing consensus, but a potential consensus is sufficient: courts can induce debate and deliberation that leads to consensus in a non-hierarchical dialogue in which the conflicting parties, state actors, civil society organizations, and the diverse stakeholders themselves develop flexible substantive standards that interpret constitutional requirements, often over repeat litigation. The CJEU and the ECtHR—as courts beyond the nation state—in their constitutionalizing jurisprudence are able to constructively re-open and re-politicize controversies that are blocked at the national level, or which cannot be resolved at the domestic level. But, crucially, the understanding of constitutional framework-principles is itself subject to revision and reconsideration as the experience of dealing with the diverse national contexts of discovery and application accumulates. This democratic-experimentalist process lies at the heart of the distinctive model of contemporary Euroconstitutionalism.
Svrha je ovog rada prikazati osnove sustava slovenskog prekršajnogprava i utjecaj odluka Ustavnog suda Republike Slovenije na razvoj togprava. Postoji značajna povezanost između prekršajnog prava i ...nizaustavnih prava i normi u slovenskom sustavu. Ustavni je sud u posljednja dva desetljeća od donošenja novog Zakona o prekršajima iz 2003.više puta značajno utjecao na tumačenje i razvoj slovenskog prekršajnog prava te je prouzročio niz novih pravnih tumačenja i zakonodavnihpromjena. Posljedično se prekršajno pravo u slovenskom sustavu pojavljuje kao izrazita ustavnopravna kategorija. Za ilustraciju navedenog, poslije produbljenog prikaza osnova slovenskog prekršajnog prava, uz isticanje otvorenih pravnih pitanja, što je bitno za razumijevanjeslovenskog sustava i njegove dinamike, sukladno svrsi ovog rada kaojednoga u nizu članaka različitih autora o razvoju prekršajnog pravana zapadnom Balkanu, bit će detaljnije prikazane odabrane mjerodavne odluke slovenskog Ustavnog suda na području prekršaja u vezi stemeljnim pitanjima svakog poštenog postupka kaznene prirode, npr.u vezi s privilegijem protiv samooptuživanja, zadiranjem u osobnu slobodu (određivanjem zatvora u prekršajnom pravu), pravom na pravnilijek itd. Autor prvi put daje sustavni prikaz cjelokupne ustavne prakseRepublike Slovenije u području prekršajnog prava. U zaključnom dijelubit će analizirana i posebna autorova teorija o ulozi Ustavnog suda uSloveniji – teorija klatna, prikazana na slučaju prekršajnog prava iodluka Ustavnog suda u vezi s njim.
The purpose of this paper is to show the close connection between the system on minor offences and constitutional laws and norms in the Slovenian system. In the last two decades, since the adoption of the current Minor Offences Act from 2003, the Slovenian Constitutional Court has several times significantly influenced the interpretation and development of Slovenian law on minor offences and initiated several legislative changes. As a result, the law on minor offences in the Slovenian system appears as a distinct category of constitutional law. After the presentation of the legal basis of Slovenian law on minor offences, several authoritative decisions of the Slovenian Constitutional Court in the area of minor offences are examined, for example in connection with the privilege against self-incrimination, limitations of personal freedom (prison sentences in the law on minor offences), the right to legal remedy, etc. The paper provides for the first time a systematic overview of the constitutional practice of the Slovenian Constitutional Court on minor offences. In the final part, a special theory on the role of the Constitutional Court in Slovenia is briefly analysed - the pendulum theory, illustrated in the case of the law on minor offences.
