...the European Commission published the decision on 7 December 2017 to take Slovenia to the EU Court of Justice over the failure to notify a complete transposition of EU rules on public procurement ...and concessions into national law.2 However, the other two Directives, also adopted within the same EU public procurement legislative package, ie Directive 2014/24/EU on public procurement3 and Directive 2014/25/EU on procurement by entities operating in the water, energy, transport and postal services sectors,4 were transposed on time, and the quality of transposition is generally reasonable.5 The CCCA was drafted by the Ministry of Finance, while the Slovenian Public Procurement Act (Zakon o javnem naročanju – ZJN-3), transposing the other two 2014 public procurement Directives, was drafted by the Ministry of Public Administration. ...it was decided to transpose the provisions of the Directive into the national legal system comprehensively by adopting a new law called (notably) Certain Concession Contracts Act (emphasized by the authors), which lays down rules on the procedures for the award of works concessions and service concessions only above the threshold set by the Directive. ...the provisions from the Companies Act are applied subsidiary; A concession is the only possible form providing services of general economic interest, performed by a private law entity. In recent years, on a municipal level also works concessions have been gathering momentum in other fields, not only for the provision of SGEI and NESGI (eg DFBOT-models for kindergartens or sewage treatment plants). Besides the laws outlined above, regulating the concessions prior the adoption of CCCA, also some other sector-specific laws regulate the concessions, eg Pharmacy Practice Act (Zakon o lekarniški dejavnosti),15 or Health Services Act (Zakon o zdravstveni dejavnosti).16 To reiterate, none of those already existing acts were harmonised with CCCA transposing Directive 2014/23/EU, which now represent a significant legal uncertainty, because of overlapping provisions.
In the area of the award of concession contracts there was a legal vacuum which European Courts tried to solve by clarifying some aspects related to the award of concession contracts in twenty-six ...pertinent judgements in that area they delivered since year 2000. Nevertheless, the situation in the area of the award of concession contracts was far from satisfactory. That alerted competent institutions of the European Union to the fact that problems connected with the award of concession contracts can not be adequately addressed on a case-by-case basis and that adoption of pertinent EU rules was necessary. Consequently, at the beginning of the year 2014 the Directive of the European Parliament and of the Council on the award of concession contracts was adopted (hereinafter: Concessions Directive). In this paper we are analysing the main elements of that Directive, such as the precise definition of concession, compulsory publication of concession notices in the Official Journal of the EU in prescribed cases, establishment of certain obligations with respect to the selection and award criteria to be followed by entities awarding concessions, regulation of modifications of concessions during their term, etc. In the paper a critical analysis of the application of the Concessions Directive in the shipping sector is also made, especially in the field of award of contracts for the provision of maritime cabotage services and contracts on providing port services, which are qualified as service concessions and, in that sense, are subject to the application of the Concessions Directive.

ES En 2014 la Unión Europea aprobó una serie de Directivas, concretamente las Directivas 2014/23/UE, 2014/24/UE, y 2014/25/UE, concernientes a la a la adjudicación de contratos de concesión, la ...contratación pública y la contratación por entidades que operan en los sectores del agua, la energía, los transportes y los servicios postales. La necesaria transposición de estas Directivas al Ordenamiento español generó la aprobación de la Ley 9/2017, de 8 de noviembre, de Contratos del Sector Público, por la que se transponen al ordenamiento jurídico español las Directivas del Parlamento Europeo y del Consejo 2014/23/UE y 2014/24/UE, de 26 de febrero de 2014. Es el análisis de las normas establecidas en dicha Ley, el objeto de estudio de este trabajo, y más concretamente, las disposiciones relativas a los llamados contratos menores, en lo referente a la celebración de contratos de suministro y de servicio, con valor estimado inferior a los 15.000€ . Para ello se realizará un breve análisis de las diferentes normativas destinadas a regular la contratación pública antes y después de la adhesión de España a la Comunidad Económica Europea, junto con el estudio de los elementos más destacados de la nueva ley, para profundizar posteriormente en los cambios que la misma ha provocado en los contratos menores enunciados anteriormente.

To do so, a brief analysis of the different regulatory rules for contracting the drafting of the new law is opened, to deepen more deeply into the changes that it has caused in the smaller contracts previously.
