  • Zakonodajni referendum s suspenzivnim učinkom - de lege ferenda

    Imperfect and also unsuitable normative regulation of legislative (particularly preliminary) referendum in Slovenia is causing considerable problems in its use. The practice has shown that it makes ... adoption of laws essentially more difficult and complicates the entire legislative procedure. This regulation also does not offer suitable solutions to numerous practical entanglements, but it also enables procedural double crossing and even abuse. Beside this, legal guarantees for realisation of decisions of the voters in legislative procedure are rather questionable. Therefore the Constitutional court has had to intervene several times. It has abrogated quite some provisions of the law on referendum and people's initiative. The proposal of the new law on referendum and people's initiative therefore provides introduction of legislative referendum with a suspensive effect. In this referendum voters would vote about a law already adopted by the National Assembly, but before its promulgation and enforcement. This form of referendumhas been enforced and proven in most of the Western European Countries, which know legislative referendum on national level.
