Vloga sodišč pri kršitvi pravice do sojenja v razumnem roku : diplomska naloga

The Author presents the regulation of the right to be tried within a reasonable time as guaranteed by the European Convention on Human Rights and the Constitution of the Republic of Slovenia in ...Europe and in Slovenia. The main stress is on the role of courts which either set standards for determination of the reasonable time or when executing regular jurisdiction have to guarantee this right in individual proceedings. European Convention and the existing case-law of the European Court for Human Rights (EuCHR) represent main guidelines for the European countries. This is represented in first part of the thesis. EuCHR has in recent time decisively expressed its opinion, that countries must not only secure this right but also make legal remedies available so that the enforcement of the right to a hearing within a reasonable time could reach its effect. The importance of this right has also been stressed out by the Court of the European Communities in Luxemburg. The first part deals also with the views of the Constitutional Court of the Republic of Slovenia. The second part focuses on exercise of the right to a hearing within a reasonable time in the light of current situation concerning court delays and legal remedies available within the Slovenian legal system. It is questionable whether any remedy at all meets the standards set by the EuCHR. The latter has in the past already been denied by the EuCHR. The author concludes with the summary of the topic and, taking into consideration the increasing number of complaints to the EuCHR against Slovenia, points out the necessity of a better regulation concerning legal remedies. In this very place the author gives substantial weight to a more determined role of the Constitutional Court, offering possible solutions for the regulation of the topic as well.
