Resumo: O texto analisa as Leis Orgânicas Municipais (LOMs) sob a chave das teorias sobre o constitucionalismo na Ciência Política. Sugerimos um desenho de pesquisa que integra a análise da política municipal com a Ciência Política e que foca no âmbito nacional. Mobilizamos as teorias sobre as constituições nacionais que explicam características como a extensão, a divisão temática e o emendamento das LOMs. Elaboramos um banco de dados com características quantitativas dos textos e emendas das LOMs desde 1988. A amostra de conveniência inclui 743 municípios. Completamos os dados sobre as LOMs com informações sobre o tamanho populacional dos municípios, as eleições locais e os orçamentos municiais. O resultado do trabalho confirma a validade externa das hipóteses sobre a importância da divisão temática e das características demográficas das comunidades sobre a extensão dos textos e a frequência do seu emendamento. Já a hipótese sobre as constituições como seguro contra maiorias políticas instáveis não foi confirmada. Ainda, exploramos novos fatores como o volume orçamentário e a dependência financeira dos municípios, cujo impacto sobre as constituições e emendas se revela como pontual. O trabalho aponta novos caminhos para a pesquisa, explorando a validade externa das teorias sobre o constitucionalismo a partir de dados do âmbito estadual e local e sugerindo uma nova agenda de pesquisas para melhorar o entendimento das características aninhadas das LOMs dentro do sistema federativo. Abstract: The text analyzes the Municipal Organic Laws (LOMs) under the key of theories on constitutionalism in political science. We suggest a research design that integrates the analysis of municipal politics with political science that focuses on the national level. We mobilize theories about national constitutions that explain characteristics such as the extension, thematic division, and the amendment of LOMs. We created a database with quantitative characteristics of the texts and amendments of the LOMs since 1988. This convenience sample includes 743 municipalities. We complete the data on LOMs with information on the population size of municipalities, local elections, and municipal budgets. As a result of the work, we confirmed the external validity of the hypotheses about the importance of the thematic division and the demographic characteristics of the communities on the length of texts and the frequency of their amendment. Another hypothesis, regarding constitutions as insurance against unstable political majorities, has not been confirmed. We also explore new factors, such as the budget volume and the financial dependence of municipalities, whose impact on constitutions and amendments is revealed to be specific. The work points to new paths for research, exploring the external validity of theories about constitutionalism based on state and local data and suggesting a new research agenda to improve the understanding of the nested characteristics of LOMs within the federal system.
