U tekstu se rastvara pojam „dekonstrukcije“ administrativne države u SAD-u kao njen reprezentativni primjer. Polazeći od dominacije moderne administrativne države, puna slika suvremenog ...konstitucionalizma u SAD-u mora uključivati administrativni konstitucionalizam kao svekoliko razumijevanje i interpretaciju suvremene administrativne države i njene strukture od strane agencija i drugih aktivnih aktera upravnoga prava. Administrativni konstitucionalizam danas je jedan od najintenzivnije izučavanih predmeta istraživanja komparativnog ustavnog i upravnog prava. Razlog egzegeze ovoga pitanja nisu samo njegove različite dimenzije već i činjenica da on predstavlja glavni mehanizam kojim se danas elaborira i implementira ustavno značenje.
This paper opens up the concept of „deconstruction “of administrative states in the USA as its representative example. Starting from the domination of a modern administrative state, the full picture of modern constitutionalism in the USA must include administrative constitutionalism as overall understanding and interpretation of a modern administrative state and its structure by agencies and other active participants in administrative law. Administrative constitutionalism is today one of the most intensively studied subjects of investigation of comparative constitutional and administrative law. The reason for exegesis of this issue is not only its various dimensions but also the fact that it represents the main mechanism which today elaborates and implements constitutional meaning.
The purpose of this study was to examine the kinematic and kinetic differences of the sprint start and first two steps between faster and slower high-level sprinters. Twelve male sprinters were ...dichotomized according to personal best 60- and 100-m times. Each participant performed five starts under constant conditions. An eight-camera system was used for 3-D kinematic analysis. Dynamic forces at the start were determined with starting blocks mounted on bipedal force plates. Measures of front and rear block total force, front and rear block maximal force, time to front and rear block peak force, total force impulse, total horizontal and vertical impulse, front and rear block force impulse, time of block clearance, block leaving velocity and block leaving acceleration were collected. Between-group comparisons were made using independent samples t tests (p < 0.05) and by calculating effect sizes (Cohen’s d). Spearman’s correlation coefficients were used to examine the relationships between sprint start kinematics, kinetic measures and sprint performance. Significant between-group differences were observed in rear block total force (p = 0.0059), rear block maximal vertical force (p = 0.0037) and total force impulse (p = 0.0493). Only front block total force significantly correlated with 100 m sprint performance in both the slower and faster groups (r = 0.94 and 0.54, respectively; p = 0.05). Our findings suggest that faster sprinters show enhanced sprint start motor performance with greater force development than slower sprinters.
U tekstu se prikazuju neke nove paradigme koje najizravnije ukazuju na organsku i vitalnu vezu ustavnog i upravnog prava unutar kompleksa javnog prava. Stajalište autora je da primjeri ''vladavine'' ...(governance), ''administrativnog konstitucionalizma'' (administrative constitutionalism), zatim ''libertarijanskog administrativnog prava'' (libertarian administrative law)... demonstriraju dinamični proces artikulacije suvremenog javnog prava i njegove adaptacije političkom procesu suvremene države i njenim transgraničnim asocijacijama. Iako su navedene i druge paradigme još daleko od konačnih odgovora, evidentna je i neporeciva praksa da upravo one pokazuju permanentno nastojanje ustavnodemokratske države ka usavršavanju. U tom smislu navedene paradigme uvijek upućuju na postojanje cjelovitog državnopravnog procesa detekcije i rješavanja određenih pitanja. Zato ustavno-zakonodavna obrada temeljnih ustavnopolitičkih pitanja i problema, njihovo administrativno procesuiranje te sudbena detekcija i rješavanje stalno ukazuju na potrebu za unutrašnjim integritetom i koherencijom javnopravnog kompleksa države i prava.
This text demonstrates some new paradigms which most directly point out the organic and vital connection of constitutional and administrative law in public law. It is the author's viewpoint that the examples of '' governance ‘‘, '' administrative constitutionalism '', and ‘‘ libertarian administrative law '' demonstrate the dynamic process of adaptation and articulation of contemporary public law to the political process of the modern state and its transborder associations. Even though the stated and other paradigms are still far from final answers, it is evident and undeniable practice that precisely they show the permanent efforts of a constitutionally democratic state towards perfection. In this sense, paradigms always point to the existence of a holistic legal process of detection and resolution of certain issues. This is why constitutional-legislative analysis of fundamental constitutional political issues and problems, their administrative processing and judicial detection and resolution constantly demonstrate the need for internal integrity and coherence of the public legal complexity of state and law.
Politika ograničena pravom odnosno podređivanje svake javne aktivnosti sudbenim i drugim kontrolama temeljno je obilježje i zahtjev konstitucionalizma i vladavine prava. Upravo je u skladu s načelom ...vladavine prava i legitimnim ustavnodemokratskim zahtjevima za njegovom supremacijom da država, i to ponajviše njena izvršna vlast i druge institucije sistema vladavine budu podređeni pravu i različitim kontrolama. U tekstu autori analiziraju komparativno iskustvo administrativne države koja je u gotovo stoljetnom razdoblju svog trajanja na različite načine iskušavala demokratska sredstva kontrole.
Politics limited by law that subjects every public activity to court or other controls is the basic characteristic and demand of constitutionalism and the rule of law. It is in keeping with the rule of law principle and legitimate constitutional and democratic demands for its supremacy. The state, mostly its executive and other institutions of the system of rule should be subject to the law and various controls. In this text the authors analyse the comparative experience of an administrative state which in almost 100 years of its existence in various ways has put democratic means of control to the test.
U radu autor ukazuje na relevantne odredbe i značaj Magne Carte kao preteče modernih deklaracija o pravima, te se kratko osvrće na suvremena shvaćanja i uvriježene klasifikacije ljudskih prava, ...sustave njihove zaštite, a detaljnije na usporedive odredbe Korčulanskog statuta koje, prema njegovom mišljenju, nesumnjivo predstavljaju nagovještaj modernih garancija prava i sloboda. Pritom u Korčulanskom statutu pronalazi i neke odredbe, poput, primjerice, ograničavanja trgovanja robljem, koje Magna Carta ne poznaje. Autor polazi od toga da pri povlačenju paralela između srednjovjekovnih i modernih dokumenata i procjeni značenja pojedinih odredaba i instituta nužno treba biti oprezan, a pitanje zaštite ljudskih prava predstavlja posebno sklisko područje. No, zaključak je autora da je i za Korčulanski statut i za Magnu Cartu nužno istaknuti i to da njihova važnost nije samo u onome što je u njima zapisano i što su predstavljali svojim piscima i njihovim suvremenicima; štoviše, još je važnije njihovo nasljeđe u vidu značenja koje su njihovu sadržaju pripisale kasnije generacije. Mitovi su, naime, ponekad zaista važniji od stvarnosti.
The paper points out the relevant provisions and the importance of the Magna Carta as a forerunner of modern declarations of rights, and briefly looks at modern understandings and established classifications of human rights, their protection systems, and looks in more details at comparable provisions of the Statute of the Town and Island of Korčula as undoubtedly representative examples of modern guarantees of rights and freedoms. At the same time, author find some provisions in the Korčula Statute, such as, for example, the restriction of the slave trade, which Magna Carta does not know. The author starts from the fact that, when drawing parallels between medieval and modern documents and assessing the meaning of certain provisions and institutes, one should necessarily be careful, because the issue of human rights protection is a particularly slippery area. However, the author's conclusion is that for both the Korčula Statute and the Magna Carta it is worth pointing out that their importance is not only in what is written in them and what they presented to their writers and their contemporaries; moreover, even more important is their heritage in terms of the meanings ascribed to their content by later generations. Namely, myths are sometimes indeed more important than reality.
Sportski sektor je samo jedno u nizu područja teško pogođenih pandemijom Covid-19 i mjerama koje su državne vlasti širom svijeta poduzele protiv širenja smrtonosnog virusa. Odgode i otkazivanja ...većine sportskih natjecanja, počevši od Olimpijskih igara u Tokiju 2020. preko niza drugih događaja međunarodnog, nacionalnog i lokalnog značaja, još su jednom ukazale na nezamjenjivu ulogu i značaj koordinirane akcije politike i prava na svim razinama. Ova nam je situacija ponovno otkrila važnost ustava izvanrednog stanja (emergency constitution) u javnom pravu, ali i drugih pravnih klauzula (force majeure) s kojima će se konfrontirati sportske federacije, organizatori natjecanja, klubovi i sami sudionici u nastojanju razrješenja ozbiljnih ekonomskih i financijskih izazova te posljedica glede pravnih obveza koje su nastale ugovorima na području sponzorstva, prodaje i prijenosa sportskih događaja, itd. U ovom tekstu autor ukazuje na postojanje ustava izvanrednog stanja, njegove oblike i primjere u komparativnom ustavnom pravu, kao i na karakter događaja koji su tijekom 2020. godine pratili nastanak i djelovanje institucija u pokušaju zaštite društva. Pritom je jedno od temeljnih pitanja i je li Republika Hrvatska koristeći de iure ili de facto izvanredno stanje pomogla ili odmogla sportu.
The sports sector is just one in a series of areas hard hit by the Covid-19 pandemic and measures taken by state authorities around the world against the spread of the deadly virus. The delays and cancellations of most sports competitions, starting with the Tokyo 2020 Olympics through a series of other events of international, national and
local significance, have once again highlighted the irreplaceable role and importance of coordinated policy and law action at all levels. This situation has revealed to us again the importance of the emergency constitution in public law, but also other legal clauses (force majeure)
that will be confronted by sports federations, competition organizers, clubs and the participants themselves in an effort to address serious economic and financial challenges. and the consequences regarding legal obligations arising from contracts in the field of sponsorship, sale and
transmission of sporting events, etc. In this text the author points to
the existence of the emergency state constitution, its forms and examples in comparative constitutional law, as well as the nature of events monitored the emergence and operation of institutions in an attempt to protect society. One of the fundamental questions is whether the Republic of Croatia, using a de jure or de facto state of emergency,
helped or hindered sports.
The text emphasizes the need to study the historical Roman constitution, as an integral part of the comprehensive analysis of the sources of the ideological apparatus of the contemporary ...constitutional democratic state. The authors remind us of the methodological instruction from T. Mommsen’s Staatsrecht that the said studies are not only a unique direction towards understanding SPQR constitutionalism and its legate, but also constitute an approach that enables conclusions regarding results that are not temporally and substantively limited, nor are they – “so much as narrowly legalistic as it is often thought”. Thanks to the choice of an open and broad approach of modern constitutional legal analysis, which is guided by the thought: the constitution is culture (P. Haberle), the continuity and vitality of new knowledge about the old topics of government and freedom, property and owner, wealth and poverty, class and classless society is strengthened as unchanging constants of the constitutional system of the contemporary state and society.
Pred Arbitražnim sudom Hrvatskog nogometnog saveza već se više od dvadeset godina vode brojni arbitražni postupci između igrača i trenera te nogometnih klubova. Pritom su zasigurno jedni od ...najvažnijih i najznačajnijih postupaka oni koji se vode radi otkazivanja ili raskida ugovora, budući da u tim postupcima u slučaju uspjeha u sporu igrač dobiva status tzv. slobodnog igrača te može nesmetano promijeniti klub bez bilo kakvog plaćanja svojem prijašnjem klubu. Za razumijevanje ove problematike važni su poznavanje prakse Arbitražnog suda HNS-a u postupcima otkazivanja ugovora o radu (ugovora o profesionalnom igranju), kao i povezana praksa Sportskog arbitražnog suda u Laussani, te odluke Suda pravde Europske unije. U ovom radu autori će analizirati relevantnu praksu navedenih sudbenih tijela, s naglaskom na komentar u odnosu na najznačajnije dosadašnje odluke Arbitražnog suda HNS-a u postupcima radi otkazivanja ugovora o radu, ugovora o profesionalnom igranju/treniranju ili ugovora o stipendijskom igranju, a sve to u sportsko-radnim sporovima između klubova i igrača.
Numerous arbitration proceedings between players, coaches and football clubs have been conducted before the Court of Arbitration of the Croatian Football Association (HNS) for more than twenty years. At the same time, certainly the most important procedures are exactly those conducted for the purpose of canceling or terminating contracts, since in these procedures, in case of success in the dispute, the player gets the status of the so-called ‘ free player’ and can freely change clubs without any payment to his/her former club. In order to understand this issue, it is important to know the practice of the HNS Arbitration Court in disputes regarding canceling of employment contracts (professional playing contracts), as well as the related practice of the Court of Arbitration for Sport in Lausanne and relevant decisions of the Court of Justice of the European Union. In this paper, the authors analyze relevant case law of the aforementioned bodies, with an emphasis on the commentary in relation to the most significant decisions of the HNS Arbitration Court in procedures for cancellation of employment contracts, professional playing/coaching contracts or scholarship playing contracts, all of which in sports and labor disputes between clubs and players.
U tekstu se ističe značaj izučavanja povijesnog rimskog ustava, kao sastavnog dijela cjelovite analize izvora ideološkog aparata suvremene ustavnodemokratske države. Autori podsjećaju na metodološki ...naputak iz T Mommsenovog Staatsrechta (1875., 2011.) prema kojem navedene studije nisu samo jedinstveni smjer prema razumijevanju SPQR konstitucionalizma i njegova legata, već i pristup koji omogućuje zaključak o rezultatima koji nisu temporalno i sadržajno ograničeni, niti su "toliko usko legalistični kako se najčešće misli". Zahvaljujući izboru otvorenog i širokog pristupa moderne ustavnopravne analize kojoj je misao vodilja: ustav je kultura (P Haberle), jača se kontinuitet i vitalnost novih spoznaja o starim temama - vlasti i slobodi, vlasništvu i vlasniku, bogatstvu i siromaštvu, klasnom i besklasnom društvu, kao i o drugim nepromjenjivim konstantama života ustavnog sustava suvremene države i društva.
U ovom tekstu izložit će se pitanje jednog novog oblika konstitucionalizma: zelenog ili ekološkog konstitucionalizma, koji je postao svojevrsno „pitanje dana“ suvremene ustavne politike, kao i ...osnovne konture njegove problematike s kojom se susreće moderni ustavotvorac i ona demokratska politika koji su voljni realizirati mjere „ekološki protektivne politike“. Posebna pozornost će se, dakle, pokloniti izvorima, oblicima i svrsi afirmacije recentnog zelenog konstitucionalizma. Temeljno je polazište da konstitucionalizaciju zaštite okoliša ne treba promatrati kao panaceu koju bi trebalo izbjegavati ili uklanjati iz amplituda ordinarnog političkog odlučivanja. Naprotiv, inzistiranjem na njegovoj konstruktivnoj ulozi moguće je zagovarati i ostvarivati demokratsku političku kontrolu nad „raspojasanim“ snagama tržišta koje preko okoliša i drugih pitanja koja se tiču javnog dobra već dugo žele do kraja ostvariti politiku deregulacije i korporativne vladavine.
This text presents the issue of a new form of constitutionalism: green or ecological constitutionalism, which has become its own kind of „today's issue “of contemporary constitutional politics. This also includes the basic contour of this problem area with which the modern constitution maker is faced Also introduced will be democratic politics with which they are willing to achieve measures of „ecological protective policy“. Particular attention will be given to the sources, forms and aims of affirming recent green constitutionalism. The fundamental starting point is that constitutionalising environmental protection should not be viewed as a panacea which should be avoided or removed from the amplitudes of ordinary political decision making. On the contrary, by insisting on its constructive role, one could also discuss and achieve democratic political control over „licentious“ market forces which through environmental and other issues regarding the public good, for a long time have wanted to completely achieve deregulation and corporative rule policy.
