This study builds on the hierarchy of influences model and the concept of the chilling effect to investigate how strategic lawsuits against public participation (SLAPPs) affect journalism, directly ...and indirectly. Based on the semi-structured interviews with Slovenian journalists and editors targeted by SLAPPs, and with their newsroom colleagues, it reveals inconsistencies between the respondents’ expressed awareness of the impact of SLAPPs on their work and their perception of the broader impacts. By examining how SLAPPs interact with the various professional and personal circumstances of journalists and editors, and with the political, economic and regulatory context, toward a potentially deterring outcome, the article contributes evidence on factors that strengthen or mitigate the possible chilling effect of SLAPPs, for both targeted and non-targeted journalists and editors. The research findings add to the empirical knowledge of the emerging body of research on SLAPPs in anticipation of European and national anti-SLAPP regulation.
Z digitalizacijo komunikacijskega okolja je prišlo do regulativnega neravnovesja, v katerem so na eni strani regulirani in finančno podhranjeni mediji, na drugi pa neregulirane in ...eko-nomskomočnedigitalneplatforme. Pri temdržavljani vse več informacij in medijskih ali medijskim podobnih vsebin sprejemajo prek platform. Cilj študije je raziskati odzive teles medijske samoregulacije na vprašanja na področju novinarske etike in profesionalnosti, povezana z digitalizacijo, ter pripravljenost teles medijske samoregulacije in zakonsko podprtih medijskih regulatorjev za sodelovanje pri urejanju digitalnega komunikacijskega okolja. Analiza etičnih kodeksov ter intervjuji s predstavniki medijskih samoregulativnih teles in medijskih regulatorjev iz štirih držav, nastalih na območju nekdanje Jugoslavije, so razkrili podobnosti pri prilagajanju medijske samoregulacije vprašanjem digitalnega komunikacijskega okolja, a niso nakazali strinjanja glede možnosti poseganja države vanj ter glede krepitve sodelovanja medijskih samoregulatorjev in regulatorjev pri njegovem urejanju.
This paper analyses policies and regulation addressing net neutrality in Slovenia. It traces them from their bold beginnings in 2012 to their harmonisation with prevailing trends and practices in the ...European Union, following the enactment of EU rules on net neutrality in 2016. The study, based on qualitative document analysis and supplemented by interviews with stakeholders, showed that Slovenia was not successful in advocating stronger EU net neutrality safeguards. The rules of the single digital market within the EU with the limited subsidiarity of member states made it impossible to apply the original Slovenian legal safeguards. This indicates a reduced potential of nation states to advocate their communication policy objectives within the EU framework on one hand, and their ability to influence EU policymaking by encouraging a quicker common response with independent action on the other. Further research is required into the potential re-evaluation and extension of the concept of net neutrality, to address the full extent of discriminatory treatment of internet traffic, not limited solely to networks.
Digitalno vladovanje, ki se razvija v državah članicah EU kot odgovor na izzive avtomatiziranega in algoritmiziranega komuniciranja ob ujetosti državne in evropske medijske regulacije v analogne ...koncepte in rešitve, je zaradi kompleksnosti redko predmet celostne obravnave. Predlagan metodološki pristop, utemeljen na konceptu vladovanja in splošni teoriji sistemov, ki povezuje družbene, ekonomske in tehnične koncepte, ter obseg primerjalne raziskave, ki vključuje 24 držav članic EU, omogočata celovit vpogled v stanje vladovanja v EU. Rezultati raziskave so predstavljeni v kontekstu procesov transformacije regulacije in vladovanja ter širših medijskih in družbenih sprememb, pri katerih se zdi, da je regulacija vedno nekaj korakov za tehnološkimi podjetji, zdaj že pomembnimi globalnimi političnimi akterji, kot v igri mačke in miši, v kateri bi morale države pokazati več spretnosti, odločnosti in sodelovanja, korporacije pa več družbene odgovornosti.
The development in the Slovenian media market suggests that media legislation that is dominated by a free market ideology does not prevent the concentration of media capital. The process of media ...privatisation takes different courses in print media and in broadcasting. The main problems relate to (1) the non-transparency of privatisation processes, (2) media as family business, (3) cross-media ownership, (4) the impairment of public capital, (5) hostile take-overs. The authors analyse five forms of media ownership concentration in Slovenia: (1) chains - the same company owns more than the "normal" number of media of the same kind in the state; (2) networks - a holding company produces programs and distributes them with the help of local stations that are members of its network, but have their own legal independence; (3) cross-media ownership - media companies include different kinds of media in their portfolio; (4) conglomerates - corporations whose main activity pertains to a different branch of the economy acquire a media company; (5) vertical integration - mergers in programming production, distribution, publishing activities, etc. Experiences with the "deregulation" demonstrate that just an increase of the number of available channels or the expansion of new print media does not automatically increase the diversity of contents and sources.
