  • Article 35 : prohibition of quantitative restrictions on exports : (ex-Article 29 TEC)
    Hojnik, Janja
To assure proper functioning of the internal market not only imports to the other MS needs to be undisturbed, but also exports. Yet, the number of cases before the EU Court of Justice concerning ... national restrictions of exports is considerably lower in comparison to those concerning import restrictions. The reason for this lies in the fact that MS rarely apply export restrictions as this is normally against their public interest, considering that states usually enhance exports. Article 35 TFEU is therefore relevant mostly in relation to economically and politically sensitive goods (e.g. oil, arts, weapons and live animals).
