    Background. One of the governing principles in the health care sector is the principle of a doctor's sovereignty in directing the process of treatment and in takin such professional medical decisions ... which, in his professional opinion, lead in the fastest and most effective way to the patient's convalescence. In his direct, market relationship with the patient, the doctorshould enjoy unlimited professional freedom - clinical sovereignty. The doctor should implement, free of any economic constraints, the optimal professional medical doctrine. A doctor, providing health care services on theaccount of a public health insurance fund, should, opposite to the above, respect the agreed and feasible professional medical doctrine, remunerable from public funds. Conclusions. This contribution discusses certain limitations to the professional sovereignty and the division of the responsibility for a successful medical treatment of an individual patient, and for the citizens' health among the state, which determines the scope and contents of the public health insurance, the sponsor, who faciliates the health insurance scheme, and the doctor, who is responsible for the delivery of health care services in agreed extent and quality to all insured persons.
