Article 6 guarantees to everyone a hearing within a reasonable time. Domestic courts must ensure that all those who play a role in the proceedings do their utmost to avoid unnecessary delay. Members ...of the Council of Europe and the European Court for Human Rights itself have to deal with growth of the number of applications every year and therefore the delays are even longer. The Council of Europe adopted the Declaration "Guaranteeing the long-term effectiveness of The European Court of Human Rights" in May 2003 and in March 2004. The protocol Nr. 11 was consequently adopted. Their goal is to shorten the length of the proceedings before the ECHR. Some of the Member States have already adopted changes in their legal system to speed up the proceedings; for example Italy and Croatia, others will have to do the same in the near future. In Slovenia the concern for the decision taking without the unnecessary delay is generally regulated by the Article 23 of the Constitution. Special protection of this right is provided by the administrative dispute. The exhaustion of legal protection under the provisions of the Administrative Dispute represents the procedural assumption for the Constitutional complaint. That means that the constitutional complaintmay be submitted only after the conclusive and final judgment in administrative dispute. Around 700 applications are pending before the ECHR against Slovenia, more than 2/3 are based on alleged violation of the right to a hearing within reasonable time. One might wonder how many convictions does Slovenia need before the ECHR, to change the judicial system more effectively.
