This essay tests the argument that the decisions of the Judicial Committee of the Privy Council (JCPC) were consistent with the views of Canadians at the time. Thoroughly set out by Alan Cairns in a ...1971 article, the argument was supported by Richard Simeon and Ian Robinson 20 years later in their study for the Macdonald Royal Commission. To test the argument, the essay uses the two JCPC decisions that resulted in provincial control of labour policy, namely, Toronto Electric Commissioners v. Snider and the Labour Conventions reference. To determine the degree of popular support for these judgements, the essay surveys the views and reactions of key institutional actors. The evidence shows that support for federal control of labour policy was substantial. The author concludes that, in at least two instances, the provincialist bias of the law lords was at odds with the centralist vision of Canadians, and that support for a centralist vision did exist in early Canada.
