Focusing deliberately on the impact of law courts on substantive law – and not on its systematisation by learned jurists – it studies similarities and differences in the development of the law across different jurisdictions. In doing so it evaluates whether and to what extent it is possible to consider this development as a unitary and truly European phenomenon. This collection re-evaluates current debates surrounding the development of civil law in the early modern period in the context of the grand narratives of European legal history and sets out to challenge current orthodox views about early modern civil law.

En prenant en compte l’Ancien Régime tout en englobant le moment révolutionnaire, cet ouvrage collectif observe, à partir des terrains français et italiens, le phénomène du déclassement dans le cadre d’un ordre hiérarchique, rigide, pensé comme naturel donc immuable, mais qui n’était pas immobile, alternant des périodes de plus ou moins grande ouverture ou fermeture, mais aussi dans une phase de rupture, de transition et de redéfinition où la perte de statut et de fortune a pu s’accompagner d’opportunités de reclassement. Les études ici réunies ont été guidées par un questionnaire commun : montrer la difficulté d’appréhender des situations de déclassement où se mêlaient, selon des degrés variables, appauvrissement, déshonneur, déchéance morale ; restituer la parole – rare - des acteurs historiques sur leur expérience du déclassement ; montrer la difficulté de mesurer le déclassement à partir de marqueurs objectifs tant il s’agissait d’un phénomène relatif, parfois paradoxal, conditionné par un environnement social lui-même mouvant ; envisager le déclassement comme un processus en s’attachant à l’interprétation de trajectoires personnelles et collectives ; interroger, enfin, le rôle joué par l’État dans l’ordonnancement des frontières sociales.

Jewish economic activity was a key factor in the development of the Polish-Lithuanian Commonwealth, and it greatly enhanced the incomes, and thereby the social and political status, of the noble magnates, including the powerful Radziwiłł family. In turn, with the magnate's backing, Jews were able to leverage their own economic success into high status in estate society. Over time, relations within Jewish society began to change, putting less value on learning and pedigree and more on wealth and connections with the estate owners.
This groundbreaking book exemplifies how the study of Jewish economic history can shed light on a crucial mechanism of Jewish social integration. Mais la neutralité a ses contraintes. Celui qui la choisit doit d'abord avoir la capacité de défendre son territoire et de faire respecter son pavillon face aux belligérants sous peine d'être victime d'une guerre à laquelle il demeure étranger. Il lui faut ensuite ne favoriser aucune des parties qui s'affrontent. Cette exigence est difficile à remplir, car elle impose de s'interroger sur les types de relations susceptibles d'aider un belligérant au détriment de l'autre ; autrement dit, il faut définir l'activité et le moment qui font quitter au neutre l'impartialité à laquelle il doit s'astreindre. Ces préoccupations sont au cœur des politiques de neutralité du Danemark et de la Suède, dès la fin du XVIIe siècle, puis des Provinces Unies, au XVIIIe siècle, dans les conflits opposant la France à l'Angleterre. Pour le gouvernement de Versailles, les capacités des neutres à exporter les productions françaises, à assurer l'importation de marchandises étrangères et à prendre en charge le commerce avec les colonies sont des enjeux de plus en plus importants. La neutralité s'impose comme une question centrale dans le champ des relations internationales à la faveur du développement des échanges commerciaux et de la radicalisation des pratiques de guerre du XVIIIe siècle. Elle est une réalité complexe qui peut être étudiée par des approches emboîtées, en la considérant du point de vue de différents acteurs : le diplomate qui la négocie, le négociant qui la pratique, le philosophe et le juriste qui la pensent.
