Until recently, the disgorgement of profits remedy in US design patent law garnered little attention from scholars or practitioners. Congress created this remedy in the late nineteenth century to ...overrule two Supreme Court decisions that awarded nominal damages as the sole compensatory remedy for infringements of design patents. Under the new remedy, a design patentee could ask for a disgorgement of the "total profit" that an infringer made from sales of articles of manufacture to which the infringing design had been applied. Patented designs back then were generally co-extensive (or nearly so) with the appearance of products sold in the marketplace, and Congress was told when it adopted the total profit remedy that the design "sells the article." These conditions made it plausible to legislators that little or none of the profit on the sale of an infringing article was attributable to other elements of the article (e.g., quality of materials used or craftsmanship of its manufacture), and that the infringer captured profits it would have been unable to earn had it not infringed the design patent. However, in the modern era, it has become quite common for design patents to issue on small parts, features, or components of complex products and on designs that are more functional than ornamental. Changes in the nature of the design patent entitlement have precipitated a crisis about how to interpret the "total profit" remedy now codified as § 289 of US patent law.

The Apple Computer Company has evolved into one of the most innovative technology-based firms to transpire in the last three decades. Much of its success has been attributed to effective supply chain ...management. The purpose of this study is to provide an examination of external risk factors associated with Apple Inc.'s key suppliers through the creation of Bayesian networks. The study sample consists of Apple Inc.'s top electronic equipment suppliers based on its expenditure levels (e.g., cost of goods sold; selling, general and administrative cost; research and development, etc.) directly associated with these firms. Bayesian networks are used as a methodology for examining the supplier external risk profiles for the study sample. The results of this study show that Bayesian networks can be effectively used to assist managers in making decisions regarding current and prospective suppliers with respect to their potential impact on supply chains as illustrated through their corresponding external risk profiles.

Asymmetric pricing structure and different intergroup network externalities are characteristics of two-sided markets not captured in the analysis of one-sided markets. Focusing on Cournot duopoly ...where membership decision may be delegated to a manager, several equilibrium regimes are sustained depending on the fixed cost of managerial hiring and strength of the network externality exerted by the side whose demand is more price sensitive. The change from null to full delegation sharpens the asymmetric pricing structure and reduces the price level in two-sided markets. Contrary to one-sided markets with direct network effects, the prisoner's dilemma holds for sufficiently strong indirect network externalities. Imperfect interside discrimination of managerial incentives ensures profit maximization and efficient consumers' allocation. Private hiring should occur when the two-sided market exhibits symmetric pricing structure. An explanation for Apple's unprecedented event is provided. The reduction of revenue and managerial bonus in 2016 may be justified by the dissemination of full delegation in the Chinese information technology industry. Apple's upcoming strategy may consist on reducing both access prices, although the side whose demand is more price sensitive should have a greater price reduction. Alternatively, improving the content quality may constitute Apple's corporate strategy, thereby inducing a skimming pricing strategy on Chinese rivals.
In this paper, I look at the Apple iPhone as a fascinating instance of adaptation, especially as it relates to digital cultures. A theme in the rise of the mobile, or cell, phone has been how it ...underscores the active role that people play in the orchestration and use of culture. The gambit of the iPhone is that the mobile phone itself will be decisively remade, and through this that media culture will itself be reformed. To make sense of this rapturous reception, I examine the iPhone as a notable instance of consuming culture. The paper discusses the double sense in which the iPhone functions both as a signal adaptation of the mobile phone at the same time as it introduces new practices and politics of adaptation.
This case study provides analysis of the strategic marketing plan of electric vehicle manufacturer, Tesla Motors. It has profound marketing management implications, as it addresses this investigation ...from the unique perspective of Tesla's 'new technology'-based approach to automobile marketing and relates it to the successful marketing model of Apple Computer. This marketing approach is counter to the traditional automobile industry's marketing management approach which favors mass marketing and mass production. A qualitative, exploratory research approach was adopted for this analysis. Research was conducted via extensive secondary literature collection and data analysis, as well as in-depth examination of case studies focusing primarily on Apple Computer. Key findings conclude that: (1) the battery electric vehicle industry is poised for explosive growth; (2) Tesla Motors is uniquely positioned to capitalize upon this growth opportunity; and (3) a 'new technology'-based approach to marketing management is central to Tesla's current and future growth.
