Sujet à trop d’indéterminations en France, le concept de NCP a nécessité une analyse comparative fondée sur l’expérience italienne afin d’en identifier les contours et, par la suite, d’étudier sa ...place dans le droit. Il en ressort que les NCP renvoient à une multiplicité de catégories normatives de caractère axiologique et téléologique, servant de stratégie politique et structurant le système juridique. Par ailleurs, l’introduction de la forme programmatique dans les Constitutions modernes mêle l’indétermination de la norme dans son énonciation moderne au droit dans sa déclinaison traditionnelle. Les programmes ont ainsi du mal à trouver leur place dans le droit. Les NCP semblent a priori être privées d’effet juridique ; leur formulation imprécise ne mettrait en place que de simples objectifs. Toutefois, leur développement dans l’espace juridique paraît suffisamment important pour qu’il ne soit pas assimilé à une malfaçon du droit qui entacherait sa pureté. En effet, le concept NCP renvoie à de véritables « normes » constitutionnelles programmatiques dont la normativité reste particulière, signe non pas d’une « crise » du droit mais de son « évolution ».
Still subject to a certain level of vagueness in France, the concept of programmatic constilutional norms (PCN) required acomparative analysis based on the Italian experience in order to identify its trontiers and subsequently study ils place in law. Il appears that the PCN reters ta a multiplicity of normative categories ot axiological and teleological character, serving as political strategy while structuring the legal system. Moreover, the introduction of programmalic form in modern constitutions combines the vagueness of the norm in its modern formulation to the law in ils classical variant. Programs have struggled to find their place in law. The peN seem to be a priori denied of legal effect, their rather vague wordings would only established simple goals. However, their development in the legal space seem important enough 10 avoid PCN to be considered as legal oddities that couk' attend ta the purity of law. Indeed, Ihe concept of PCN connects to real programmatic constitutional norms whose normativity remains peculiar, sign not of a "crisis" of the law, but of its "evolution" .
Gegenstand der Arbeit bildet die aus Skandinavien stammende Rechtsfigur der "Erweiterten Kollektiven Lizenz" ("extended collective license"), welche über die Erstreckung von Kollektivverträgen die ...Lizenzierung von umfassenden Werkrepertoires an Nutzer ermöglicht. Trotz ihrer wachsenden Popularität ist die Erweiterte Kollektive Lizenz wissenschaftlich noch nicht annähernd erschöpfend behandelt worden. Vor diesem Hintergrund werden anhand einer umfassenden Analyse zunächst das Wesen, die Struktur sowie die maßgeblichen Aspekte dieser Rechtsfigur näher untersucht. Aufbauend auf diesen Erkenntnissen widmet sich die Arbeit anschließend der Frage, ob und inwieweit die Erweiterte Kollektive Lizenz im Einklang mit höherrangigem Recht in Deutschland und Europa in Zukunft nutzbar gemacht werden könnte. Gerade an der Nahtstelle von Exklusivität und Kollektivierung vermag das Modell in bestimmten Bereichen den erforderlichen Interessenausgleich im Urheberrecht zu gewährleisten.
The focus of this book is the normativity of global ethic. Over the years, different cultures and civilizations have been brought closer than never before by globalization. This trend has both its ...negative and positive dimensions. Overall, the main problem of this present trend of societal organization and human interaction called globalization is a moral issue, namely, the question: how should we treat one another? Okeja's global ethic seeks to answer this question. It underscores that we should treat one another in our current age of globalization in accordance with the Golden Rule principle. The suggestion of this ethic is therefore that we should not treat others the way we would not want to be treated. This sounds simple enough. The problem, however, is that it is not exactly clear what this principle of moral conduct would suggest in both simple and complex moral situations. Most importantly, it is not clear why it is reasonable to treat people the way we would not want to be treated. Why, in other words, should we act in accordance with the Golden Rule principle? What is the justification of the demand the Golden Rule makes on us? This book answers these and other questions about the normative plausibility of the Golden Rule, and thus global ethic, from the comparative perspective of ethics in African philosophy. It analyzes three stages of the possible normative justification of the moral imperative of global ethic and proposes a deliberative form of justification.
Ce travail de recherche doctorale a pour objectif de mieux comprendre le lien entre politiques d’équilibre vie professionnelle- vie personnelle et égalité femmes-hommes en entreprise. Il s’attache à ...comprendre comment ces dispositifs influencent la norme sexuée.En mobilisant le cadre théorique des représentations sociales, notre investigation s’appuie sur deux études de cas approfondies, avec 44 entretiens semi-directifs « outil majeur de repérage des représentations » (Abric, 2011), comme méthode principale de collecte de données. Nous avons choisi de mener ces études dans deux pays différents : la France et l’Espagne, en raison de leur approche contrastée de la question de la conciliation : plutôt traditionnelle pour la France, plutôt intrusive et individualisée pour l’Espagne.Les résultats mettent en lumière l’hétérogénéité et le caractère sexué des représentations des salariés vis-à-vis des politiques d’équilibre, celles-ci apparaissent aussi fortement liées à la figure du manager et à son style de management. La catégorisation des représentations (progressistes/ traditionnalistes/ neutres et hostiles) contribue à comprendre leur influence sur l’égalité, et fait apparaître que la prise de conscience des inégalités –plus forte chez les salariés espagnols- est une condition préalable vers une conciliation égalitaire.
This PhD research aims at better understanding the link between work life balance policies and gender equality in the workplace. The objective is to understand how these measures can influence sexual roles division at work.By referring to the theoretical framework of social perceptions, our work is based on two main case studies, with 44 semi-oriented interviews “major tool to identify perceptions”, as the main method to collect data. We chose to conduct the two case studies in two different countries: France and Spain, because of their contrasted approach towards work life balance topic: rather traditional for France, more intrusive and individualized for Spain.The results highlight the heterogeneity and the gendered character of the employees’ perceptions of work life balance policies; those ones also appear to be strongly connected to the manager behavior and its management style. The categorization of perceptions (progressist/ traditionalist/ neutral/ hostile) contributes to a better understanding of their influence on gender equality, and reveals that inequalities awareness –stronger amongst Spanish employees- is a prior condition for a more equal work life balance.
