Integrating Alternative Dispute Resolution (ADR) into legal systems is essential for improving access to justice, decreasing litigation expenses, and promoting enforced outcomes. This article ...examines the ADR practices in Hungary, a country that has successfully integrated ADR into its legal system, to gain significant insights for Indonesia, as both countries share the same sociocultural practices for communal dispute resolution. This normative legal research examines Hungary's extensive legal framework, the roles of institutional support structures, and the enforcement of ADR awards. The study employs comparative analysis that systematically evaluates pertinent legal documents, institutional reports, and scholarly literature from Hungary and Indonesia. The study found fundamental factors that contribute to the effectiveness of alternative dispute resolution (ADR) in Hungary including the existence of a clearly established legislative framework, sufficient institutional infrastructure, and effective regulation to enforce ADR decisions. Indonesia can adopt these techniques to improve its Alternative Dispute Resolution (ADR) system, resulting in more streamlined, cost-efficient, and fair processes for resolving disputes and to establish a more unified and efficient ADR system.

Court-annexed Alternative Dispute Resolution (ADR) programs have become increasingly prevalent in the past fifty years, but there is a lack of comprehensive data on their efficacy and impact. Davis ...analyzes a student note by Jordan Hicks, which provides a detailed examination of court-annexed ADR programs in DE Superior Court. Hicks's analysis focuses on judicial efficiency, speed, failure rates, and prejudicial concerns, and offers a template for studying similar programs in other jurisdictions. He highlights the challenges of gathering data on court-annexed ADR programs across different states and the inconsistencies in statistical reporting. However, Hicks's approach of turning available data into meaningful information and his suggestions for improving the efficiency of court-annexed ADR programs are commendable. Since the late twentieth century, federal and state jurisdictions across the United States have explored the use of Alternative Dispute Resolution ("ADR")programs to resolve legal disputes. ADR ...programs provide extrajudicial mechanisms through which parties can resolve their disputes without the delay and expense of a traditional judicial proceeding. Courts and practitioners alike have lauded ADR programs. For litigators, ADR programs are a way to deliver outcomes to clients quickly and efficiently. For courts, ADR programs are a way to remove cases from overcrowded dockets. While ADR is generally considered to be speedier and more cost-efficient than a trial, little empirical research has been done to determine which sorts of ADR programs deliver the greatest returns. An examination of the last four decades of ADR programs in Delaware Superior Court may provide just this insight. Since 1978, the Delaware judiciary has enacted, repealed, and amended three similar, but distinct, iterations of an ADR program in Delaware Superior Court. Because all three iterations were enacted in the same court system, the Delaware ADR program is a microcosm in which different characteristics of ADR programs may be compared against each other. This objective comparison reveals which iteration of the ADR program has proven most efficient for Delaware, and may provide valuable insights for legislators and rule-makers who seek to design efficient ADR programs in jurisdictions across the United States.

A mediação surgiu como um sistema social que detém normas ...específicas de cada cultura e regras que as expressam. Até hoje, a mediação opera como um sistema de significados profundamente humano. Este artigo analisa se tais normas específicas para a mediação, testadas e refinadas com o tempo, serão transferidas, relativamente intactas, para o ambiente virtual. Para isso, será analisado como os designers constroem e implementam os ambientes virtuais e sua decorrente automatização tecnológica. Contudo, para realizar isso da melhor maneira os designers devem, em primeiro lugar, identificar, entender e respeitar os valores, a ética e o propósito implícitos nessas normas intergeracionais.
Mediation is one of the Alternative Dispute Resolution (ADR) that emphasises a mutually agreeable resolution and incorporates a win-win situation between parties. Mediation is not a rare concept in ...Indonesia and Malaysia. People in Indonesia and Malaysia have long used mediation in their daily lives as mediation has been proven to be effective since long ago. Due to its extensive use in Indonesia and Malaysia, a comprehensive study was carried out by the researcher to identify the comparison of mediation in Indonesia and Malaysia. In this paper, the researcher will review the practice of mediation in Indonesia and Malaysia via a comparison analysis where the researcher employs a qualitative approach via library-based research. Many reference sources and reading materials have been used by researchers to see similarities and differences between these two countries. The result of this study affirms that mediation practices in Indonesia and Malaysia are quite similar, despite being governed under a different law and regulations. In addition to having many similarities, one of the things that attracted the researcher's attention is that both countries have their challenges in carrying out mediation. Therefore, this aspect of the challenge also needs to be touched upon so that mediation can be conducted in both countries smoothly. It is also hoped that with this study, in the future, this study can also be used as a guide or manual in discussing mediation for both countries.
Violence against women is characterised by its universality, the multiplicity of its forms, and the intersectionality of diverse kinds of discrimination against women. Great emphasis in legal ...analysis has been placed on sex-based discrimination; however, in investigations of violence, one aspect has been overlooked: violence may severely affect women's health and access to reproductive health, and State health policies might be a cause of violence against women. Exploring the relationship between violence against women and women's rights to health and reproductive health, Sara De Vido theorises the new concept of violence against women's health in international law using the Hippocratic paradigm, enriching human rights-based approaches to women's autonomy and reflecting on the pervasiveness of patterns of discrimination. At the core of the book are two dimensions of violence: horizontal 'inter-personal', and vertical 'state policies'. Investigating these dimensions through decisions made by domestic, regional and international judicial or quasi-judicial bodies, De Vido reconceptualises States' obligations and eventually asks whether international law itself is the ultimate cause of violence against women's health.
