Angesichts der jüngsten Finanz- und Wirtschaftskrise haben Gewerkschaften und Arbeitgeberverbände vermehrt Tarifverträge zur „kollegialen Arbeitnehmerüberlassung“ abgeschlossen, die ...vor allem Klein- und Mittelunternehmen eine Flexibilisierung des Personaleinsatzes ermöglichen. Empirische Befunde zeigen große Unterschiede hinsichtlich der Anwendung der Tarifverträge: Während die Möglichkeiten der Arbeitnehmerüberlassung in manchen Regionen zeitweise rege Anwendung fanden, wurde sie von Unternehmen anderer Regionen trotz ihrer Potenziale im Hinblick auf die Bewältigung zentraler Herausforderungen von Konjunkturkrisen und Fachkräftemangel nicht angewendet. Der Beitrag wählt eine strukturationstheoretische Perspektive, um die Ursachen für die Unterschiede in der praktischen Umsetzung dieser personalwirtschaftlichen Strategien anhand zweier Regionen (Braunschweig und Ruhrgebiet) exemplarisch zu analysieren. Die Unterschiede in den Umsetzungspraktiken lassen sich auf die Gestaltung der Einführungsprozesse sowie die darauf aufbauenden sozialen Praktiken zurückführen. Regional-kulturelle Muster, Interessenlagen zentraler Akteure und der Grad der Beteiligung während der Einführungsphase werden als Erklärungsfaktoren identifiziert.
The paper analyzes the decision of the Court of Justice of the European Union in joined Cases TSN and YTN, concerning the interpretation of directives governing maternity leave, parental leave and ...equal opportunities as well as equal treatment of men and women. Subject of the dispute was rejection to pay remuneration which is under collective agreements usually paid during maternity leave, to two Finnish female employees due to interruption of unpaid parental leave by maternity leave. In addition of comment of the decision the author presents also its importance to the legal system of the Slovak Republic.
This paper provides a brief overview of the Finnish wage bargaining system and its evolution over the past decades into its current mode by drawing on existing documents, reports and analyses. The ...emphasis is on the changes having occurred in the system’s over-all structure as well as in its main content. Finally attempts are made, by use of the existing empirical evidence, to contrast these changes against the development of wages and the unionisation rate. The paper concludes with a brief discussion of future challenges as ex-pressed in recent studies of the Finnish wage bargaining system.

Para ello, en primer lugar debemos ponernos en contexto, mostrando los cambios que introducen las progresivas reformas. En segundo lugar se pretende dar una visión general del sistema, prestando especial atención al fenómeno de la concurrencia de convenios colectivos y como se regula, ya que es dentro de fenómeno donde tiene importancia la concurrencia de convenios colectivos. Se presta especial atención a la preferencia aplicativa de convenios colectivos de empresa, que será el centro del presente trabajo, analizando sus límites materiales y las consecuencias de que la concurrencia sea imperativa tras las reformas de 2012. El trabajo finaliza con un repaso de las primeras sentencias sobre prioridad aplicativa del convenio de empresa y una crítica sobre el impacto de estas reformas en el sistema de negociación colectiva.- EN In the present essay we try to show the basic working of applicative priority of company collective agreement, concept introduced in our collective bargaining system by 2011 and 2012 reforms. For that purpose we must, first, set context, showing changes introduced by successive reforms. After that, we try to give a general view of the system, focusing in collective agreement overlapping and how is it ruled, because it is in this overlapping where it is important the company collective agreement priority. We focus on applicative priority of company collective agreements, which is the main part of this work, analysing its material boundaries and consequences of such priority being imperative after 2012 reforms. A key area of focus in the economic reform process and the design of a favorable business environment is labor market legislation. Montenegro has obviously failed in this area. After nearly 13 years ...since the beginning of the transition process, or five years since the beginning of Economic reforms, the new Labor Law was passed in July 2003. This is not the only weakness of the labor market reform; more importantly is that the new law did not actually bring any significant changes that would create a more flexible labor market. Since the General Collective Agreement, which is an important part of labor legislature in Montenegro, must be adjusted to the new Labor Law, the Union has proposed a new Collective agreement. In this paper we will discuss the new Labor Law as well as the adjusted Collective Agreement that was proposed by the union.
The French hospitals sector is split between sub-sectors, with different employment status (civil servant versus private employment contract). Industrial relations differs. Nevertheless, differences ...between the sub-sectors are not very important. Quality rules and health regulation could explain why different labour market institutions do not lead to a strong divide in employment and working conditions.

The paper analyses discourses by scholars who, as experts, were close to the political elites, and who tried to legitimize this kind of co-regulation by pointing out the inefficiency of state intervention and the epistemic authority of non-state actors.
