This open access book focuses on public actors with a role in the settlement of investment disputes. Traditional studies on actors in international investment law have tended to concentrate on ...arbitrators, claimant investors and respondent states. Yet this focus on the “principal” players in investment dispute settlement has allowed a number of other seminal actors to be neglected. This book seeks to redress this imbalance by turning the spotlight on the latter. From the investor’s home state to domestic courts, from sub-national governments to international organisations, and from political risk insurance agencies to legal defence teams in national ministries, the book critically reviews these overlooked public actors in international investment law.
La Convention pour la sauvegarde du patrimoine culturel Immatériel de 2003 et la Convention sur la protection et la promotion de la diversité des expressions culturelles de 2005 sont les deux plus ...récents traités culturels internationaux conclus sous l’égide de l’Organisation des Nations Unies pour l’éducation, la science et la culture (UNESCO). Puisant leur source dans la Déclaration universelle sur la diversité culturelle adoptée à l’unanimité des membres de l’UNESCO en 2001, les Conventions de 2003 et de 2005 constituent toutes deux une réponse de la communauté internationale aux phénomènes de mondialisation des économies et d’homogénéisation des cultures, notamment générés par l’intégration des marchés. Ces instruments demeurent néanmoins distincts et poursuivent des objectifs qui leurs sont propres, bien que des interactions entre les deux conventions puissent être identifiées. While decades of space ventures have led to significant technological advances, space activities have also brought increasing environmental problems. This book examines the current international ...legal regimes in space law and environmental law in order to ascertain their applicability and efficacy in addressing environmental threats in the space sector. The research suggests mechanisms which could improve environmental protection in the sector and strengthen the environmental element in space law. These mechanisms include a variety of norm-setting strategies used in international environmental management. Special attention is drawn to the potential of environmental impact assessment in the space sector and to dispute resolution procedures. Like other areas of human activities, the space sector should accommodate both economic interests and environmental protection in line with the principle of sustainable development.
Die Arbeit untersucht das mit der Verbreitung strafrechtlicher Sanktionen für Kartellrechtsverstöße verbundene Konfliktpotenzial auf internationaler Ebene und beleuchtet dabei insbesondere die ...Gefahren, die sich aus dem parallelen Eingreifen mehrerer nationaler Kartellstrafregime auf einen internationalen Kartellverstoß ergeben. Dabei werden vorgelagert die auf strafrechtlicher und auf kartellrechtlicher Seite bestehenden internationalen Kooperations- und Koordinierungsmechanismen auf ihre Verfügbarkeit bei der Durchsetzung nationaler Kartellstraftatbestände hin untersucht. In diesem Zusammenhang wird unter anderem ein umfassendes Lösungsmodell dazu entwickelt, inwieweit die Staatsanwaltschaften der EU-Mitgliedsstaaten den Instrumenten der europäischen Kartellverfahrensverordnung (Verordnung 1/2003) unterliegen und wann ein nationaler Straftatbestand als „einzelstaatliches Wettbewerbsrecht“ im Sinne dieser Verordnung anzusehen ist.
