This essay aims at analyzing the concepts of provisionality, definitiveness, temporality, and summarity of cognition, all used in the scope of the theme of "provisional protections", confronting them ...with the relevant legal provisions to the matter, in order to elucidate the relationship between the concepts of provisionality, definitiveness, temporality, and the concept of cognition in procedural law, as well as how these terms relate to the notions of judgment of probability, of evidence and certainty of the right affirmed in court. The bibliographical review will thus be used as an investigation procedure. The research method is the hypothetico-deductive one, to the extent that it will seek to demonstrate that the hypothesis of the correlation between provisionality and summary of cognition is not necessarily correct, as it does not account for all the complexity of the presented theme, especially in the light of the Brazilian Civil Procedure Code. In regard the research's results and conclusions, one can say that the classic concept of provisionality adopted by Brazilian doctrine is insufficient to explain all the legal situations in which the term "provisional protections" is used. Thus, for that the "provisional protections" can be charactered by concept of provisionality is necessary understand it by larger way, that is, meaning "smaller stability" of some judicial decisions. In other word, this "smaller stability" will can refers to judicial decisions' practice effects or to its revocability by judge. Yet, it is very important observe that this "smaller stability" is not necessarily linked to summary cognition. O presente ensaio tem o objetivo de analisar os conceitos de provisoriedade, definitividade, temporariedade e sumariedade da cognicao utilizados no ambito da tematica das "tutelas provisorias", confrontando-os com os dispositivos legais pertinentes a materia, de modo a elucidar qual a relacao existente entre os conceitos de provisoriedade, definitividade, temporariedade e o conceito de cognicao no direito processual, bem como de que modo esses termos se relacionam as nocoes de juizo de probabilidade, de evidencia e de certeza do direito afirmado em juizo. Para isso, sera utilizado, como procedimento de investigacao, a revisao bibliografica, com consulta a doutrina acerca da materia objeto da pesquisa. O metodo de pesquisa e o hipotetico-dedutivo, na medida em que se buscara demonstrar que a hipotese da correlacao entre provisoriedade e sumariedade da cognicao nao e, necessariamente correta, de modo que nao da conta de toda a complexidade do tema apresentada, notadamente a luz do Codigo de Processo Civil brasileiro. Quanto aos resultados e conclusoes da pesquisa, pode-se destacar que o conceito classico de provisoriedade adotado pela doutrina brasileira e insuficiente para explicar todas as situacoes legais em que o termo "tutelas provisorias" e utilizado. Em outras palavras, para que as "tutelas provisorias" possam ser caracterizadas pelo conceito de provisoriedade, e necessario compreende-lo de maneira abrangente, significando uma "menor estabilidade" de certos provimentos jurisdicionais, a qual, dependendo do caso, podera referir-se aos efeitos praticos do provimento jurisdicional ou a sua revogabilidade pelo orgao julgador. Por fim, esse menor grau de estabilidade nao se relaciona, necessariamente, a sumariedade da cognicao. O presente ensaio tem o objetivo de analisar os conceitos de provisoriedade, definitividade, temporariedade e sumariedade da cognição utilizados no âmbito da temática das “tutelas provisórias”, ...confrontando-os com os dispositivos legais pertinentes à matéria, de modo a elucidar qual a relação existente entre os conceitos de provisoriedade, definitividade, temporariedade e o conceito de cognição no direito processual, bem como de que modo esses termos se relacionam às noções de juízo de probabilidade, de evidência e de certeza do direito afirmado em juízo. The article deals with the issue of procedural flexibility from the perspective of the theory of the legal process as a guarantee. Starting from a dogmatic method, it seeks to differentiate the ...flexibility of the procedure and the adaptability of jurisdictional protection. It demonstrates that the criticisms made to the common procedure and procedural rigidity in Brazil follow premises of Italian doctrine. It clarifies that the criticism of procedural flexibility by the judge does not mean a disregard for material right. Finally, it looks at issues of comparative law. The bibliographic review method is used, in the construction of premises, and the deductive method in the formulation of the theses defended by the study.

O artigo trabalha com a questão da flexibilização procedimental sob a perspectiva da garantística. Partindo de uma metódica dogmática, busca diferenciar flexibilização do procedimento e ...adaptabilidade da tutela jurisdicional. Demonstra que as críticas realizadas ao procedimento comum e à rigidez procedimental no Brasil seguem premissas da doutrina italiana. Elucida que a crítica garantística à flexibilização procedimental pelo juiz não significa um menosprezo ao direito material. Observa, por fim, questões de direito comparado. Faz-se uso do método de revisão bibliográfica, na construção de premissas, e do método dedutivo na formulação das teses defendidas pelo estudo.

O ensaio tem como tema a investigacao do significado do adjetivo "cientifico" dentro do processualismo "cientifico" bem como o conteudo das "novas fases metodologicas". Delimita-se a investigacao dentro da Ciencia Juridica e sua divisao tripartite. Tem-se como objetivo demonstrar que o adjetivo "cientifico" nao guarda relacao com as exigencias metodologicas da Ciencia Juridica. Coloca-se em xeque a existencia de fases metodologicas. A hipotese e de que o adjetivo "cientifico" e as "novas fases" foram utilizadas, respectivamente, como estrategia discursiva para desqualificar uma teoria com bases epistemologicas distintas e para reivindicar para as "novas" fases uma autoridade que nao se justifica.
