With his conclusion, Squire discusses the historical trajectory of American legislatures and suggests how they might further develop over the coming decades. It distinguishes among parties, factions, coalitions and delegations based on the extent to which they are unified in their voting and/or willing to form policy coalitions with other legislative 'agents'. It discusses the voting unity and ballot systems that allow voters to identify an agent, and describes the degree to which those agents have been flexible with regards to the formation of policy coalitions. It also shows that the US parties have exhibited higher levels of unity but less flexibility in recent years, and thus contrast the prevailing pattern in Latin America. The book focuses its explanation for the patterns on the role of candidate nominations, other aspects of the electoral system and the legislators' ideological alignments.
Parliamentary democracy is the most common way of organizing delegation and accountability in contemporary democracies. Yet knowledge of this type of regime has been incomplete and often ...unsystematic. Delegation and Accountability in Parliamentary Democracies offers new conceptual clarity on the topic. Taking principal-agent theory as its framework, the work illustrates how a variety of apparently unrelated representation issues can now be understood. This procedure allows scholarship to move well beyond what have previously been cloudy and confusing debates aimed at defining the virtues and perils of parliamentarism. This new empirical investigation includes all 17 West European parliamentary democracies. These countries are compared in a series of cross-national tables and figures, and 17 country chapters provide a wealth of information on four discrete stages in the delegation process: delegation from voters to parliamentary representatives, delegation from parliament to the prime minister and cabinet, delegation within the cabinet, and delegation from cabinet ministers to civil servants. Each chapter illustrates how political parties serve as bonding instruments, which align incentives and permit citizen control of the policy process. This is complemented by a consideration of external constraints, such as courts, central banks, corporatism, and the European Union, which can impinge on national-level democratic delegation. The concluding chapters go on to consider how well the problems of delegation and accountability are solved in these countries. This book challenges ...such Eurocentric visions by retracing the evolution of modern institutions of collective decision-making in Eurasia. Breaching the divide between different area studies, the book provides nine case studies covering the area between the eastern edge of Asia and Eastern Europe, including the former Russian, Ottoman, Qing, and Japanese Empires as well as their successor states. In particular, it explores the appeals to concepts of parliamentarism, deliberative decision-making, and constitutionalism; historical practices related to parliamentarism; and political mythologies across Eurasia. It focuses on the historical and “reestablished” institutions of decision-making, which consciously hark back to indigenous traditions and adapt them to the changing circumstances in imperial and postimperial contexts. Thereby, the book explains how representative institutions were needed for the establishment of modernized empires or postimperial states but at the same time offered a connection to the past.
In this book, Carol Mershon and Olga Shvetsova explore one of the central questions in democratic politics: how much autonomy do elected politicians have to shape and reshape the party system on ...their own, without the direct involvement of voters in elections? Mershon and Shvetsova's theory focuses on the choices of party membership made by legislators while serving in office. It identifies the inducements and impediments to legislators' changes of partisan affiliation, and integrates strategic and institutional approaches to the study of parties and party systems. With empirical analyses comparing nine countries that differ in electoral laws, territorial governance and executive-legislative relations, Mershon and Shvetsova find that strategic incumbents have the capacity to reconfigure the party system as established in elections. Representatives are motivated to bring about change by opportunities arising during the parliamentary term, and are deterred from doing so by the elemental democratic practice of elections.
In the wake of several social justice movements, including the #MeToo movement in 2017 and the Black Lives Matter Movement in 2020, corporations increasingly emphasized their commitments to ...diversity, equity, and inclusion (DEI) in a variety of ways. Amid shifts in both public attitudes and the corporate landscape, a new trend in shareholder derivative actions emerged: shareholders began suing boards of directors for corporate failures related to DEI shortcomings. As a result, major corporations like Meta, Cisco, and Gap have faced suits brought by shareholders seeking to hold boards accountable for corporations' public pledges to DEI values and initiatives.
Although these actions have experienced limited legal success so far, this Comment argues for a reconceptualization of "success" in shareholder derivative suits related to board and executive-level diversity that recognizes these actions may carry value in serving a deterrent purpose, inducing corporate action through public shaming, and acting as a positive social force that demands industry attention on matters of DEI accountability. Next, this Comment proposes a modification to the substantial benefit doctrine that recognizes benefits may be derived from diversity-related derivative suits for the corporation or broader class of shareholders based on a fact-intensive inquiry as to whether the action resulted in changes which reduce the risk of reputational harm and future litigation or increase investment opportunities. Further, as regulators and state legislatures consider novel strategies to encourage leadership diversity, these suits may also complement public sector initiatives as a private enforcement mechanism.
