El Acuerdo Plenario No. 1/2009/CJ-116 es un aporte de la Corte Suprema del Perú que contiene elementos normativos para concretizar la coordinación entre la jurisdicción especial comunal y la ...jurisdicción ordinaria, dado el mandato constitucional y convencional que sostiene el reconocimiento de la función jurisdiccional de las rondas campesinas en el Perú. A través de la revisión del Acuerdo en relación con el sistema de fuentes del derecho y las exigencias del pluralismo jurídico, el presente artículo tiene como objetivo explicitar los elementos normativos elaborados por los jueces e identificar sus puntos de coincidencia con los pronunciamientos del Tribunal Constitucional. Dicha evaluación se da mediante el análisis documental de las fuentes primarias y secundarias, lo que permitió identificar como principal punto de encuentro entre ambas Cortes la exhortación al legislador para que cumpla con el mandato del artículo 149 de la Constitución, el cual exige la promulgación de una ley de desarrollo que regule las relaciones entre ambas jurisdicciones.

Muovendo dalla proposta di legge Pillon, il contributo si interroga sulla funzione affettivo-educativa dei genitori nei confronti della prole, dopo il fallimento della loro unione. Assai critica è la ...posizione nei confronti della proposta di legge che rigidamente definisce i tempi di permanenza dei figli minori con ciascuno dei genitori. Contrariamente, si sostiene che il compito del legislatore dovrebbe essere solo quello di definire un principio; il tempo di frequentazione dei figli con ciascun genitore dovrebbe, difatti, essere il più ampio possibile, tenendo presente la situazione concreta e l'esigenza dei figli di una crescita serena ed equilibrata. Il disegno di legge Pillon offre anche lo spunto per una riflessione pedagogica sul tema del "diritto all'amore", quale diritto soggettivo all'affetto dei genitori, essenziale per la vita affettiva dei figli e per la loro armoniosa formazione. The paper deals with the issue of the parents' affective-educational function towards their offspring, after the failure of their union and comments on the Pillon bill. This bill strictly defines the time spent by minor children with each of the parents. This option appears very critical: the task of the legislator should only be to define a principle; the time for children to attend with each parent should be ample, bearing in mind the concrete situation and children's need for a serene and balanced growth. The Pillon bill also offers the opportunity for an educational reflection on the topic of the "right of love", as a subjective right to parental affection, essential for the emotional life of children and for their harmonious education. The article deals with various aspects of multiple-office holding. Although the phenomenon is especially influential in connection with legislators, the text offers a critical synthesis of recent ...findings on multiple-office holding on any level of political decision-making, thus providing a general framework for scholarly discussion and further research. The paper first provides a definition of the concept of multiple-office holding, which has been heretofore lacking in the Czech context. Causes of multiple-office holding are then delineated and divided into the three categories of historical reverberations, systemic elements and individual incentives. Both the positive and negative impacts on a political system are discussed as well. Next, three approaches (direct, indirect, and autoregulatory) of dealing with the practice of multiple-office holding, which are employed by particular political systems, are distinguished. Then, the role of a multiple-office holding in the Czech political system is depicted. The final part of the paper discusses a specific controversy linked to the phenomenon and criticises the lack of proper debates and scientific analyses on the practice.
