The New Civil Procedure Code, inspired from article 6 of the European Convention on Human Rights, provides that everyone is entitled to a fair hearing within a reasonable time by an independent and ...impartial tribunal established by law and the court should provide against the breach of this principle by taking all legal actions. In case of legal proceeding, a part of the administrative relations between the authority and the legal or natural persons are also under the force of this principle. The European Court’s jurisprudence determines the field of this principle by the definition of the notion ‘civil’. In order to ensure the celerity of the administrative proceedings the New Civil Procedure Code provides the possibility of the parties to stand before the court requiring the protraction of the trial.
El proceso contencioso administrativo es un instrumento procesal ordinario para brindar tutela procesal contra las actuaciones de la Administración, así como para efectuar un control jurídico del ...ejercicio de sus funciones. Su modalidad urgente sirve para ofrecer dicha tutela y realizar tal control respecto de vías de hecho y omisiones de la Administración. Sin embargo, nuestra normatividad no considera los casos en que la actuación constitutiva de vía de hecho se produzca respecto de lo establecido en un reglamento, ni tampoco cuando la conducta que la Administración omita esté prevista en un reglamento. Nos encontramos ante dos casos en los cuales el principio constitucional de control interórganos y el derecho constitucional a una tutela judicial efectiva resultan afectados.
Establishing legal forms of nature conservation entails a restriction on the right of ownership and other property rights. For this reason, the legislature introduced in the Act of 27 April 2001 on ...Environmental Protection Law solutions allowing for the purchase of real estate or payment of damages. The provisions of the Environmental Protection Law set out an administrative-judicial procedure of claiming for remedying a damage caused by the legal operation of the public administration related to the protection of environmental resources. This procedure is based on the fact that a claim, essentially of a civil nature (a claim for remedying a damage caused by restricting the use of property) is pursued in two stages – the first in an administrative proceeding in which the administrative authority issues a decision and in the second, where the case is decided by a general court. The first stage is obligatory, in the sense that in the event of a dispute for compensation, the aggrieved party must apply to the administrative body for compensation. The second is initiated as a result of the action of the party dissatisfied with the compensation awarded by the administrative body.
This article discusses the scope of the constitutional due process clause in Brazilian administrative law, based on an analysis of the Brazilian Constitution, the Fifth (1791) and Fourteenth (1868) ...Amendments to the U.S. Constitution, the International Covenant on Civil and Political Rights, and the European and Inter-American human rights systems. The author concludes that since the due process clause (Brazilian Constitution Article 5.54, namely, “no one shall be deprived of liberty or property without due process of law”) was inspired by the U.S. Constitution, Brazilian legislators should exercise their powers of discretion in policy-making to adapt the clause to the realities of the Brazilian administrative authorities and to the experience of the quasi-independent authorities that perform the adjudicative function under U.S. administrative law.
On the 26th to 28th of October 2022, the Faculty of Law and Administration of the Adam Mickiewicz University in Poznań, organized an international scientific seminar entitled "Simplification and ...Electronisation of Administrative Proceedings" with the following round table discussion, which was organised under the auspices of Mgr. Beniamin Rozczyński from Adam Mickiewicz University, within the framework of the research project "Simplification and Electronisation of Administrative Proceedings" (2020/37/N/HS5/01045) on simplification of administrative proceedings in the Visegrad Group Countries. The project was funded by the National Science Centre in Poland. The seminar was held in person.
