  • Alternative dispute resolution in administrative law - the Slovenian perspective [Elektronski vir]
    Pečarič, Mirko
This paper deals with the possibilities and obstacles of using alternative dispute resolution tools in administrative law. Due to the involvement of public power in administrative procedures and ... disputes, this branch of law does not only balance between oneʹs interest vis-à-vis the interests of another, so these tools in the administrative matters in Slovenia are analysed to show possible discrepancies between theory and practice, between the legal arrangements and habitual practice. Based on this analysis and with the evaluation of legal arrangements of alternative dispute resolution in the US and New South Wales administrative law, criteria are given by which could be more easily decided pro et contra to (not) use these tools in administrative law. The paper marks the several open topics that need to be further investigated, if legislators want to walk the walk, not only talk the talk about these tolls, i.e. provided that they want for these tolls to be applied more successfully in administrative matters. But before that, these tools should be clearly distinguished form other similar tools. This paper numbers some of them.
