When employees at firms like Greyhound and Eastern Airlines walk out to protest wage and benefit reductions, they are permanently replaced and their representative labor unions destroyed. Every year, the threat or drama of a high-profile strike-in air traffic control towers, at Amtrak, or at Caterpillar-makes national headlines and, every year, several hundred thousand unrepresented American employees are discharged without good cause.
During the past decade, employer opposition to unions has increased. Industrial and demographic changes have eroded traditional blue-collar labor support, and class-based myths have discouraged organization among white-collar workers. As the American labor movement begins its second century, it is confronted by challenges that threaten its very existence. In this work, Charles Craver presents an incisive analysis of the current state of the American labor movement and a manifesto for how this crucial institution can be revitalized. Craver calls for a greater recognition that mediation as a form of dispute resolution is essentially akin to assisted negotiation, and argues that this form of dispute settlement should be utilized ...more frequently in disputes among members of a community. Craver suggests that successful mediation can help assuage community members of the typical negative social pressure associated with inter-community litigation, and provides that such mediation can enhance the psychological well-being of the negotiating parties. As computers, the Internet, and efficient transportation systems have generated a truly global political and economic world,1 the extent of governmental and private transnational negotiating has ...significantly increased. International political entities - such as the United Nations and its affiliates and the World Trade Organization (WTO) - and regional political/economic groups - such as the European Union, the Group of Eight (G-8), the expanded Group of Twenty (G-20), and the North American Free Trade Zone - have increased the number of bilateral and multilateral governmental bargaining interactions. Nongovernmental organizations (NGOs) have become increasingly involved with issues that were previously addressed exclusively through governmental channels. Federal employees have enjoyed only limited bargaining rights, under Executive Orders 10,988 and 11,491 and Title VII of the Civil Service Reform Act, with Congress determining their basic wages and ...fringe benefits and managers determining basic departmental policies. On the other hand, most state and local government personnel have the right to bargain over their wages, fringe benefits, and working conditions. A number of state laws preclude bargaining over the basic missions of the departments involved or the manner in which they carry out their functions. Nevertheless, public sector labor organizations have been able to negotiate bargaining agreements covering many important topics. Here, Craver discusses the impact of labor unions on worker rights and public sector dispute resolution procedures. He also tackles the political nature of public sector collective bargaining and the use of alternative dispute resolution techniques to resolve public sector bargaining disputes.

Lawyers negotiate repeatedly. They actually engage in bargaining interactions when they do not even appreciate the fact that they are negotiating. They interact with colleagues within their own ...firms, and they interact with prospective clients and current clients. They also negotiate on behalf of clients with external parties. Transactional attorneys work to structure diverse business arrangements, while litigators endeavor to resolve disputes. Here, Craver discusses the current ethical rules governing lawyer conduct during bargaining interactions, and the standards that communitarians would like to impose on practicing attorneys. He also explores the different negotiator styles employed by legal practitioners to see which ethics approach is most reflective of real world encounters and examine the way in which the Model Rules and traditional concepts of fraud should be applied to overt misrepresentations, partial disclosures, and nondisclosures.

When males and females negotiate with persons of the opposite sex — and people of the same sex — gender-based stereotypes may influence their interactions. Men and women often assume that males are ...more likely to be competitive, win-lose negotiators who want to maximize their own return. Women are expected to be more accommodating, win-win negotiators who try to preserve relationships by seeking to maximize the joint return achieved by the parties. these assumptions are accurate, we might expect men to achieve better negotiating results than women. This article explores common gender-based beliefs that might affect bargaining interactions. It then compares the performance of male and female law students over the past 16 years on Legal Negotiation course exercises to determine whether men or women achieve better results on negotiation exercises. The data suggest that negotiator gender does not significantly influence negotiation results.
