This article aims to answer the urgency of the formation of Law about MPR in the Indonesian constitutional system. This research uses normative juridical research method with statutory and conceptual ...approach, as well as a qualitative descriptive analysis. This article concludes that 1) the formation of law on MPR has philosophical, juridical, and socio-political urgency; 2) the process of forming the law regarding the MPR must pay attention to the process and the content of the formation of good laws and regulations as regulated in the legislations.
This research examines the legal problems surrounding the dismissal of Aswanto as a judge of the Constitutional Court of the Republic of Indonesia (MKRI), where the dismissal is deemed inconsistent ...with the prevailing laws and regulations. This study employs a doctrinal research type with a normative juridical approach through the examination of legislation and conceptual understanding to scrutinise the constitutionality of the replacement of constitutional judge Aswanto by the People's Representative Council (DPR) and its implications on the independence of the Constitutional Court. The findings suggest that, firstly, the replacement of Judge Aswanto during his tenure by the DPR is an unconstitutional act as it does not align with the constitution. Secondly, this replacement has implications for weakening the independence of the Constitutional Court, including constitutional independence, functional independence, personal independence, and evident practical independence. Therefore, the President needs to annul Presidential Decree Number 114/P/2022 and restore Judge Aswanto to his original position. Additionally, to prevent the misuse of power, further limitations and elaborations are required regarding the DPR's supervisory function over the judiciary, in this case, the Constitutional Court, in accordance with the system of checks and balances.
This study scrutinizes the status of the regulations enacted by the Nusantara Capital City Authority (IKN Authority) within the Indonesian legislative hierarchy, based on Law Number 3 of 2022, also ...known as the IKN Law. A normative research approach underpins this analysis, utilizing legislative and conceptual methodologies. The investigation concludes that the IKN Law’s Article 5 paragraph 6, was drafted to accommodate all regulations formulated by the IKN Authority. These regulations, born out of the authority's attribution, hold an equivalent standing to those issued by a minister, institution, or agency at the central level given that the IKN Authority is an institution at the ministerial level. Consequently, the formulation of these regulations adheres to the rules governing central-level regulations, with the Supreme Court conducting their review. The unique aspect is the subject matter, which relates to the governance structure of the IKN Authority. Moreover, the formulation of regulations by the IKN Authority should: 1) Define the IKN entity’s position as a unique regional government entity; 2) Outline the types of regulations to be enacted; 3) Clarify the source of authority, which is attribution-based; 4) Specify its position in the hierarchy, equivalent to Regional Regulations; 5) Detail the formulation process and treatment, aligning it with the creation of regional legal products; 6) Elucidate the subject matter of the Regulatory Authority; and 7) Highlight the review process, which can be escalated to the Supreme Court.
The debate on the absolute competency of the State Administrative Court in Indonesia to set the dispute over the State Financial Losses Report (LHPKKN) is proved to have caused dissenting opinion. ...The judgments between one administrative court to other court in Indonesia cause main problem of achieving justice and legal certainty. This research examines the issue of absolute competence of the Administrative Court in adjudicating disputes on the State Financial Losses Report published by the Financial and Development Monitoring Agency (BPKP). This article uses normative legal research and implement the statute approach, conceptual approach, and case approach. These approaches are used to discern and analyze several related legal materials or documents scientifically. The aims and objectives of this research are to find a legal solution on how this classic issue has to be approached and solved. As a result, it is found through this article that the Administrative Court has absolute competence in deciding disputes on the Report on the Calculation of State Financial Losses issued by the Financial and Development Monitoring Agency, which is supported by several fundamental reasons.

Namun realitanya saat ini, konstitusi negara Indonesia(UUD NRI 1945) masih belum sejalan dengan ...nilai-nilai konstitusionalisme itu sendiri. Hal ini dapat dilihat dari biasnya bangunan presidensialisme di Indonesia serta tidak jelasnya sistem kamar parlemen yang diterapkan di Indonesia, apakah berkayuh pada sistem parlemen tiga kamar ataukah pada sistem parlemen dua kamar. Tulisan hukum ini ditulis untuk mengkaji bagaimana desain ideal sistem pemerintahan presidensil dan kamar parlemen di Indonesia. Pada bagian akhir tulisan hukum ini, disimpulkan bahwa terdapat 5 gagasan yang perlu menjadi materi perubahan dalam UUD NRI 1945 dalam rangka mewujudkan sistem presidensil yang lebih murni. Selain itu, dalam upaya mempertegas parlemen dua kamar di Indonesia, langkah pertama yang harus dilakukan adalah merubah paradigma MPR yang semula dianggap sebagai sebuah lembaga yang memiliki keanggotaan tersendiri, menjadi MPR yang merupakan forum sidang gabungan antara DPR dan DPD. Selanjutnya, agar sistem parlemen dua kamar yang digagas menjadi lebih ideal, DPR dan DPD haruslah diposisikan dalam strata yang sama dalam hal fungsi dan kewenangannya
