<p class=MsoNormal style=text-align: justify; >Este libro, compuesto por doce capítulos, contribuye al
dialogo sobre la construcción de política pública sobre el desplazamiento
forzado y la garantía de los derechos de las víctimas del conflicto armado como
son la verdad, la justicia, la reparación y las garantías de no repetición,
desde una perspectiva local y participativa. Distintas experiencias
comunitarias sobre salud mental, seguridad alimentaria, educación, entre
otras, permiten contrastar la distancia que existe en el diseño e
implementación de las políticas públicas sobre el desplazamiento forzado que
se diseñan a nivel nacional frente a las necesidades concretas y realidades que
aparecen a nivel local. Esperamos que estas reflexiones sean un insumo para los
tomadores de decisiones y para todos los actores que participan en el proceso
de dignificación y garantía de los derechos de la población desplazada en
Colombia.

Maternity surrogacy aims to provide a child for one or more adults. This consists in the deliberate conception of a child, who is without a family of origin, by manipulating his birth and his ...biological mother to satisfy the desire of the beneficiary adults. Therefore, the legitimacy of surrogacy is at least debatable. However, considering the old realities of the current Romanian societies, in the present study we proposed by lege ferenda the possible implementation in the Romanian Civil Code of maternity-altruistic surrogate, under certain conditions.
In this paper, we wish to make a few comments on the third edition of the hungarian translation of the Romanian Civil Code, without claiming to be exhaustive. Our translation suggestions concern ...certain provisions of personal (and family) law, law of property and law of obligations. We will expand on the concepts of legal personality, legal capacity and capacity to act in the personal law section, the concepts of property and assets in the law of property section, and the relationship between the concepts of legal fact and deed in the law of obligations section, and then make translation and correction suggestions for all the other articles in the books mentioned.
The validity as an essential element of contract is the basis for achieving the economic purpose set out in in it. Without validity there is no legal way to enforce the contractual content. In ...addition to the identity of the theoretical foundations of the legal institution of validity, significant differences can be observed between Romanian and Hungarian law. Those differences justify the performance of a comparative legal study beside several other specific reasons. The first of the this special reasons is the cross-border economic relations and the Hungarian legal society in Romania, which can play a ‚bridge’ in this matter. The real need for professional co-operation between members of the same mother tongue lawyers results summaries of the conceptual issues based on comparative legal studies. For theoretical, scientific and practical purposes the study outlines the basic issues of the nullity and avoidance of a contract, the partly different basic positions of the two legal systems, the grounds for annulment and the legal consequences.
There is a legal vacuum that regulates the settlement and legal consequences of pre-contractual promises between parties in Indonesia. This research aims to examine the legal application of the ...Promissory Estoppel Doctrine in filling legal gaps while comparing it with a number of Common Law countries, including England, which implemented this doctrine earlier. This research uses normative legal research using a comparative approach, case approach and conceptual approach. The sources of legal materials in this research consist of primary, secondary and tertiary legal materials. The application of the Promissory Estoppel doctrine to the Indonesian legal system can be done because there are similarities between the legal system in common law (England, the Philippines) and the legal system in Indonesia, so that courts in Indonesia can use this doctrine to fill legal gaps. Pre-contracts have been regulated in such a way both through legislation and the application of relevant legal doctrines in a number of developed countries. with the doctrine of promissory estoppel, an agreement that has not fulfilled certain conditions or objects, in this case a pre-agreement, can protect a party who has placed a trust in another party in the process of carrying out negotiations which causes him to carry out certain legal actions (rechtshandeling) and causes the birth of reliance. loss. Promissory estoppel is an important concept in English law however, the legal requirements for promissory estoppel may differ from country to country.
Abstract
This introduction provides an overview of the concept and role of independent authorities in comparative public law, with a particular emphasis on Latin America. First, we outline an idea of ...these institutions and examine how they have assumed critical responsibilities traditionally allocated to one of the three branches of government. We also explore their role in protecting constitutional democracy and discuss some problems associated with their democratic legitimacy. Second, we outline these entities’ situation in Latin America, stressing how little academic attention they have received in contrast with their growing importance. Finally, we provide a critical review of each of the contributions to the symposium.
This work derives a right to access to personality development through parenthood, taking into account aspects of sociology of law and comparative law, as well as the state of discussion in moral and ...legal philosophy; and thus, defines new standards for the European human rights protection scheme and the fundamental rights protection of the German constitution. This refers to the right to form and develop one's own personality through the relationship with a child - as an integral part of one's identity. Based on this, the work examines the implications for a reorganization of German law on reproductive medicine and outlines the necessary consequential changes in family law.
