Reconstructing Rawls has one overarching goal: to reclaim Rawls for the Enlightenment—more specifically, the Prussian Enlightenment. Rawls’s so-called political turn in the 1980s, motivated by a ...newfound interest in pluralism and the accommodation of difference, has been unhealthy for autonomy-based liberalism and has led liberalism more broadly toward cultural relativism, be it in the guise of liberal multiculturalism or critiques of cosmopolitan distributive-justice theories. Robert Taylor believes that it is time to redeem A Theory of Justice’s implicit promise of a universalistic, comprehensive Kantian liberalism. Reconstructing Rawls on Kantian foundations leads to some unorthodox conclusions about justice as fairness, to be sure: for example, it yields a more civic-humanist reading of the priority of political liberty, a more Marxist reading of the priority of fair equality of opportunity, and a more ascetic or antimaterialist reading of the difference principle. It nonetheless leaves us with a theory that is still recognizably Rawlsian and reveals a previously untraveled road out of Theory—a road very different from the one Rawls himself ultimately followed.

The justification of the present study refers to the dilemma between whether or not to impose a tax on the labor automation process and, to what extent, such a measure can be considered fair. The ...theorization was built in two classic schools of moral philosophy, which offered assumptions capable of transcending their own time and guiding choices about the future of work and the role of taxation. The methodological procedure used was descriptive and exploratory. It was concluded, after analyzing the ethical theories of Rawls, Bentham and Mills, that it is imperative to establish some type of tax imposition capable of ensuring that the benefits of this new model of society are not monopolized by few and do not result in an aggravation of the inequalities historically experienced by our society. A justificativa do presente estudo refere-se ao dilema entre instituir ou nao uma tributacao sobre o processo de automacao laboral e, ate que ponto, tal medida podera ser considerada justa. A teorizacao foi edificada em duas escolas classicas da filosofia moral, que ofereceram pressupostos capazes de transcender seu proprio tempo e guiar escolhas acerca do futuro do trabalho e o papel da tributacao. O procedimento metodologico empregado foi descritivo e exploratorio. Concluiu-se, apos analise das teorizacoes eticas de Rawls, Bentham e Mills, ser imperativo o estabelecimento de algum tipo de imposicao tributaria capaz de assegurar que os beneficios desse novo modelo de sociedade nao sejam monopolizados por poucos e nao venham a resultar em um agravamento das desigualdades historicamente experimentadas por nossa sociedade. Este artículo presenta un análisis sobre justicia, oportunidades y capacidades en la educación inclusiva universitaria, desde la perspectiva de Rawls y Sen. Metodológicamente es positivista, ...descriptiva y diseño documental, analizándose investigaciones acerca del tema. Los resultados reflejan que a pesar de que la inclusión es un derecho asegurado por organismos internacionales y cada país ha formulado leyes, se evidencia en distintas investigaciones, que el proceso es más teórico que práctico, al existir carencias en las universidades para darle trato justo a personas con discapacidad, igualdad de oportunidades según sus capacidades. Por tanto, se propone un Modelo para la Efectiva Educación Inclusiva Universitaria, con fundamentación holística e integral, asumiéndose las condiciones socio económicas y culturales del estudiante, la formación docente, la actitud hacia la discapacidad que coadyuvan con la calidad de vida de los estudiantes en función de la equidad como libertad (Rawls, 1971), y el enfoque de capacidades (Sen, 2012). This article presents an analysis of justice, opportunities and capacities in inclusive university education, from the perspective of Rawls and Sen. Methodologically it is positivist, descriptive and documentary design analyzing research on the subject. The results reflect that although inclusion is a right guaranteed by international organizations and each country has formulated laws, it is evident in different investigations that the process is more theoretical than practical, as there are deficiencies in universities to give fair treatment to people with disabilities, equal opportunities according to their abilities. Therefore, a Model for Effective Inclusive University Education is proposed, with a holistic and integral foundation, assuming the socio-economic and cultural conditions of the student, teacher training, the attitude towards disability that contribute to the quality of life of these students based on equity as freedom (Rawls, 1971), and the capabilities approach (Sen, 2012). O presente artigo tem o condão de analisar o processo de construção de um espaço público democrático, a partir da teoria de justiça política de John Rawls, demonstrando como a prática pública da ...justiça, enquanto valor social compartilhado auxilia no estabelecimento de uma sociedade mais justa, capaz de enfrentar o fato do pluralismo e promover a tolerância, criando os meios para uma discussão política razoável em torno da justiça. Para tanto, em um primeiro momento analisa a relevância da liberdade para a consecução da prática pública da justiça como valor social democrático, e posteriormente os elementos do pluralismo e da tolerância, como fundamentais desde o princípio na sua proposta à concepção de justiça que comportaria uma visão plural de sociedade.

En primer lugar, intentaré mostrar que esta cuestión ...puede ser leída autónomamente y puesta a dialogar con otras formulaciones tradicionales de la felicidad. Y en segundo lugar, trataré de mostrar los problemas que conlleva una concepción objetiva de la felicidad como la que propone Rawls.
John Rawls desenvolveu sua teoria da justiça como equidade a partir da noção de que cabe aos próprios indivíduos estabelecer os princípios básicos de organização da sociedade. O autor considera que ...os membros devem estar numa posição original de igualdade envolvidos pelo véu de ignorância, capaz de evitar a influência de condições pessoais na escolha desses critérios. Tais princípios da justiça legitimariam uma sociedade democrática, pois fundamentados na liberdade e igualdade (ou respeito às diferenças). Entretanto, é comum que surjam divergências de interesses como decorrência natural das relações interpessoais, fator que representa um risco à manutenção do arranjo social. O presente artigo tem por objetivo mostrar que a mediação se apresenta como um mecanismo de tratamento de conflitos que melhor concretiza a teoria de Rawls, pois pretende o restabelecimento do vínculo entre as partes, permitindo aos envolvidos a construção pacífica da solução através da participação ativa na tomada de decisões.
This article will deal with some aspects concerning affirmative actions promoted by the State when, due to the omissions or the flaws of the policies, minorities rigths can only be protected by ...judicial interference, in order to provide access to fundamental goods and rights. Such a theme will be dealt with based on the views of John Rawls, especially in his major word, A Theory of Justice. In a rawls'ian perspective, the judicialization of politics can be seen as a jurisdictional procedure which aim is to provide, in a concrete way, the application of the principle of the access to equality, liberty and rights. Without intending to exhaust the theme, such a rawlsian perspective on the judicialization of politics will be set on the relationship between the judicialization and the dicotomy Lawpolitics. Neste artigo serao abordados alguns aspectos relativos as acoes afirmativas do Estado quando, em sua omissao ou falhas nas politicas publicas aplicadas, acabam os direitos de minorias somente sendo resguardados atraves de interferencia judicial, visando garantir acesso a bens e direitos fundamentais. Toda esta problematica sera abordada e correlacionada, ainda, na visao do autor John Rawls, com base em sua obra maior "Uma teoria de justica". Neste sentido, a judicializacao da politica pode ser interpretada como um procedimento jurisdicional ao qual pugna, em termos concretos, proceder a aplicacao do principio da igualdade e acesso as liberdades e direitos do Estado. Assim sendo, sem o objetivo de esgotamento do tema, sera apresentada problematizacao nesta seara, especialmente quando a judicializacao de politicas publicas se coloca em conflito com a dicotomia direito e politica.
